08-03-1948 Regular Meeting 145 REGULAR MEETING MIAMI SHORES VILLAGE COUNCIL August 3, 1948 The regular semi-monthly meeting of the Village Council of Miami Shores Village, Florida, was held at 7:30 o'clock, P.M., August 3, 1948 at the Municipal Office, with the following Councilmen present: L. J. McCaffrey M. E. Reynolds Howard I. Parish Absent: Roy Mackenzie, Mayor George A. Frix The Village attorney, Mr. Anderson, was also present. Mr. McCaffrey was appointed to officiate at the meeting in the absence of Mayor Mackenzie. Upon motion made by Mr. Parish, seconded by Mr. Reynolds and unanimously carried, the reading of the minutes of meetings held July 20, 21, 23 and 27, was dispensed with and approved as written. The next item on the agenda was the final action in awarding contract to C. F. Wheeler for constructing the City Hall. In discussing this award, Mr. Parish pointed out that our original estimate to build and equip the City Hall was $90,000 and that it will run way over this figure if the construction alone costs $82,000. It was his repeated opinion that the building is too large and not as efficiently arranged as it might be. To convey the opinion of the members of the Council not present, a letter was read which had been signed by Mr. Frix and Mr. Mackenzie before leaving town, quoted as follows: "Inasmuch as we will be absent from the city on the date of our next regularly scheduled Council meeting, at which date we propose to award contracts for the construction of the City Hall and Swimming Pool, we make the following recommend- ations: "1. That the contract for the construction of the City Hall be awarded to C. F. Wheeler Builders in the amount of $82,000.00 according to the bid received from this firm this date. 146 147 -2- "2. That the contract for the construction of the Swimming Pool be awarded to Perry E. Willits, Inca in the amount of $77,247.00, according to the bid received from this firm this date. "We shall be willing to abide by the decision of the Council members present at the meeting on Tuesday, August 3rd, 1948, concerning the inclusion or deletion of the alternates accompanying both these bids." This letter had also been signed by Mr. McCaffrey. At this point Mr. Reynolds moved that the bid as submitted by C. F. Wheeler for the con- struction of the City Hall at a contract price of $$2,000.00, plus the alternates, be accepted, and that the standard form of Agreement as submitted be executed by the proper officials of Miami Shores. This motion was seconded by Mr. McCaffrey, after temporarily relinquishing the chair to Mr. Parish, and upon vote, passed by a majority of two, with Mr. Parish dissenting. Concerning the bids for the swimming pool, Mr. Parish moved that all bids submitted be rejected since they are in excess of the money available to build the pool. This was seconded by Mr. Reynolds and passed unanimously, with the added stipulation that the Council will meet with the Golf Course Committee to go over ways and means of building a pool within the limits of cash available. The third item on the agenda was to establish a definite amount of bonds to be issued for the construction of the City Hall. After a lengthy discussion of the various additional items of expense that will be necessary over and above the actual construction cost, Mr. Reynolds made a motion, seconded by Mr. Parish, that the Village Manager be authorized to accept bids on bonds in an amount of $100,000.00. Before a vote was taken the Village Manager brought up the question of the legality of changing the printed schedule of payments to cover amounts equaling $100,000.00 instead of $125,000.00. It was the Village attorney's opinion that this would not affect the validity of the resolution. Upon vote, Mr. Reynolds' former motion was unanimously carried. 148 149, -3- The next item brought before the Council was in regard to the Supreme Court's rehearing of the Edwards suit. Mr. Anderson wanted to know if the Council wished him to appear for oral argument on the date of September 27. He believed that the Village should fight the case, if for no other reason, because it was contesting the right of the Village to condemn land. He also pointed out that the Village had nothing to lose and that it was more or less a matter of precedent in carrying on with this case. It was Mr. Parish's motion, seconded by Mr. Reynolds, that the Village attorney be instructed to proceed with the case and appear for oral argument on September 27. Upon vote this motion was carried by a 2-1 vote, with Mr. McCaffrey dissenting. The final item on the agenda was in regard to a license for a new drug store that will operate as a pharmacy without soda fountain or food. After discussing comparative license fees for other drug stores with food service, it was Mr. Reynolds' motion, seconded by Mr. Parish and unanimously carried, that the license ordinance be amended to incorporate a classification for drug store without soda fountain or food. At 8:40 P.M. Mr. Reynolds moved that the meeting be adjourned.
