01-15-1952 Regular Meeting 15 ` REGULAR MEETING MIAMI SHORES VILLAGE COUNCIL January 15, 1952 A regular meeting of the Village Council of Miami Shores Village, Florida, was held at 7:30 o'clock P. M. , January 15, 1952, at the Village Hall with the following Councilmen present: Mayor M. E. Reynolds George A. Frix Michael J. Franco William E. Carpenter S. D. Phillips, Jr. Absent: None Mr. Herbert Nadeau attended in the absence of Mr. Anderson, Village Attorney. Mr. Mason appeared before the Council in behalf of Mr. Dickinson.. He presented the tracing of the revised plat of Miami Shores Lake Subdivision with the changes made as suggested by the Council at a previous meeting. The original plat was brought forth for comparison. There was some discussion about the grading, whether or not piling would be required and of the natural shelf which is there at present. Mayor Reynolds requested Mr. Garris, the engineer of the revised plat, to present a certified report as to the (a) grading, (b) piling, and (c) present underlying shelf. Mr.' Mason expressed the desire to save..time and the Council agreed that when the engineer's report was presented, the Council would hold a brief meeting to review the certification and pass the resolution. Mr. -Don Nicholson, attorney, representing the Florida East Coast Rail- road, appeared to discuss a proposed ordinance regarding changes of the present hours for loading and unloading of freight cars.. Hours were changed to 7:00 Am is 1 1 174 to 9:00 PM. However, in cases where there is a breakdown or another type of emergency which calls for work before or after specified hours, the Railroad will not.be penalized. The matter of the siding south,of 6th Avenue being used almost continually at the present time for loading and unloading of materials for areas far removed from Miami Shores Village, has been referred to the Village Attorney. The Railroad is governed by the Waybill and once the car is spotted the Railroad has no control over the loading or unloading by trucks from the fight cars. Therefore, a separate ordinance is to be written regarding the loading and unloading by trucks from this siding,and .their li;nitations, thus placing the responsibility on the trucker instead of the Florida East Coast Railroad. Mr. Rudnick asked about the investigation regarding the Miami Shores Motor Lodge. Mr. McCall advised him it is still in the hands of the City Attorney, Mr. Anderson. A question was raised as to the boards and weeds on the lot at 92nd ,Street and Biscayne Blvd. The Council made a notation to have Mr. Byrd remove the boards and debris and cut the weeds. Mr. Byrd was advised to hold the boards at the shop. There being no further business the meeting was adjourned. Deputy Clerk Approved.- Mayor Approved:Mayor 18 1
