03-18-1952 Regular Meeting 45 REGULAR MEETING MIAMI SHORES VILLAGE COUNCIL March 18, 1952 A regular meeting of the Village. Council of Miami Shores Village, Florida, was held at 71.30 o'clock P.M. , March 18, 1952, at the Village Hall, with the following Councilmen present: Mayor M. E. Reynolds George A. Frix Michael J. Franco S. D. Phillips, Jr. Absent: William E. Carpenter Mr. Thomas H. Anderson, Village Attorney, was also present. Upon motion made by Mr. Frix, seconded by Mr. Franco and passed unanimously, reading of the minutes of the last regular meeting was dispensed with and they were approved as written. A letter was received and read from the Florida East Coast Railway Company wherein they acknowledged receipt of Ordinance No. 229 concerning the hours of switching operations and stated that although the ordinance, in their opinion, is probably unconstitutional, they will endeavor to comply with it, barring emergencies. Next was the Planning Board recommendation concerning the American Legion petition for permit to build a home. This involves the re- zoning of the N.W. 100 sq. ft. of Tract A, Shores Center Subdivision to- permit opermit a Legion home in an. A-1 zone and it was unanimously recommended by the Board that this petition be approved by the Village Council. After some of the objections were heard concerning this location, Mr. Frix moved that 46 1 47 3/18/52 the Village Manager be instructed to notify all affected property owners of a certain time to appear before the Council for discussion of this petition in accordance with Ordinance No. 227, an amendment to Ordinance No. 92. Motion was seconded by Mr. Phillips and passed unanimously. Concerning the ordinance to close certain streets west of .N. W. 2nd Avenue, it was _recommended by the Village Manager that the people interested should get a legal commitment from the owners so that they will agree to carry out their part of the deal before the ordinance is passed. The following Advisory Board recommendations were read: Swimming Pool - 1952 season Single Freeholder Membership $40. 00 Family Freeholder Membership $60. 00 Non-freeholder single Membership $60. 00 Non-freeholder family Membership $80. 00 Daily fees fifty cents (50}) per day for freeholders and dependent members of their family, who shall obtain an identification card from the Miami Shores Village Manager's office. Each identification card is to be signed at the time of receipt by the holder, and presented at the pool each time swimming privileges are exercised. Non-freeholders shall pay a daily fee of eighty cents (80�). Greens Fee Due to the decrease in number of greens fee players, the Advisory Board also voted to request the Council's approval to reduce the greens fees to Three Dollars ($3. 0.0) for the month of April, begin-- ning.April 1st. Mr. Marshall Luce of the Advisory Board, explained to the Council their reasons for the recommended fees on the swimming pool. He also reported on the revenue made from the Golf Course this year and added that for more ae 1 1 49 -3- 3/18/52 efficient operation they would like to build a slat house and equipment shed somewhere on the Golf Course property which should be taken into consider ation in next year's budget. Upon motion made by Mr. Phillips, seconded by Mr. Franco, and passed unanimously, the swimming pool rates as recommended by the Advisory Board were passed unanimously. Concerning the daily greens fee of $3. 00 for the mouth of April, Mr. Franco moved that it be approved. Motion was seconded by Mr. Frix and passed unanimously. On the unfinished business, the request to build on Lot 8, Block 11, Pasadena Park, was again reviewed. Mr. Taintor argued further against issuing such a permit. Mr. Fitzgerald, the builder, presented plans of two houses that would fit on the lot, observing required set backs. Finally, Mr. Frix moved that the petition be denied. Motion died for lack of a second. Mayor Reynolds then asked that this be postponed for a special meeting when all Councilmen are present This meeting was tentatively set up for Friday at 6:30 P.M. at the Village Hall. The Village Manager reported that toe North Dade Planning Council would like to meet at the Village Hall on March 28 and the Village Council are invited to attend. The next business was a review of the proposal to purchase ten feet of Lot 3, Block 83, to make the alley passable for Village vehicles. The Village Manager reported that on contacting real estate people, he was advised that $250. 00 is a fair price for this land, which the owners are willing to accept. sa 1 1 1 51 -4- 3/18/52 Thereupon Mr. ]Phillips moved we buy the ten feet of land. Motion was seconded by Mr. Franco and passed unanimously. Mr. William Hagearty, as spokesman for the Miami Shores Citizens Protective Association, organized to help fight the re-zoning of Biscayne Blvd. , submitted to the Council the proposition that the Village buy the land involved in this suit. He also mentioned that the Association was of the opinion that the motel at 105th Street was being run as a motel illegally and contrary to zoning regulations and that the Village should stop this operation. It was explained that the Council has discussed this matter several times and that it appears there is nothing the Council can do about it. After further discussion.on the Boulevard zoning case, Mayor Reynolds stated it is the request of the Council that this Association coordinate the actions of its attorney more closely with ours and that we, as the Council, have nothing to do with the suit at this time, nor can we say anything about it until it is decided whether or not the matter will have to be brought before the Council to act upon.
