07-28-1941 Public Hearing(b' MINUTES OF MEETING OF MIAMI SHORES VILLAGE COUNCIL JULY 28th, 1941 The Miami Shores Village Council held a public meeting on July 28th, 1941 in the Village Community House with all members present, this meeting having been called pursuant to the provision of the Village Charter. There were eighty-four Village citizens in attendance. The Mayor explained each item of the budget, and the only suggested change brought about by this meeting was the continued use of metal plates for evidence of automobile inspection. The Council then resolved itself into an Equalization Board and adjourned to the Village Office to hear objections to tax assessments on the 1941 tax roll. Mr. Ray Earnest, representing Foremost Properties, Inc., appeared before the Council to object to assessments on Tracts 175-A through 178-A, Miami Shores Section 8 Revised. Mr. Earnest was reouested to put his objections in writing to be considered by the Board on Tuesday, July 29th. The Board received letters objecting to assessments from Hugh H. Gordon and Mrs. Carrie S. Nelson, after which the Board recessed until 7:30 P. M. July 29th, 1941 and received written objection to the assessments of Foremost Properties, Inc. from Mr. Ray M. Earnest. After discussion the Board decided to reduce this property to $2,000.00 per acre. The Board then considered the objection of Mr. Hugh H. Gordon to the assessments on his property and decided to assess Tracts 178-B through 181-B at 2,000.00 per acre, being on the same basis Pgge -#2 7/29/4b as the assessment placed on the tracts owned by Foremost Properties. The Board reduced the 10 acres of land described as Mr. Gordon's home place to $18,000.00, and his property described as Tract I to 011,000.00. The property of Mrs. Carrie S. Nelson was reduced from $8,400.00 to 08,000.00. The property of John M. Ritter was reduced from $10,250.00 to $10,000.00. A letter objecting to the assessments of several pieces of property was received from T. J. Ellis, Jr., but no changes were made in his assessments. All letters of objection to the tax assessment roll are on file in the Village Office. The Equalization Board having completed its business dis- solved, and then the members sat as a Village Council and upon motion of Mr. Arnold, seconded by Mr. Frix, Ordinance No. 107 was unanimously passed and adopted, said ordinance being entitled: AN ORDINANCE ADOPTING THE FINAL BUDGET OF MIAMI SHORES VILLAGE FOR THE FISCAL YEAR OF THE VILLAGE FROM AUGUST 1, 1941 THROUGH JULY 31, 1942. Upon motion made by Mr. Stockdell and seconded by Mr. Arnold, the Council unanimously adopted Ordinance No. 108, said ordinance being entitled: AN ORDINANCE ADOPTING THE FINAL TAX ASSESSMENT ROLL OF MIAMI SHORES VILLAGE FOR THE YEAR 1941; DETERMINATION OF VALUE OF REAL AND PERSONAL PRO- PERTY AND FIXING THE MILLAGE FOR REVENUE FOR THE REQUIREMENTS OF SAID VILLAGE FOR THE FISCAL YEAR AUGUST 1, 1941 THROUGH JULY 31, 1942. After which the meeting was adjourned. REPORT OF PLANNING BOARD OF MIAMI SHORES VILLAGE ON THE MATTER OF INCREASING THE CUBIC CONTENT RE- QUIREMENTS OF RESIDENTIAL BUILDINGS ON THE LOTS FRONTING ON N.E. 96th STREET RUNNING EAST FROM THE RAILROAD. PROPERTY TO N.E. 8th AVENUE. To The Members Of The Council Of Miami Shores Village: In compliance with the Council's instruction concerning a proposal to increase the cubic content requirements of dwellings on property fronting on N.E. 96th Street from the railroad to N.E. 8th Avenue, the Planning Board recommends that increases be made according to the figures indicated on the plat attached to this report. This Board has been and is of the opinion that 96th Street is one of the principal residential streets of the Village, and that the present minimum cubic foot requirements of 15,000 feet on the subject property is low. This Board in making its recommendation has studied the property and has taken into consideration the close proximity of the railroad and the commercial property abutting the railroad on the west, which conditions create a decreasing influence on appraisals, development and loan committments from lending agencies. We therefore suggest that the requirements on this property be es- tablished on a graduated scale, beginning at N.E. 8th Avenue, with the same cubic requirement (20,000) as the frontage running East from this point, and decreasing toward the railroad as shown on the plat. I believe that our Building, Inspector actor' in good faith, he having obtained permission from our Village Vanager, Er. liMeall, to erect a residence as a contractor on the S. W. corner of 98th Street and B. E. 5th Avenue. Our Village Llan ger was given specific in- struoticns by former L:ayor Stookdeli that Er. Ritter - vas not to be given permission while he vas in the em- ploye of our Village aa Village Building Inspector., to take contract to oroct this dwelling.
