07-22-1941 Regular MeetingMINUTES OF MEETIN3- OF MIAMI SHORES VILLAGE COUNCIL JULY 22nd, 1941 The Miami Shores Village Council held a meeting on July 22nd, 1941, with all members present, the meeting having been called for the purpose of considering the tentative budget that was submitted on July 15th, along with the tentative tax assessment roll, by the Village Manager. A copy of the tentative budget, as submitted by the Village Manager, is attached to an*ade a part of these minutes. The Council, after considering each item, adopted the tentative budget to be discussed at the public hearing on July 28th. A copy of said tentative budget is also attached hereto and made a part of these minutes. The Council considered police car bids from various auto- mobile agencies and decided to authorize the purchase of two Pontiac sedans for $1360.00, plus a trade-in allowance of yp850.00 on the two old police cars. The $1360.00 to be paid December 1st, 1941. A letter was presented from the Everglades National Park Association requesting that the Council include $250.00 in their budget as a donation to help in the maintenance of the Association, but the Council regretfully denied this request. Also presented was a letter from R.F. Lawrence asking that money be provided to pay him the $500.00 balance on his architect- ural fees on the Golf Course. The Attorney was instructed to answer the letter and tell Mr. Lawrence that this matter would be taken up at the next regular meeting of the Council. There was also a letter presented from Mr. Holt asking for $p1200.00 Attorney's Fees, but no action was taken. Page #2 7/22/41 Mr. Arnold asked the Village Attorney if he would give the Council an idea of what they could anticipate in the way of Attorn- ey's fees in this particular litigation on the Golf Course. Mr. Sappen- field stated that he thought the amount should be based upon what he is able to accomplish. Mr. Childress stated that the Attorney should give us an amount based on what he thought would be his fees in case he lost the case, not to exceed a certain amount if he loses and not to exceed a certain amount of he wins the case. The Village Attorney reported that he had been asked to help clear up the title on Lot 10, Block 12, Pasedena Park, and that in order to do this it would be necessary for the Village to issue a quit claim deed, as foreclosure had been started and a Master's Sale held, but that as the records show that the Village has collected all of its taxes it would be in order to authorize the issuance of a quit claim deed. Upon motion by Mr. Childress and seconded by Mr. Frix the Council unanimously approved the issuance of this deed. The Village Attorney then brought before the Council the metter of the suit concerning th3 Harmstead house at 490 N.E. 96th Street. The Attorney stated that he would like to have instructions from the Council. "Several residents of the Village, including W.H. Walker, Jr., Dr. Kells, etc., have filed a petition for a mandamus to stop construction of this house. The question of policy is what position the Village should take in it. I ruled here last Wednesday night that I did not think we had the right to stop it legelly and I stand with that opinion. Therefore, I do not think the work should be stopped and the Village should make some response or defense to this alterna- tive writ. There are two things you can do: 1. Move to quash the writ. Mr. Walker told me that it is entirely possible that Miss Page '#3 7/22/41 Harmstead's attorneys will ask to intervene, and if they do intervene I think it would be a fine thing, for we will have all parties before the court and they can settle it among themselves. If they do not in- tervene, the court may not let them. Mr. Walker has offered a suggest- ion - 2. Instead of moving to quash, that we file an answer to the writ and say that we would not stop the work and the reason is that a permit was issued for a single family dwelling and represented to us as such, and we believe such permit was issued accordirgly. That will put it before the court as to whether or not it is a single family dwelling. This would give them a little time and that is what he wants because he feels if he has some time that Miss Harmstead will get to- gether with the other parties end settle this by argument. It is purely a matter of policy as to whether or not we want to cooperate with him to that extent and give the court a chance to rule whether or not it is a single family dwelling or try to get rid of it as quick as we can." After some further discussion Mr. Arnold made a motion that the Village Attorney be instructed to handle this litigation in the way he thinks best.
