REGULAR MEETING
MIAMI SHORES VILLAGE COUNCIL
March 15, 1949
A regular meeting of the Village Council of Miami. Shores Village.,
Florida, was held at 7:30 o'clock P.M., March 15, 1949 at the City Hall, with
the following Councilmen present; as well as, the Village Attorney:
Roy Mackenzie, Mayor
L. J. McCaffrey
M. E. Reynolds
Howard I. Parish
Absent: George A. Frix
Upon motion made by Mr. Parish, seconded by Mr. McCaffrey and
unanimously carried., the reading of the minutes of the last meeting was dis-
pensed with and they were approved as written.
Mr. Frank A. Howes of 428 N. E. 91st Street, appeared before the
Council to appeal his zoning violation with regard to maintaining multiple
family occupancy at said address. The Village Attorney explained the background
of the case wherein the former owner, Mr. Palumbo, was informed that he was
violating the Zoning ordinance by maintaining apartments at this address. This
case was never followed up and according to Mr. Howes, the House was sold to
him without knowledge of any legal action pending against the former owner. It
was also Mr. Howes' opinion that since this house was built before the incorpor-
ation of the Village, the zoning restrictions did not apply. However.. it was
pointed out that the two apartments in the main house were constructed after
that time without building permit.
After a lengthy discussion concerning the advisability of making
exceptions to the Zoning ordinance, the precedence it would establish, etc.,
Mr. Parish moved that the Council reject the petition of Mr. Howes to maintain
his residence at 428 N. E. 91st Street as a multiple family dwelling. Motion

was seconded by Mr. McCaffrey and, upon,,-vote, passed unanimously.
Appointment of Building.. Electrical and Plumbing Board members
for 1949 was deferred until next meeting.
Mr. Paul Palmer of 1222 N. E. 91st Street was present to determine
if the Council would favor a petition from the home owners in his neighborhood
to be incorporated into Miami Shores Village; the territory in question being
east of 10th Avenue from N. E. 88th Street to 91st Terrace and extending east
to the Bay. Mr. Parish moved that the Council will act favorably on a petition
for incorporation, provided same will show consent of at least two-thirds of
the residence owners. Motion was seconded by Mr. McCaffrey and passed unanimously.
Consideration of the swimming pool budget was postponed until
the next meeting, when Mr. Fri.x will be present.
It was the Village Manager's suggestion that an ordinance be
adopted by Miami Shores to set up legal amounts for traffic fines and bonds.
Upon suggestion of Mr. Parish, Council asked that this be put into a definite
recommendation.
In a discussion of the unpaid bills for the month of February,
it was suggested that they be listed in more detail and that the Village Manager
should approve all Purchase Orders. It was moved by Mr. Parish, seconded by
Mr. McCaffrey and passed unanimously that they be paid.
Meeting adjourned at 9:05 P.M.
