MIAMI SHORES VILLAGE COUNCIL
DECEMBER 17, 1946
A regular meeting of Miami Shores Village Council was held
on December 17, 1946 at 7:30 PM. All members of the Council were
present except Mr J C Kilburn. Mr Thomas Anderson, Village
Attorney, was also present.
Minutes of Regular Meeting of December 3, 1946 were read and
approved.
The Council then gave audience to Mr Fred Fletcher, who stated
that Mr Jack Kofoed had obtained certain information with respect to
dog•track funds contributed to the cities of Miami and Miami Beach.
It was Mr Fletcher's suggestion that, with this Information, the
Council appoint a committee to talk to Mr Joe Adams of the Biscayne
Dog Track with a view to obtaining additional funds from the Track
to compensate for municipal expenses resulting from its operation.
Mr Fletcher further requested that the Council write the Florida
East Coast Railway to effect that if train whistles are not controlled,
train speeds through the Village will be reduced. As result of Council
discussion of this and other aspects of operation of FEC trains
through the Village, it was understood the Village Attorney would
again write the Railway with reference to previous Council action
calling upon the Railway to reduce speed of trains and to install
safety gates at crossings.
Mr Fletcher also registered protest concerning truck traffic on
NE 96th Street and the Grand Concourse, and was advised by the

Village Manager that signs prohibiting such traffic are now being
made and will be placed on streets in question; further, that
passage of horse trucks has been stopped.
Suggestion was also made by Mr Fletcher that the Council take
some action toward placing covered benches at bus stops. '
The Council then heard a letter from Mr Jack Kof oed, who is
building a house on NE 93rd Street between 10th and 11th Avenues,
and requested that this thoroughfare be paved and the sidewalks
repaired. There followed a discussion on the general condition of
Village sidewalks, it being agreed this matter will be placed on
the calendar for further action in three months time.
The Council then heard report from Mr Reynolds who, with Mr
Kilburn, had been appointed by the Mayor to work on revision of
occupational license fees with a committee from the Business and
Professional Men' s Association. Mr Noel and Mr McKenzie, members
of the latter Committee, were also present and participated in the
discussion.. It was explained by Mr Reynolds and Mr Noel that the
policy of the Committees, in suggesting certain revisions, had been
to base such suggested revised fees on the business volume and
business investment involved.
After thorough discussion, upon motion by Mr Reynolds, seconded
by Mr Parish, and unanimously carried, the Council adopted in
Ordinance form (No.166) the Occupational License Schedule incorporating
changes recommended by the Counsel Committee and the Committee of
the Business and Professional Men' s Association, which Schedule is
attached to these Minutes as Exhibit "A" and is a part hereof, with

further revisions in such Schedule, as follows:

The Council further agreed that license fees applicable to the Food
Palace and Margaret Ann Store, as appearing on Schedule attached
hereto as Exhibit "A", are and shall be based on their status as
"markets".
Motion was further made by Mr Parish, seconded by Mr Reynolds,
and unanimously carried, instructing the Mayor to write. the Business
and Professional Men' s Association a letter expressing the Council' s
appreciation of the cooperative efforts of that Association and its
Committee toward the end of establishing a mutually satisfactory
Occupational License ordinance.
Mr Reynolds then moved that the Mayor appoint a Council committee
of two to work with a committee from the Business and Professional
Men's Association for the purpose of studying occupational license
tax systems, which joint committee shall report to the Council on
its study no later than the first Council meeting in March 1947. The
motion was seconded by Mr Parish and carried unanimously.
After hearing a letter from Mrs Doris A Goll, submitting her
resignation from the Planning Board, the Council unanimously adopted
motion offered by Mr Reynolds and seconded by Mr Parish, accepting
the resignation and instructing the Mayor to write Mrs Goll,

