02-28-1940 Special MeetingPage 1 2-28-40 MINUTES OF THE MEETING OF MIAMI SHORES VILLAGE COUNCIL FEBRUARY 28, 1940 The Miami Shores Village Council held a special meeting on February 28, 1940. Present were Mayor Kitson, Mr. Milledge, Mr. Stockdell, Mr. Pruitt, the Village Attorney and Village Clerk. Reading of the minutes of the previous meeting was omitted. The first business to come before the Council was the appearance of Mr. John G. Thompson who asked for a quirt Claim Deed on 10 acres of land located in Section 36, Township 52, Range 41 East, explaining that the Village had a lien on this property through error, and upon motion made by Mr. Milledge and seconded by Mr. Pruitt the Council authorized the issuance of said deed subject to the approval of the Village Attorney. The Council then adjourned to the home of Mr. John J. Lindsey,fifth member of the Council, who was confined to his home because of illness. The Mayor re -opened the meeting at Mr. Lindsey's home, and upon motion made by Mr. Pruitt and seconded by Mr. Milledge the Council unanimously passed Ordinance No. 95,being entitled: AN ORDINANCE AUTHORIZING THE TRANSFER OF $400.00 FROM ITEM #53; $300.00 FROM ITEM #54; $640.00 FROM ITEM #59; $2000.00 FROM ITEM #85, MAKING A TOTAL OF $3340.00 AS FOUND IN BUDGET OF MIAMI SHORES VILLAGE PRESENT FISCAL YEAR, MIAMI SHORES VILLAGE ORDINANCE NO. 85, TO ITEMS 73, 63, 42 AND 84, OF SAID BUDGET DESCRIBED BY PROVIDING THAT ITEM 73 SHALL AMOUNT TO $720.00; ITEM 63 SHALL AMOUNT TO $1400.00; ITEM 42 SHALL AMOUNT TO $700.00 AND ITEM 84 SHALL AMOUNT TO $520.00, MAKING A TOTAL OF $3340.00 FOR THE PURPOSES OF PAYMENT OF COMPENSATION OF DIRECTOR OF RECREATION, PURCHASE OF NURSERY AND INCINERATOR LAND. PURCHASE AND INSTALLATION OF TRAFFIC LIGHTS AT NINETY- SIXTH STREET AND SIXTH AVENUE, AND NINETY-FIFTH STREET AND MIAMI AVENUE, IN SAID VILLAGE, PAY COMPENSATION FOR FULL TIME BUILDING INSPECTOR TO SUPERVISE AND HANDLE ALL THREE DIVISIONS OF BUILDING AT THE RATE OF TWO HUNDRED AND FIFTY DOLLARS PER MONTH, AND DECLARING AN EMERGENCY TO EXIST. Page 2 2-28-40 The four members of the Council then returned to the Village office and reconvened and upon motion made by Mr. Stockdell seconded by Mr. Mill.edge Ordinance No. 96 was unanimously passed by those present. Said Ordinance being entitled: AN ORDINANCE ESTABLISHING MIAMI SHORES VILLAGE RE- CREATION DEPARTMENT HAVING SUPERVISION AND CONTROL OF THE VILLAGE COMMUNITY HOUSE AND RECREATION HALL, CREATING THE OFFICE OF DIRECTOR OF RECREATION, SPECIFYING SUCH OFFICER'S DUTIES AND AUTHORITY AND DESIGNATING USES TO WHICH THE COMMUNITY HOUSE AND RECREATION HALL MAY BE PUT, PROVIDING FOR ADDITIONAL HELP TO DIRECT THE RECREATION AND LIMITING THE MANNER IN WHICH SAID DEPARTMENT AND SAID HALL MAY BE OPERATED AND USED, AUTHORIZING THE CHARGING OF ADMISSION TO FUNCTIONS HELD IN SAID HALL AND REQUIRING AND AUTHOR- IZING.A CHARGE TO BE MADE FOR THE USE OF THE HALL BY RESIDENTS OF THE VILLAGE FOR THE PURPOSE OF DEFRAYING LIGHTING, WATER, JANITOR AND OTHER EXPENSES IN CONNECTION THEREWITH, PROVIDING FOR THE DISPOSITION OF THE REVENUE RECEIVED IN THE USE THEREOF, AND OTHER PURPOSES. Mr. Holt, Village Attorney, reported that he had replied to the letter of the Attbrney representing R. F. Lawrence in his claim of $500.00 balance due on planning and supervising construction of the Golf Course. A copy of the letter written by Mr. Roy Schroder, WPA Administrator, to Mr. E. H. Hulse of the Miami WPA was read to the Council,and the Village Manager was instructed to acknowledge receipt of same. A letter from Mr. Joseph R. Cannon, Investigator for the Subeommittee of the House of Representatives of the 76th Congress was read and ordered acknowledged. Upon a