12-07-1948 Regular Meeting i REGULAR MEETING MIAMI SHORES VILLAGE COUNCIL December 7, 1948 A regular meeting of the Village Council of Miami Shores Village, Florida, was held at 7:30 o'clock P.M., December 7, 1948 at the Municipal Office, with the following Councilmen present: Roy Mackenzie, Mayor L. J. McCaffrey Howard I. Parish M. E. Reynolds George A. Frix Mr. Anderson, Village attorney, was also present. Upon motion made by Mr. Frix, seconded by Mr. McCaffrey and unanimously passed, the reading of the minutes of the last meeting was dispensed with and approved as written. The first item brought before the Council was the requests for street lights. It was agreed after discussion that the following lights were badly: needed, - three overhead bracket type on N. E. 105th Street and one white- way underground to be turned on between Biscayne Blvd. and 10th Avenue on 96th Street. It was moved by Mr. Parish, seconded by Mr. Reynolds and unanimously approved that these lights be installed. The next item on the agenda was a letter of complaint from a property owner, Mr. James A. Sadler. It was suggested that the Village Manager answer Mr. Sadler's letter, giving him the information he requested regarding assess- ment values, etc. Concerning the Legion Home, it was reported by the Village t3anager that Mr. Brockway had recently stated that the Golf Course site was not acceptable to him as a central location for the building and that he meant to so inform the Legion by letter. Notwithstanding this, Mr. McFarland, on behalf of the American Legion, was present to suggest that a meeting be arranged to i -2- get together on the proposed site to discuss terms and other conditions regarding a 99-year lease of the property and in this way both the Legion and the Council will have fulfilled their part of the agreement. At a previous meeting the Legion stated they would be willing to assume all court costs incurred by the Village in the Zoning suit against their property on 96th Street, in exchange for this piece of land on the Golf Course. Councilman Parish did not believe that this, in any way, would justify giving or leasing to the Legion any tract of land belonging to the people of the Village. He stated that the Council had no right to give away Village property to any group or organization regardless of its merit. Further, he asked the Council to recall their previously made unanimous agreement to grant the Legion a piece of property only in a fair and equitable exchange for their property on 96th Street. The principle involved in this proposed unbusinesslike deal is one to be seriously considered, he continued, so that no discrimination will have to be made against other organizations who might request property of the Village. Councilman McCaffrey explained that at a public meeting three years ago the people of Miami Shores unanimously agreed to give the Legion a tract of land on the Golf Course for their home. Mr. Reynolds stated that the Council was empowered to make a grant on the strength of unanimous public approval. It was Mr. Frix's opinion that we should get a definite answer from Mr. Brockway on his acceptance of this site for construction of the Legion home before any action is taken. Council agreed to postpone further action until that time. Mr. Paul whose home is directly behind the new City Hall on N. E. 101st Street, asked the Council if it were going to be possible to erect a solid wall at the rear of the City Hall property line to protect his home from some of the noise and lights caused by parking. The Village Manager -3- stated that a block wall will cost about $600 and suggested that the Council postpone definite action on this at the present time with the assurance to Mr. Paul that something will be done when money is available. Mr. McCaffrey brought up the question of paving the alleys. He stated that the sidewalks crossing the entrances to the alleys were in very bad condition and suggested immediate paving from the street up to where the side- walks cross the alleys and repair sidewalks at said crossings. Mr. Anderson again brought up a complaint about trucks using the alley behind his house at a very early hour in the morning. Until it is determined what mills company's truck goes through at that time, nothing can be done. Council approved draft of letter to be sent to Villagers concerning proposed plan for completing construction of the swimming pool. Meeting adjourned at 9:35 PM. c Village ager a Clerk APPROVED; Mayor