conveying the appreciation of the Council for her services on the
Planning Board.
The Council then discussed with the recently appointed Zoning
and Building Director the nature and progress of his work to date,
and indicated to him the advisability of so arranging his work as
to permit an increasing assumption of technical and general inspection.
With respect to requested contribution from municipal funds to
the Community Chest, it was the opinion of the Council that such a
contribution was not indicated in view of thorough individual
coverage and contributions.
The Council then heard Mr J C Noel, who appeared in behalf of
a client, owner of Lot 20 and W201 of Lot 21, Block 5 (70' frontage)
who, for selling purposes, desired to know if residential construction
thereon would be permitted. The Council suggested to Mr Noel that, ,
in view of the 75-foot requirement of the Zoning Ordinance, he
endeavor to negotiate purchase of an additional, adjoining five feet,
which would solve the problem.
The Village Manager reported to the Council that four applica-
tions for taxi certificates are now on hand, requiring setting by
the Council of date for hearing thereon. Mr Parish thereupon moved
that the next Council meeting (January 7, 1947) be set as date for
hearing the applicants. The motion was seconded by Mr McKee and
unanimously carried.
The Village Manager also presented for Council consideration
the evident necessity for certain amendments in the Village charter,
with particular reference to future sewer installation, to the

filing of Tax Sale Certificates with County Taxing Office, and to
the rate of interest now charged on delinquent taxes. 'It was agreed
by the Council that the Village Manager, together with the Village
Attorney, will proceed in thorough charter revision, with a view to
submission of a Special Act to the Legislature.
The Council agreed that schedule established last year for
Christmas gifts to municipal employees shall be adhered to this year.
Request was made by the Village Manager for authorization to
expend $150 for engineering survey of the corners on NE 2nd Avenue
at 97th, 98th and 99th Streets with view to proper drainage and
paving from sidewalk to sidewalk. Upon motion by Mr Reynolds,
seconded by Mr Parish, Council unanimously authorized such expenditure.
Upon motion by Mr Parish, seconded by Mr Reynolds, the Council
further authorized the Village Manager to expend approximate amount
of $500 for installation of traffic light at NE 2nd Avenue and
98th Street.
The Village Manager then requested the Zoning and Building
Director to outline to the Council his recommendation for revision
of Ordinance #164, and reasons therefor. Following discussion,
Mr Reynolds moved that Ordinance #164 be amended by striking there-
from the following portion of Section 1 (a) :
"In all cases where access to such building cannot be had
from the rear, the entrance to such garages or garage rooms
shall be set back six or more feet from the front line of
such building that is farthest from the front line of the
lot on which it is being constructed. ",
and by adding thereto the following provision:
"Provided that, where the garage door faces the street,
the front of the garage shall not be closer to the street
than the front line of the building that is farthest from
the front lot line. "

The motion was seconded by Mr Parish and carried unanimously.
The matter of fee for apartment garbage collection was then
presented by the Village Manager for Council consideration, as
result of which Council agreed upon a fee of $10.00 per can for
apartments.
The Village Manager reported to the Council that, with respect
to parking-lot program, he had made preliminary agreement to purchase
for $1,000, Lot ?, Block 18, Miami Shores Section 1. Upon motion by
Mr Reynolds, seconded by Mr McKee, and carried unanimously, Council
thereupon authorized the Village Manager to complete purchase of
such lot at price agreed upon.
Further authorization was requested by the Village Manager,
because of circumstances outlined to the Council, for purchase of
Lot 12, Block 28, a 50-foot lot. Mr McKee mov ed that the Village
Manager be authorized to buy such lot at a price of $925. The motion
was seconded by Mr Parish and unanimously carried.
Mr McKee then presented the following motion:
"That an ordinance be adopted or Ordinance No. 92 be amended
so that all future buildings erected in the Village or
alterations to existing structures shall provide off-street
parking sufficient for their needs.."
After thorough discussion, the proferred motion was withdrawn
by Mr McKee and the following motion offered:
"That hereafter all buildings erected in the business area
shall provide sufficient off-street parking. "
Discussion of the suggested motion continued to time of adjournment,
it being agreed by the Council that the matter required further
careful study.
The meeting adjourned at 12:00 Uldnight.