motion made by Mr. Pruitt and seconded by Mr. Milledge Ordinance No. 97 was unanimously adopted by those present. Said Ordinance being entitled: Page 3 2-28-40 AN ORDINANCE REGULATING THE ERECTION, CONSTRUCTION, REMOVAL, ENLARGEMENT, ALTERATION, REPAIRING, MOVING, DEMOLITION, CONVERSION, OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA AND MAINTENANCE OF BUILDING AND/ OR STRUCTURE, INCLUDING SIGNS, AWNINGS, AWNING -SHUTTERS, STATIONARY AWNINGS, AND CANOPIES IN MIAMI SHORES VILLAGE, FLORIDA: PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFOR; PROVIDING FOR THE REMOVAL OR MAKING SAFE OF CONDEMNED BUILDINGS OR STRUCTURES AND FOR THE ABATEMENT OR REMOVAL OF NUISANCES AND FURTHER PROVIDING FOR LIENS FOR EXPENSES INCURRED AND FOR THE RECOVERY OF SUCH EXPENDITURES; PROVIDING FOR THE TEMPORARY AND PERMANENT OCCUPANCY OF PUBLIC PROPERTY FOR CERTAIN USES UNDER SPECIFIED CONDITIONS AND REGULATIONS; CREATING A BOARD OF REVIEW AND APPEAL AND PROVIDING FOR ITS APPOINTMENT, QUALIFICATION, DUTIES AND POWERS; ADOPTING IND APPROVING CERTAIN SPECIFICATIONS, REGULATIONS AND STANDARDS OF TESTS AND INSPECTIONS BY SPECIFIC REFERENCE; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR PENALTIES FOR THE VIOLATION THEREOF; PROVIDING THAT IN THE EVENT ANY SECTION, SUB -SECTION, SENTENCE, CLAUSE OR PHRASE OF THIS ORDINANCE SHALL BE DECLARED OR ADJUDGED INVALID OR UNCONSTITUTIONAL, SUCH ADJUDICATION OR INVALIDITY SHALL IN NO MANNER AFFECT THE OTHER SECTIONS, SUB -SECTIONS, SENTENCES, CLAUSES OR PHRASES OF THIS ORDINANCE; AND DECLARING THIS ORDINANCE TO BE AN EMERGENCY MEASURE. Mr. Milledge made a motion that the Village Manager be instructed to mimeograph Council minutes of each month and deliver them to the residents of the Village. Mr. Pruitt then offered a substitute motion that the Village Manager be instructed to estimate the cost of mimeographing the minutes of the past six months and to report to the Council at the next meeting. There was no second to the substitute motion/ Then Mr. Sto`ckdell seconded Mr. Milledge's previous motion and the vote on same was: Mr. Stockdell Mr. Milledge Mr. Pruitt Mr. Kitson Yes. Yes. No. No. The motion failed to carry. The Council discussed the possibility of an Ordinance forbidding picketting of construction jobs in Miami Shores Village and decided to postpone action until an investigation could be made Page 4 2-28-40 concerning such Ordinances in other cities. The Council instructed that Mr. Nice be paid a balance of $75.00 due him in connection with the completion of the Building Code adopted at this meeting, after which the meeting was adjourned. M. Harloe, Assistant Commissioner and Chief Engineer, requesting additional information in regard to the above captioned project. Your attention is specifically directed to the fact that it will be necessary for a detailed explanation to be secured from the Village of Miami Shores, explaining the proposed mothod of opera- tion of the golf course. In addition, information is desired as to whether or not it is contemplated that the operation of the course, as controlled by the Village, will be vested in the Golf Course Committee as now constituted. I would appreciate it if you will formally contact the sponsors on this project and request that this information be submitted in its entirety to your office in triplicate. Please incorporate such matters as the efficiency of WPA labor, the difference between the final ana the estimated costs, the overloading of the project with labor, and the misclassification of skilled labor. In addition to the above if there are any other facts you think should be brought to the attention of the Subcommittee, I suggest you incorporate them in your communication.
