MItâ–ºMI SHORES VILLAGE COUNCIL
AUGUST 27, 1941
The Miami Shores Village held a special meeting on August
27th, 1941 to discuss the lawsuit filed by the Security First Mort-
gage Corporation to have the Court order the Village to stop burning
garbage and trash at the Village Nursery,
Present were Council Members, Mr. Frix, Mr. Childress, Mr.
Stockdell and Mr. Arnold, Mr. Kurtz, acting Village Attorney, and
the Village Manager.
In the absence of Mayor Earnest, Mr. Childress was made chair-
man of the meeting.
Upon motion made by Mr. Arnold, seconded by Mr. Stockdell,
the council unanimously accepted notice of the lgwsuit and decided to
all appear in court on the following Friday, August 29th, at 3:30 p.m.,
this being the time set for the hearing.
After discussing the matter fully, Mr. Frix moved to approve
the answer to said sult as prepared by Mr. Kurtz the attorney. The
motion was seconded by Mr. Arnold and unanimously carried. (A copy
of said answer being attached to and made a part of these minutes).
The,Village Manager was instructed to make arrangements to
dispose of the garbage and trash at some other place at a reasonable
cost to the Village, and to withhold the application to the County
Zoning Department for a permit to construct an incinerator on the
Nursery property.
After which the meeting was adjourned.
