OF MIAMI SHORES VILL .GECOUNCIL
January 13, 1942
The regular monthly meeting of the Miami shores Village
Council was held on January 13, 1942, with all members present
as were the Village Manager and Village Attorney.
The minutes of the meeting of October 14th were read and
approved by the Council. The minutes of the meeting of December
9th were read and Mr. Childress stated that the reason that he
asked that the litigation on the filling station be continued
was because it would establish a guide for future action on
filling stations.

Mr. Arnold moved that the reporter and Village Manager

be instructed to have all notes covering Council'meetings trans -
scribed and that they only include in the actual minutes to be
read before the Council the official actions of the Council, and
that the minutes be made in copies. This motion was seconded by
Mr. Stockdell and unanimously approved.
Mr. Dixon and Mr. Reynolds, of the Tire Rationing Board,
appeared before the Council and asked that since they had no
money to pay for help, telephones, or anything else, that they
be permitted to use space in the Village Office, and said request
was approved.
The Attorney reported that nothing had been done on the
Golf Course litigation, but that he would endeavor to push the
matter.
The Liquor Store application on file was brought to the
attention of the Council and Mr. Arnold moved that the permit
either be granted by next noon, or that the money and application
be returned. This motion was seconded by Mr. Childress and
unanimously approved.
Upon motion by Mr. Arnold and seconded by Mr. Childress
the Council unanimoubly approved the promotion of J.N. Cliatt, Jr.
to the rank of Sergeant on the Police Department, at the same
salary.
Mr. Arnold brought up the question of making definite
arrangements for the boy scout meetings at the Community House
as there have been interruptions since the beginning of the
Red Cross first aid classes for air raid wardens. Mr. Arnold
moved that the Village Manager be instructed to set aside Tues»
day night for boy scouts and Friday night for cub scouts, and
that nothing interfere with such schedule except an emergency.
Said motion was seconded by Mr. Frix, and after some discussion
the motion was withdrawn at the request of the Mayor who volun-
teered to satisfactorily settle the matter within 24 hours and
in failing to do so he agreed to call a special meeting with
the next 24 hours.
A letter was received from the Water Department of the
City of Miami notifying the Village of personal property tax
exemption claim on the water distribution system in the Village.
Mr. Frix moved that the letter be received and filed and that
the tax assessor comply with the statutes as they now stand.
The Village Manager was instructed to negotiate with
the Water Department concerning the rental of fire hydrant
privileges and report back to the Council.
The Council denied an application for Homestead Exemption
for 1941 filed by Mrs. Agnes Trout during the month of December.
The Council denied approval of an appeal from a Planning
Board decision in denying a permit for a guest house at 70 N.W.
105th Street.
Mr. Childress reported on Defense activities and moved the
adoption of Ordinance No. 113, said ordinance being entitled:
AN ORDINCE AUTHORIZING BLACKOUTS AND
AIR RAID PROTECTION AND ESTABLISHING
ORDERS, RULES AND REGULATIONS PERTAINING
THERETO: PRESCRIBING PENALTIES FOR THE
VIOLATION OF THE PROVISIONS OF THIS
ORDINANCE: AND REPEALING ALL LAWS IN
CONFLICT
The motion being seconded by Mr. Stockdell and carried by a
4/5 majority with Mr. Arnold dissenting and stating that he
thought it was too drastic.
Upon motion of Mr. Stockdell and seconded by Mr. Arnold
Ordinance No. 114 was adopted, said ordinance being entitled:
AN ORDINANCE REQUIRING A FLORIDA LICENSE
TO DRIVE A MOTOR VEHICLE UPON THE STREETS
OF MIAMI SHORES, REQUIRING POSSESSION OF
SUCH LICENSE AT ALL TIMES AND EXHIBITION
OF SAME ON DEMAND OF ANY POLICE OFFICER,
PRESCRIBING PENALTIES FOR THE VIOLATION
OF THE PROVISIONS OF THIS ORDINANCE, AND
REPEALING ALL ORDINANCES IN CONF******LICJT.;� `

The Village Attorney reported that he had talked to the
Golf Course Committee concerning theCouncil's recommendations
that expenses be curtailed in the operation of the Golf Course,
and stated that the Committee welcomed the criticism offered
in a cooperative spirit and that they had stated that all of

the suggestions toward cutting expenses had been thoroughly
studied by the Committee from time to time.
The Attorney reported that the Committee reports had been
presented to Judge Barns and had been confirmed.
The Village Attorney also reported that the case of Crane
and Company against Miami Shores Village had been set for February
18th and that the Attorney for the National Fireproofing Corp.
had communicated with ii threatening to file a suit for collection.
Mr. Childress stated that he had received a letter from the
Orange State Oil Company about their old Golf Course account,
and Mr. Arnold stated that they had talked to him about the
matter asking that a letter be sent them concerning their bill
so that their files could be brought up to date.
The Council instructed the Village Manager to get up the
necessary information for organizing a voluntary fire department
in case of an emergency.
Upon motion made by Mr. Childress and seconded by Mr.
Arnold the Council unanimously adopted advisory boards as follows:

The Council approved the use of Mrs. Allan from the Village
Office at the Community House in the afternoons to assist the
Defense headquarters for a period of about 3 weeks.
Bills incurred during the month of December in the amount
of $2681.68 were ordered paid.
After which the meeting was adjourned.
