03-06-1951 Regular Meeting 25 REGULAR MEETING MIAMI SHORES VILLAGE COUNCIL March 6, 1951 A regular meeting of the Village Council of Miami Shores Village, Florida, was held at 7:30 o'clock P.M. , March 6, 1951, at the Village Hall, with the entire Council and the Village Attorney present. Upon motion made by Mr. Reynolds, seconded by Mr. Franco and unanimously passed, reading of the minutes of the last regular meeting was dispensed with and they were approved as written. Mr. Perry Willits, President of the Advisory Board of the Country Club, appeared before the Council to present a recommendation unanimously approved by the Board for the reconditioning of the golf course. This recommend- ation included the replanting and resurfacing of 9 greens and fairways at a cost of around $10, 000, as well as, the employment of Mr. Mark Mahannah, greens- keeping consultant, at a salary of $1800 a year to supervise this reconditioning program. After discussion Mr. Mackenzie moved that the entire recommenda- tion be adopted as requested. Motion was seconded by Mr. Carpenter and unanimously passed. Mrs. Emily Frances Speers of 10659 N. E. 10th PL , was present to appeal a recent Planning Board decision whereby her request to add another one car garage to her home was denied because the minimum side line require- ments could not be maintained. Council suggested that this be referred back to the Planning Board and that Mrs. Speers appear at their meeting to person- ally explain her request. The next item on the agenda was in regard to the ordinance 26 G 27 - 3/6/51 -2- concerning roofing, read and discussed at the last meeting. The Building Inspector introduced Mr. Steve C. Raymond of the South Fla. Roofing & Sheet Metal Contractors Assoc. , who satisfactorily explained the use of the specified metals for stripping. Upon motion made by Mr. Mackenzie and seconded by Mr. Reynolds, ORDINANCE NO. 217 was unanimously passed and adopted, said Ordinance being entitled: AN ORDINANCE REGULATING THE ERECTION, CON- STRUCTION, FABRICATION, APPLICATION OR REPAIR OF A ROOF COVERING AND/OR SHEET METAL WORK IN MIAMI SHORES VILLAGE, FLORIDA; ETC. A resolution was presented by the Village Attorney concerning authorization to purchase property for a right-of-way for 105th Street running west of Biscayne Blvd. Upon motion made by Mr. Reynolds, seconded by Mr. Mackenzie, RESOLUTION NO. 318 was unanimously passed and adopted. The N. E. 2nd Avenue zoning suit was the next item to be discussed. The VillageAttorney reviewed all that had transpired in this case to date, - the decision rendered against the Village in the Circuit Court, court costs of $486. 00 assessed against the Village and the 60 days in which to file notice of appeal, also the probable cost of appealing the case to the Supreme Court. Mr. Jerome Hofmayer, unofficially spoke for the interveners, and emphasized that they were anxious to have the Council appeal the case. After further dis- cussion, Mr. Carpenter moved that the Village Attorney be authorized to file notice of appeal at a date tactically correct in his judgment. Motion was seconded by Mr. Reynolds and passed unanimously. 28 29 -3- 3/6/51 Power company franchise - the Village Manager reported that he had asked the Rader Kanppen Tippetts Engineering firm to give him an estimate of the cost of making a survey for the Village. As soon as Mr. McCall receives this information he will contact the Council by phone for approval of cost before going ahead. A letter was read from the Little River Business and Professional Women°s Club in which they asked the Village for a contribution for prizes for their Amateur Night to be held on March 30th. After a discussion of this request Mr. Mackenzie moved that the Village Manager be instructed to answer this letter in a favorable manner and state that we have no funds available at this time for this expenditure. Motion was seconded by Mr. Carpenter and passed unanimously. The Village Manager reported that the Chief of Police had not been able to complete his report on the traffic light survey by this meeting. The Village Manager reported that he had talked with Mr. Curry of the Port Authority concerning the airplanes flying over the Village. How- ever, due to the flight patterns, Mr. Curry stated there was no way the planes could be diverted so that the volume of air traffic could be eliminated over the Shores.
