MIAMI SHORES VILLAGE COUNCIL

The regular monthly meeting of the Miami Shores
Village Council was held on July 14th, 1942, with all members
present except Mr. Dooly. Also present were the Village
Attorney and Village Manager.
Minutes of the meeting of June 9th, 1942 were
read and approved.
Mayor Earnest reported that he and Mr. Dooly had
met with the Golf Course Committee, and that the Committee had
decided to continue the operation of the course.
The Council discussed the authority of the
Auxiliary police and Mr. Arnold, as Head of the Auxilary Police,
for Division Seven, dictated the following letter to be
sent to each Auxiliary Policeman.
"Dear Sir:
Am enclosing, for your information
a copy of Ordinance No. 115 passed by the
Miami Shores Village Council on June 9th,
1942. You will govern yourself accordingly
and not exceed any of the authority granted
to you as an auxiliary policeman under
this ordinance.

Minutes of a special meeting of July 8, 1942,
were read and approved.
Mr. Childress then asked for the floor and made

"Mr. Mayor and Members of Miami Shores Village Council.
I move that we dispense with the services of our Village
Manager Mr. C. Lawton McCall for the following reasons.
Shortly after the Village of Miami -Shores purchased
the 47 acres of land in January or February 1940 to be used
for nursery and incinerator purposes; our Village Manager
Mr. McCall without authority from any member of tyle
Council of this Village, in office during 1940, 1941 or 1942,
leased to several tenants for truck farming an unknown number
of acres of our nursery land at a price understood to be
three dollars more or less per acre per year.
The proceeds from the leasing of this land of which
a part was received shortly after January or February 1940
and other amounts received from time to time to this date
have never been accounted for by Mr. McCall in the records
of the Village of Miami Shores. Numerous audit reports have
been made of the books of accounts of this village since
January or February 1940 by the accounting firm of Ring,
Mahoney and Arner. These several audit reports do not
include therein any report of income received from the
leasing of our nursery land by Mr. McCall.
Mr. McCall stated to Mr. Stockdell and myself
that he had received seventy-five dollars from the leasing
of our nursery land since shortly after the Village of
Miami Shores purchased same.
Mr. McCall stated when questioned by Mr. Stockdell
and myself that he gave receipts to these tenants from a
private receipt book kept in or on his desk and that he
failed to keep a duplicate stub of receipts issued. One

receipt book was produced by Mr. McCall and a hurried examination
by Mr. Stockdell and myself disclosed that one receipt had
been issued for lease of nursery land.
Mr. McCall stated that he had kept the money collected
for the entire period in the Petty Cash Box in the safe, but
all audit reports show this not to be true; the cash box
showing only the one hundred dollars as entered on the books
of record as petty cash.

July 14th, 1942.
Mr. Childress then stated that he was willing to
have action postponed until Mr. Dooly could attend a meeting
with the four present members. After some discussion Mr.
Stockdell seconded the motion, the Attorney advised that action
could be carried over until the next meeting, and the Mayor
instructed that it be placed on the calendar of the next
meeting.
The Village Attorney reported that the Golf Committee
had applied to the court for permission to purchase a deisel
engine to pump water on the golf course, and the Council
approved this action provided fuel oil can be secured.
The Council postponed appointment of the Mayor for
the coming year.
The Council discussed the personal property tax
roll, and upon motion of Mr. Arnold and seconded by Mr.
Childress the tentative personal property roll was adopted
as adjusted.
The Council then discussed the real property tax
roll adjustments made since last meeting. It was unanimously

decided that the Village assessment on the Biscayne Kennel Club
be equal to that of the county assessment.
The Council then decided to meet several nights the
following week to further discuss the tax assessment roll.
After which the meeting was adjourned.
