REGULAR MEETING
MIAMI SHORES VILLAGE COUNCIL
September 9, 1952

A regular meeting of the Village Council of Miami Shores Village,
Florida, was held at 7:30 o8 ock P.M. , September 9, 1952, at the Village
Hall, with the following Councilmen present:
Mayor M. E. Reynolds
George A. Frix
Michael J. Franco
William E. Carpenter
S. D. Phillips, Jr.
Absent: None
Mr. Thomas H. Anderson, Village Attorney, was also present.
Upon motion made by Mr. Frix, seconded by Mr. Phillips and
passed unanimously, minutes of the last regular meeting were approved as
written.
Mr. Anderson presented two proposed ordinances. The first read
by the Village Manager was an amendment to Ordinance No. 92 prohibiting
Bungalow Courts or Motor Courts in any district except south of 92nd Street
facing on Biscayne Blvd. Upon motion made by Mr. Carpenter, seconded by
Mr. Frix, ORDINANCE NO. 233 was unanimously passed and adopted, same
being entitled:
AN ORDINANCE AMENDING ORDINANCE NO. 92, BEING
THE ZONING ORDINANCE OF MIAMI SNORES VILLAGE.

The next ordinance read was an amendment to Ordinance No. 92
in regard to lot area requirements per dwelling unit for apartment houses.

Upon motion made by Mr. Phillips, seconded by Mr. Franco,, ORDINANCE
NO. 234 was unanimously passed and adopted, same being entitled:
AN ORDINANCE AMENDING ORDINANCE NO. 92, BEING
THE ZONING ORDINANCE OF MIAMI SHORES VILLAGE.
The Council instructed the Village Attorney to prepare a separate
ordinance on off-street parking which will be taken up at the next meeting.
The Village Attorney read a letter he had received from the Chief
of Police asking that an ordinance be prepared for consideration to give him
power to enforce obedience to parking signs and traffic signs at any location
where they are deemed necessary. Council agreed the Chief should have this
power and asked the Village Attorney to prepare something to effect this.
In regard to the cloud on the title to the Biscayne Kennel Club
property because of an error in some old tax foreclosures, it was requested
that the Village execute a Quit Claim,Deed to remove this cloud. Mr. Frix
moved that this form be executed. Motion was seconded by Mr. Carpenter and
passed unanimously.
The next item on the agenda was in regard to the boundary lines
for the Miami Shores Elementary School attendance. Mr. Phillips asked that
a resolution be passed and sent to the School Board, requesting that that part
of the Village lying west of N. W. 2nd Ave. be included in the Miami Shores
School area. After further discussion of this subject, the Mayor stated that a
resolution would be drawn up and all members of the Council who can do so
will be present at the School Board meeting at 2:30 on Wednesday.

Mrs. Walsh,of 358 N. E. 94th Street, again appeared before the
Council to ask for written permission to operate her kindergarden, which the
Welfare Department is requesting. Mayor Reynolds explained this this could
not be given because of the zoning problem involved.
Mr. Jarkesy appeared before the Council to appeal the Planning
Board's decision denying him permit to erect a motel on N. E. 92nd Street,
immediately west of Biscayne Blvd. Plans for this building were presented
by the architect, E. T. Reeder. The Mayor explained that the building could
not be approved for that location as motels were only permitted south of 92nd
Street fronting on Biscayne Blvd.
Mr. A. W. Thomas of 557 N. E. 92nd Street, appgared,'to make the
following complaints against the Pickin' Chicken Restaurant, - that it be closed
at midnight instead of 1:00 AM because of the noise they make in closing; that
something be done about the cooking odors and.that the monkeys be removed.
The Mayor explained that Mr. Arnold of the Planning Board has been working
with the owner of the Pickint Chicken Restaurant to make this place more
acceptable. Mr. Reynolds asked Mr. Thomas to get together with Mr. Arnold
to work out some solution to these complaints. He also added that the monkeys
are no longer there.
Mr. Charles Matheson, 534 N. E. 92nd St. , also mentioned that
the cooking odors are very bad and said he would contact Mr. Arnold. Mr.
Matheson also asked about the railroad,unloading on Sundays, etc. Mr. F. L.
Roberts of 546 N. E. 92nd St. said he had contacted the Greater Miami Traffic

Association concerning theF.E. C. and learned that the Railroad maybe
violating an Inter-State Commerce regulation by leaving cars too long on the
siding.
Mr. Richard Seip again appeared before the Council to petition
them to enforce the ordinance concerning noises which, as he previously
explained, are caused by the two air conditioning units in the house next door.
Discussion followed as to whether or not the Village could arrest a man causing
a nuisance wit4out a signed complaint from the person being annoyed. Some of
the Council agreed to visit Mr. Seip's home to find out how objectionable this
noise is.
After a review of the bills Mr. Frix moved that they be approved.
Motion was seconded by Mr. Franco and passed unanimously.
The meeting adjourned at 9:35 P.M.
