08-17-1948 Regular Meeting 151 REGULAR 12MTING MIAMI SHORES VILLAGE COUNCIL August 17, 1948 The regular semi-monthly meeting of the Village Council of Miami Shores Village, Florida was held at 7:30 o'clock P.M., August 17, 1948 at the Municipal Office, with the following Councilmen present: L. J. McCaffrey M. E. Reynolds Howard I. Parish George A. Fria Absent: Roy Mackenzie, Mayor The Village attorney, Mr. Anderson, was also present. Councilman L. J. McCaffrey was elected to preside as Mayor in the absence of Mr. Mackenzie. It was unanimously agreed that the reading of the minutes of the last regular meeting of August 3, and a special meeting of August 9, be dispensed with and approved as written. The first business to be taken up was a petition from residents of N. W. 2nd Avenue between 105th and 111th Streets to have their property incorporated into the Village. Mr. Mannheimer and Mr. Kindelan, representing these people, presented the Council with a petition signed by 18 of the 24 home owners, the other six being out of town. 'After discussing the zoning in this area, the affects of such an acquisition and the required election, Tir. Reynolds moved that the Council take the petition under advisement and notify these people of their decision upon occasion of the next regular meeting. This motion was seconded by Mr. Prix and unanimously carried. The next item on the agenda was the appointment of another member on the Planning Board to fill the vacancy caused by the resignation of Mr. Khoury. After several names were suggested, it was Mr. Prix's motion, seconded by 1,52- s r t 153 _2_ Mr. Reynolds and unanimously carried, that Mr. James Voorhies be asked to fill this vacancy. The following resolution was submitted; MIAMI SHORES VILLAGE RESOLUTION NO. 291 RESOLUTION DIRECTING PUBLICATION OF NOTICE OF SALE OF $100,000 VILLAGE HALL BONDS OF MIAMI SHORES VILLAGE, FLORIDA WHEREAS, the Village Council of Miami Shores Village, Florida, has determined to provide at this time for the sale of $100,000 principal amount of Village Hall Bonds, being _cart of an issue of $125,000 of bonds authorized by Resolution No. 289, adopted on June 1, 1948, the bonds to be offered for sale consist- ing of the bonds maturing $6,000 in each of the years 1949 to 1963 inclusive, $7,000 in the year 1964, and $3,000 in the year 1965; now therefore, BE IT RESOLVED BY the Village Council of Miami Shores Village, Florida: Section 1. That the Village Manager is hereby authorized and directed to publish a notice calling for bids for $100,000 Village Hall Bonds (being part of an authorized issue of $125,000 bonds, authorized by Resolution No. 289, adopted on June 1, 1948, ) in The Miani Herald, a daily newspaper of general circulation in Miami Shores Village, and in The Daily Bond Buyer, a financial journal published in New York City and devoted primarily to municipal bonds, each of such publications to be made at least ten days before the date for the receipt of bids, which notice shall be in substantially the following form: NOTICE OF SALE $100,000 MIAMI SHORES VILLAGE, FLORIDA VILLAGE HALL BONDS Sealed bids will be received by the Village Council of Miami Shores Village, Florida, at its regular place of meeting, in the Municipal Office in said 154 r 155 ( -3- Village, until 7:30 o'clock, P.M., Eastern Standard Time September 7, 19482 at which time and place all bids will be publicly opened and read, for $100,000 Village Hall Bonds of Miami Shores Village, dated May 1, 1948, and maturing annually, May 1, $6,000 in each of the years 1949 to 1963, inclusive, $7,000 in the 1964, and $3,000 in the year 1965, without option of prior payment. Part of a total authorized issue of $125,000 bonds. Denomination $1,000; principal and semi-annual interest (M and N 1 ) payable in New York City in legal tender; general obligations; unlimited tax upon all taxable real property (excluding homesteads) and tangible personal property within the Village. Bidders are requested to nates the interest rate or rates, not exceeding 5% per annum in multiples of 1/4 of 1%, and each bidder must specify in his bid the anount and maturities of the bonds of each rate. No bid may name more than three interest rates, and all bonds maturing on the sate date must bear interest at the samo rate. No bid of less than par and accrued interest or for less than all of the bonds offered will be entertained. The bonds will be awarded to the bidder offering to purchase the. bonds at the lowest interest cost to the Village, such cost to be determined by deducting the total amount of the premium bid from the aggregate amount of interest upon all of the bonds until their respective maturities. The bonds were validated by decree of the Circuit Court of Dade County, Florida, rendered on July 19, 19/.8. The approving opinion of Mitchell and Pershing, New York City, will be furnished without cost to the purchasers of the bonds. Each bid roust be enclosed in a sealed envelope marked "Proposal for Village Hall Bonds", and must be accompanied by a certified or bank cashierts check for $2,500, payable unconditionally to the order of Miami Shores Village, on which no 156 .. t 1°57 -4- interest will be allowed. Award or rejection of bids will be made on the date above stated for the receipt of bids, and the checks of unsuccessful bidders will be returned immediately. The check of the successful bidder will be held uncashed as security for the performance of his bid, but in the event the successful bidder shall fail to comply with the terms of his bid, his check may then be cashed and the proceeds thereof retained as and for full liquidated damages. Whenever such terms shall have been complied with, or if it should be found impossible to issue and deliver the bonds, the check will be returned. Delivery of the bonds will be made on or about October 1, 1948, at the Florida. National Bank and Trust Company in the City of Miami, Florida. The right to reject all bids is reserved. MIAMI SHORES VILLAGE By Village Manager Section 2. That this resolution shall be in full force and effect immediately upon its passage. PASSED AND ADOPTED this day of August, 1948. Mayor Attest: Village Manager and Clerk Councilman Reynolds moved that the foregoing resolution be adopted. The motion was seconded by Councilman Frix. Upon roll call the motion passed with the following voting Aye: George A. Frix L. J. McCaffrey M. E. Reynolds 15`8 _ � 159 -5- and the following voting Nay: Howard I. Parish The Acting Mayor thereupon declared the resolution adopted. It was Mr. Parish's opinion that because of a previous estipate, the bond issue should not exceed $90,000. He also questioned the Village attorney on the possibility of limiting any future expenditures of the entire issue of $125,000. Mr. Anderson stated that this resolution limited the cost of the building and the equipment to $100,000 and that no more money could be spent _ without official action. After the Village Manager read a letter from the Suburban Review concerning the printing of the minutes of Council meetings, it was agreed by the Council to use this newspaper whenever possible for legal notices. The Village Manager then read a letter from Robert G. Chew, commending the efficiency of the Police Department in recovering his stolen property. The next item on the agenda was the situation caused by incorrect platting of Golden Gate Park lots. It was pointed out that the Village had nothing to do with this and that the owners of this property should have it all re-surveyed. The final item to be taken up was the unpaid bills for the month of July. After a review was made of the various itemized expenses, it was moved by Mr. Parish, seconded by Mr. Frix and unanimously carried, that these bills be paid. The meeting adjourned at 8:45 P.M.
