04-11-1941 Special MeetingMINUTES OF SPECIAL MEETING OF MIAMI SHORES VILLAGE COUNCIL APRIL 11, 1941 The Miami Shores Village Council held a special meeting on April 11, 1941, with all members present except Mr. Pruitt. .The Village Attorney also was absent! Mr. Ferber appeared before the Council and requested approval of a plat creating an addition to River Eay Park subdivision, and same was approved subject to the County Commissioner land County Engineer's Approval. The Council then discussed the proposed changes in the Charter, the the twelve changes are attached to and made a part of these minutes. After which the meeting was adjourned. $EPROVED BY COUNCIL: PAGES 1 and 2. Boundary changes to confirm ordinances annexing land. PAGE 4. ARTICLE 2. SECTION 1. The right of perpetual succession; to use and alter at pleasure a common seal; to sue and be sued; plead and be impleaded, and in all proper courts, including the right by action at law in the nature of debt and otherwise as may be appropriate in any court of competent jurisdiction to sue for and collect fines and penalties imposed by the Village Court, and by bill in equity to aid and obtain enforcement of any legal, statutory or other right of the Village; to levy on property of any person or corporation in the Village and sell the same in the same manner as sales under execution are conducted in order to order to collect fines or penalties due the Village or to enforce a judgment of the Village Court; to contract or be contracted with; to incur debts, borrow and expend money and make evidences of indebtedness for all lawful municipal purposes; provided that unless the same shall previously have been authorized by the affirma- tive vote of a majority of the qualified .electors 'residing in the Village who are free holders, no indebtedness of the Village shall be incurred which shall extend for a period of more than three years or which shall create an outstanding indebtedness over such maximum period of more than twenty-five per centum (25%) of the net revenue of the Village received during the next preceding fiscal year. PAGE 8. ARTICLE 3. SECTION 1. Change the terms of Councilmen so that each election there shall be three (3) vacancies to fill. That a provision for the recall of any member of the Council of I:iiami Shores Village be inserted in the Charter, which provision shall provide that before any recall shallbe instituted the persons sponsoring such shall first deposit in:the treasury of the Village the sum of Two Hundred and Fifty ($250.00) Dollars cash to defray the expenses of the election; and in addition thereto shall file a Two Thousand (02000.00) Dollar common law bond payable to the Governor of the State of Florida, or his successors in office, for the use and benefit of all persons effected thereby, conditioned that in the event the recall is not successful the person sought to be recalled shall be entitled to his damages, action and punity suffered in the proceedings; and provided further that no recall shall be had until there shall have been filed with the Village Clerk a petition containing the signatures of not less than Fifteen per cent (15%) of the then qualified electors of the Village. PAGE 8. ARTICLE 3. SECTION 2. Change the compensation of the Mayor to Six Hundred (0600.00) Dollars per year. Change the compensation of the Council to Three Hundred ($300.,00) Dollars per year. The qualifications of the electors, other than otherizing the issuance of bonds and all other evidences of indebtedness, be citizens of the United States, of the State of Florida for a period of one (1) year and of Miami Shores Village for a period of six (6) months.
