REGULAR MEETING
MIAMI SHORES VILLAGE COUNCIL
May 3, 1949
A regular meeting of the Village Council of Miami Shores Village,
Florida, was held at 7:30 o'clock P.M., May 3, 1949 at the Village Hall, with
the following Councilmen presents
Mayor Roy Mackenzie
L. J. McCaffrey
M. E. Reynolds
George A. Frix
Absents Howard I. Parish
Mr. Anderson, Village Attorney, was also present.
Upon motion made by Mr. McCaffrey, seconded by Mr. Frix and passed,
reading of the minutes of the last regular meeting and a special meeting of
April 21, was dispensed with and they were approved as written.
Mr. George Sultzbach of 9618 N. Miami.Avenue was present to petition
the Council to stop his neighbor from building a boat nextdoor to him since the
noise was causing a public nuisance. As it was the Council's understanding when
permission was granted to assemble this boat, that it would not take more than
a few months, it was pointed out that Mr. Orleman, owner of the boat, was taking
unfair advantage of the situation. Thereupon Mr. Frix moved that the Village
Manager be instructed to lookinto this building and if, in his opinion, it con—
stitutes a nuisance, to order an immediate abatement of the boat building enterprise
at Mr. Orleman's residence. Mr. McCaffrey seconded the motion and it was passed
by a 3/1 vote, with Mr. Reynolds dissenting.
Next the Village Manager read a proposed resolution No. 295, entitled:
A RESOLUTION FOR THE TECONTROL OF RENTAL UNITS IN MIAMI SHORES
VILLAGE, PURSUANT TO THE HOUSING AND RENT ACT OF 1947, AS AME MD.
Upon motion made by Mr. McCaffrey, seconded by Mr. Reynolds and
unanimously passed, the above mentioned Resolution No. 295 was adopted. A public

hearing on rent decontrol was set for May 17, the next regular Council meeting.
The next item on the agenda was in regard to the petitions signed by
the residents of 95th Street, requesting that the Council prohibit truck traffic
from their street. The Village Manager reported that the County planned to
make 95th Street a four-lane highway from N. W. 27th Avenue to N. E. 6th Avenue.
After a discussion of how this traffic could be diverted or prohibited from
crossing through the Village, Mr. McCaffrey moved that the City Manager be instructed
to go into this situation in detail and report back at the next meeting his find-
ings and recommendations for handling truck traffic in the Village. Motion was
seconded by Mr. Reynolds and passed unanimously.
The Village Manager reported that a letter had been received from
Mr. W. D. Besselieu of Stevens Pictures which stated that Mr. Alex Munson of 662
N. E. 105th Street, had presented the Village with a 16 MM sound projector for use
by the city employees and that Stevens Pictures, Inc. would furnish filns free for
such exhibits. Mr. McCaffrey moved that the Village Manager be instructed to
write a letter of acknowledgment and thanks to both these gentlemen, Mr. Munson and
Mr. Besselieu. Motion was seconded by Mr. Frix and passed unanimously.
The next item on the agenda involved the house at /x,28 N. E. 91st St.
which is still being used as a multiple family unit in violation to the Zoning
ordinance. Upon motion made by Mr. McCaffrey, seconded by Mr. Frix and unanimously
passed, Village Attorney was instructed to take necessary action to enforce our
zoning regulations at this residence.
A report from the engineer of the swimming pool was read, in which he
recommended that the concrete be allowed to age about 10 months before caulking
any cracks that have appeared. After a discussion of the construction of the pool
and the contractorts responsibility, Mr. Reynolds moved that the Village Manager
be instructed not to make any further payments in connection with the pool contract

until final approval is given by the Council. Motion was seconded by Mr. McCaffrey
and passed unanimously.
The next item on the agenda was in regard to a proposed legislative
act concerning joint authority for water and se!gage systems in the Greater Miami
area, sponsored by Commissioner Wm. W. Charles of Miami. Council instructed that
the Village Manager and Village Attorney look into this proposal with recommends,
tions for future action.
A request was made for repaving N. W. 2nd Avenue north of 105th Street
and N. W. 109th Street west of Miami. Avenue. Since the budget account for street
paving is already expended for the current year.. Council instructed that this
paving be deferred until money can be allocated in the next budget.
The Council approved the proposal:ibr• a "Miami Shores Night" at the
Dog Track, with the suggestion that the Mayor attend on behalf of the Village.
Village Manager received approval of the Council to attend the City
Managers Short Course at the University of Florida, May 5, 6, and 7.
A resolution was presented_by the Elk's Club in support of the plan to
secure for the Miami area the proposed State Medical College. Mr. Frix moved
that the Village Attorney be instructed to prepare a similar resolution introduc-
ing the acquisition of a medical school for the Greater Miami area. Motion was
seconded by Mr. McCaffrey and passed unanimously.
The Village Manager next reported that a request had been made for a
permit to construct storm shutters at 8990 Biscayne Blvd. It was Mr. Reynolds'
opinion that this would be permissible if the two other tenants in the building
had no objections and that no supplies would be maintained outside the building.
Discussion followed as to whether or not this would be in violation to the Zoning
ordinance and Council deferred action until it can be determined if this business

would be classed as retail or wholesale.
At this point Mayor Mackenzie brought up the subject of the many complaints
being received about the swimming pool fees. Mr. Frix stated he had never been
advised of the increased rate on weekends, and that the brochure hadn't mentioned
the additional fee. It was Mr. Reynolds' suggestion that the Council have a
meeting with the Golf Club Directors and all Committee Chairmen. The Council
instructed that this meeting would be held in the Village Hall, at 7:30 P.M.,
Wednesday, May 11, and that all concerned should be notified by mail.
One of the Villagers was present to ask the Council if anything can be
done to prevent people from keeping a barking dog that causes a public nuisance.
It was suggested that the Police Department be called in the case of persistent
and annoying barking and they will make an effort to have it stopped, without
requiring a signed complaint.
' As a result of a dangerous condition existing on the Golf Course where
children on bicycles are crossing the greens, Mr. Reynolds suggested that an
underpass be constructed at Grand Concourse and the railroad. It was suggested'
that the Village Manager get some figures on the approximate cost of such an
underpass so that it can be considered in the next budget.
Mr. Reynolds suggested that when the assessments are completed on
business property, the Council should review them to see that they are in line
with the value of the property.
The meeting adjourned at 10:00 P.M.
