REGULAR MEETING
MIAMI SHORES VILLAGE COUNCIL
April 17, 1951
A regular meeting of the Village Council of Miami Shores Village,
Florida, was held at 7:30 o'clock P.M. , April 17, 1951, at the Village Hall,
with the entire Council and the Village Attorney present.
Upon motion made by Mr. Carpenter, seconded by Mr. Mackenzie
and unanimously carried, reading of the minutes of the last regular meeting was
dispensed with and they were approved as written.
The first business of the evening was to canvass the results of the
Council election of April 10th. The Village Manager reported that the total number
of registered voters was 2724. Of this number, 1234 people participated with
the votes cast as follows:
Michael J. Franco 722
William E. Hagearty 678
Sion D. Phillips, Jr. 692
M. E. Reynolds 747
John A. Wall 455
Mr. Reynolds and Mr. Franco were elected to four year terms,
and Mr. Phillips, a two-year term.
Upon motion made by Mr. Mackenzie, seconded by Mr. Carpenter
and passed unanimously, returns of the election were accepted as presented
and declared official.
Before the new Council was sworn in, Mayor Frix thanked each
member of the Council that had served with him for their fine spirit of cooper-
ation. He stated that he had been an unusually good and harmonious Council and
pointed out that during the past two years, 292 motions had been passed and out

of that number, 275 had been unanimously carried, or a percent of 94. Further,
he expressed his gratitude to Mr. McCall for all his assistance, to Mr. Anderson,
Village Attorney; to Chief Senneff and the Volunteer Police and Firemen; to
Glen Byrd, our Park Superintendent; to Mr. Hansell, the Building Inspector;
to Mr. Smith, Finance Officer, and all the other employees working at the Village
Hall, as well as, to Mr. Ward and the Chamber of Commerce.
Mr. Ward, in turn, asked for a standing vote of thanks to the Mayor
for the good work done in the past two years, which was unanimously given.
At this point Mayor Frix introduced Honorable George E. Holt,
Circuit Judge, and first Village Attorney serving from 1932 to 1941, who
administered the oath of office to the newly elected Councilmen.
Next was the election of Mayor. Mr. Franco nominated M. E.
Reynolds. Motion was seconded by Mr. Carpenter and carried. Mr. Frix then
turned the chair over to Mayor Reynolds who presented Mr. Frix with a scroll
of appreciation for his services rendered as Mayor. The Village Manager then
added Mr. Frix's picture to those of the former Mayors of Miami-Shores.
Mayor Reynolds then welcomed Mr. Phillips, the new member, to the Council.
The next business was in regard to a letter from Mr. Ansin
requesting change of use of his property from apartment to hotel. Mr. Frix
moved that the Village Manager be instructed to answer Mr. Ansin's letter
and advise him to discuss the matter with the Planning Board. Motion was
seconded by Mr. Franco and passed unanimously.
A letter was read from Dr. Cato, Health Commissioner, requesting

permission to add Sodium Fluoride to the city water supply to help prevent
dental decay. Upon motion made by Mr. Frix, seconded by Mr. Carpenter,
this approval was unanimously granted.
A petition was received and read from the property owners in the
vicinity of the Burke property (101st Street at the Bay), demanding that the
Village cease using this property for trash dumping and burning. The Village
Manager reported that it would cost an additional $500. 00 per year to use the
trash dump in. North Miami. He added that he had some new ideas for reorgan-
izing the Garbage Collection Department and thought that some economy measures
could be effected. The Mayor asked Mr. McCall to make a short report on
what he had learned on this subject at the City Managers Short Course. After
discussing how the situation might be alleviated before the new fiscal year and
the cost of accomplishing same, Mr. Carpenter moved that the Village Manager
be authorized to proceed with negotiations with the City of North Miami for the
purpose of supplementing our contract with the addition of trash dumping; to
proceed immediately and to notify the property owners who signed the petition.
Motion was seconded by Mr. Phillips and passed unanimously.
Mr. Franco then asked about an ordinance to prevent anyone else
from using this property for a trash dump. The Village Manager stated that
he thought the present ordinance on lot cleaning was sufficient. Council
instructed that the Village Manager check this ordinance.
Next, the Village Attorney brought up the Ellis suit. He recommended
for the final hearing before the Supreme Court, that a replica be made of the
block of land in which the Ellis lot is located and another replica of a block

outside of the Village for a comparative picture of how this change would affect
the appearance of the Village. Cost of this replica is $ 500. After discussion,
Mr. Carpenter moved that the Village Attorney be authorized to have the Burke
Company build scale models of the two blocks mentioned for evidence in the
Ellis case now in the Supreme Court. Motion was seconded by Mr. Frix and
passed unanimously.
Mr. Carpenter and Mr. Steve McCrimmon discussed the traffic
hazard existing at Miami Avenue and 91st Street. Because the Miami Avenue
traffic is being diverted from N. W. 7th Ave. which is being repaired, Mr.
Phillips thought we should contact the County for assistance. The Chief of
Police thought they might either loan the Village a traffic light or a patrolman
for this corner temporarily and he was instructed to contact the Chief of the
Road Patrol for assistance.
A resolution was presented to effect authorization for the new mayor
to sign checks drawn on the seven existing bank accounts of Miami Shores
Village. Upon motion made by Mr. Frix, seconded by Mr. Franco, RESOLUTION
NO. 319 was unanimously passed and adopted.
After a review of the unpaid bills, Mr. Carpenter moved that they
be paid. Motion was seconded by Mr. Franco and passed unanimously.
Mr. Phillips expressed his appreciation to the people who voted
for him and to the Councilmen for all assistance they might give him.
Before the meeting finally adjourned Mrs. Edith Scully spoke to
the Council in regard to a 50 ft. lot she owns on Grand Concourse. The Village

Manager was instructed to assist her in selling her lot to the neighboring
property owners.
