REGULAR MEETING
MIAMI SHORES VILLAGE COUNCIL
April 5, 1949
A regular meeting of the Village Council of Miami Shores Village,
Florida, was held at 7:30 P.M., April 5, 1949 at the City Hall, with the follow-
ing
ollowing Councilmen present, as well as the Village Attorney:
Roy Mackenzie, Mayor
L. J. McCaffrey
M. E. Reynolds
Howard I. Parish
Councilman George A. Frix arrived after the meeting was in progress.
As this meeting primarily was to discuss proposed changes in the Village
Charter, invitation had been extended to the residents of Miami Shores to attend
and there were about 75 Villagers present.
Upon motion made by Mr. Parish, seconded by Mr. Reynolds and unanimously
carried, the reading of the minutes of the last meeting was dispensed with and
they were approved as written.
The next item on the agenda was a request made by Mr. John Bauer of
70 N. E. 101st St. to allow him to pay for garbage service on a half-year basis
since he only lives here 5 months each year and did not get the benefit of Homestead
exaTtions. It was agreed by the Council that adjustments should be made in such
cases and it was instructed that the ordinance be amended accordingly.
Mr. Carroll's request for considerationof a reduction in the cubic
content of his proposed home, was deferred as he was not present to discuss the
case.
Mr. W. H. Walker, Jr., President of the Golf Club Committee, presented
the Council with a letter outlining the swimming pool fees and memberships, the
additional cost to finish the pool and a plan of financing to carry out these
recommendations. After a discussion of these items, Mr. Parish moved that the

recommendations of the Golf Club Committee be approved. Motion was seconded
by Mr. McCaffrey and passed unanimously.
The Village Attorney then explained to the audience the reasons for
the changes to the Charter. A discussion ensued as to whether or not the hiring
and firing of the Police and Fire Chiefs should be under the direction of the
Council or the Village Manager. It was finally moved by Mr. Reynolds that, under
the proposed Section 29 of the Charter, concerning appointments by the Council,
the words, "Chiefs of Police and Fire" be added. Motion was seconded by Mr.
McCaffrey. At this point Mr. Parish questioned the motion on the principle it
involved whereby the Village Manager would be held responsible for the proper
functioning of the Police Department without the authority to do so. It was Mr.
Reynolds' opinion that the Council should handle this appointment and/or sus-
pension for better control, and to continue the administration of what he termed.,
"a. Council-form of government."
A roll call was taken of the vote with the following results:
Mr. Reynolds "Yes"
Mr. McCaffrey "Yes"
Mr. Mackenzie "Yes"
Mr. Frix "Yes"
Mr. Parish "No"
Thereupon the motion was passed on a 4/1 vote.
All other changes were discussed and accepted as written.
The next item from the agenda to be considered was the Planning Board's
recommendation concerning fences which stated "that that portion of a fence
placed between the front line of a lot and the building setback line should not
exceed * ft. in height." Upon motion made by Mr. Reynolds, seconded by Mr. Parish
and passed unanimously, this recommendation was adopted.
Discussion of rezoning of the Wolfe property was postponed until a
review was made of the wording of the Final Decree issued in this case.

In regard to the unfinished house and the contractor's request for
permission to complete it as an Owner builder, Mr. Frix moved that the Council
authorise the Village Manager to use his discretion in getting the house completed
subject to its final approval by the Building Inspector. Motion was seconded
by Mr. Parish and passed unanimously.
In discussing the delinquent taxes on the American Legion lots, it
was pointed out that they should have been exempted the same as previously done
on church and school property. Therefore, Mr. Parish moved that we cancel the
unpaid taxes in the amount of $147.75 and that in the future they will be taxed
the same as vacant church property. Mr. Frix seconded the motion and it was
unanimously passed.
Mr. Willits then went over with the Council each item of additional
expense to his original swimming pool contract, explaining why it was necessary.
Upon motion made by Mr. Parish, seconded by Mr. Frix and passed unanimously, the
Council approved completion of Mr. Willits' contract with the addition of all items
enumerated in his letter of April 1+.
The next item from the agenda was a request to send a Policeman to
Washington with the Miami Shores contingent of the School Boys Patrol, to attend
a national meeting of the School Patrols. Council agreed that the expense involved
would not be justified and suggested that some civic group, such as the Daddies
Club, finance the trip if they deemed it beneficial.
The Police Chief's request for consideration of an ordinance requiring
the registration and finger—printing of all people employed in the Village was
deferred until the Chief would be present to explain his reasons for this request.

operation on or about April 15th.
Plans are being made for announcements to be railed to all
residents of the Village not later than Monday April 11th
advising that a water show will be held Friday evening
April 15th and the pool open for swi=ing on Saturday Anril
16th.
The following schedule of charges for swimming privileges
is herewith submitted for your consideration and approval,

Those who do not have annual swimrAng priviledges may use the
pool on a daily basis of $1.00 per person for week days and
$1.50 on Saturday, Sundays, and Holidays. If sufficient
interest is sown the pool will be reserved on Sundays and
Thursdays.lfor holding anMal swim privileges. It is antici-
pated the above charges will bring not less than $25,000 income
to the Club.
However , before any such income can be obtained it will be necessary
that the following items be secured so that the pool facilities
