MIAMI SHORES VILLAGE COUNCIL
JULY 26, 1941
The Miami Shores Village Council held a special meeting
on July 26, 1941, with all members present.
This meeting was formally called by Mr. Childress and
Mr. Stockdell for the purpose of discussing the exceptions made
by the Village Attorney to the Master's report in the Bessemer
suit to foreclose the mortgage on the Village Golf Course.
Mr. Childress moved that the Council insist that the
Village Attorney request or ask the court's permission for time in
which to file an exception to the major issue in this case, and for
him to pursue the same line of legal procedure that our former
Attorney, Mr. Holt, pursued. The motion was seconded by Mr.
Stockdell, which after discussion was amended to read that "We
instruct our Attorney to seek the permission of the court to file
further exception in this golf course litigation, and that the
exception be to deny the Master's findings that there is a default
in the mortgage. The vote on this motion was:
Mr. Arnold No.
Mr. Childress Yes.
Mr. Earnest No.
Mr. Frix No.
Mr. Stockdell Yes.
and the motion failed to carry.
A transcript of notes taMen on the discussion of this
motion is on file in the Village office, but is not represented to
be an exact transcript of statements of the various members of the
Council and citizens who took part in this discussion.
After which the meeting was adjourned.

I am writing this letter which will serve as a
notice that I am joining with Mr. W. Meade Stockdell,
Councilman, in asking you to call a special meeting of
the Village Council for Friday, July 25th at 7:30 P.M.
in the City Hall.
The purpose of this meeting will be the discussion
of the Village Golf Course litigation and particularly
the point as to why the Village Council has been pre-
cluded by the action of the City Attorney from decid-
ing whether an appeal should or should not be made
from the Judge's decision which will be handed down
very shortly in this matter.
