11-28-1939 Public Hearing PUBLIC MEETING
Nov. 28, 1939.
A Public Meeting was held in the Community House on November 28,
19399 at 7:30 P. M. Present were Mayor Kitson, Councilmen Stanley
Milledge and W. Meade Stockdell, the Village Attorney and the Village
Clerk.
Mayor Kitson opened the meeting by advising those present that this
meeting was called for the purpose of discussing the proposed zoning
ordinance with the property owners and secure their opinions on same
before it was presented to the Council for its adoption. Mayor Kitson
asked the Clerk to read the first part of this proposed zoning ordinance
and to go over each zone carefully and have Mr. Nice point out on the map
the different zones and explain them.
Considerable discussion was had concerning various items contained
in the proposed Zoning Ordinance and the comments, objections and views
expressed by those present are attached to and made a part of these
minutes.

Col. Musgrave wanted the area East of the Boulevard between 93rd and
95th Sts. raised from the proposed 20,000 cu. ft. to 25,000 cu. ft. He
ought this should be the same as on 96th Street. He said Mr. Beery and
r Mr. Bozarth, owners of this property, were in favor of higher restrictions
also.
Mrs. Bert §nifJfin, who owns lots 7, 20, 21 & 22, Block 2, Golden Gate
Park Addition wants this area raised as high as possible. She said they had
paid $3000.00 per lot for this property.

Henry 0. Vander Lyn, 534 N.E. 94th Street, objected to the proposed
lower restrictions in the viicinity of his home, and the drop to 1' ,500 cu.
(ft. in the property below his house.
2 Mr. Thorpe objected to the drop from 23000 cu. ft on Grand Concourse
between 8th and 7th Avenues to 15000 cu. ft. the block east of N.E. Ito Ave.

Mr. Ring thought the 15000 cu. ft. houses around the railroad were too
ow and didn' t think the railroad should affect this property so much as

1go Mr. Ring brought out that no taxes could be derived from a house containing
only 15,000 cu. ft.
of 13,500 cu. ft.
Mr. L. C . Childress, 9105 N.E. 5th Ave. , said the restriction nomas too low
across the street from his home. He asked why they did not make this break
on 90th street instead of 91st street, that there are three nice homes fronting
on 91st street and on the other side of 91st Street the restriction is only
13,500 cu . ft.
Mrs. Sniff-en asked "why not divide at the alley line as was done on 96th St?"

Z Mr. Mitchel, 1000 N.E. 95th Street, wanted 95th Street East of the Boulevard
raised to a higher restriction than 20, 000 cu. ft.
ti Mr. Vetter, 800 N.E. 96th Street, thought restrictions around his home should
be higher. He said that 96th Street and 8th Avenue was Just as important as
the Grand Concourse and when other houses had 30,000 cu. ft in them in this
location, why should this territory be zoned for 15,000cu. ft. ?

Mrs. Stuhrman objected to proposed apartment house area.
Miss McKeown, 9760 N.E. 5th Ave. Road, said the reason they moved to the
Village was because it was advertized that there were to be no apartment houses
in the Village.
Mr. Knowles, 150 N.E . 95th St. , asked for a reason for the proposed
apartment house district.

Miss Coons said she paid $p4000.00 for a 50 ft. to nd could not build
on it now. The clerk asked her if she had applied at the Village office for
a permit and she answered that she had not.
,j;� Mr. Godard, 145 N.E. 94th Street, objected to the proposed apartment house
district.
1%. Mr. H. M. Thomas asked for a rising vote on the proposed apartment district
matter.
Mr. Paul Mack, 286 N .E . 99th Street, objected to the proposed apartment
use district. He said that the majority of the people didn' t know until the
day of this meeting about this proposed apartment house district. He brought

out that that apartment houses bring in riff-raff. He said "No one here
wants apartment houses so why should we have them! "
t Mrs. Edith Callaghan, 262 N.E. 97th Street, objected strenously to the
proposed apartment district. She said she did not want the kind of people living
around here who lives in apartment houses.
41►11, Mrs. Rollins, 260 N.E. 99th Street, asked if the property owners had
requested the zoning restrictions to be changed.
Mr. Charles Yuille, 117 N .E . 95th Street, said he would rather have an
apartment house by him�a, commercial building.
(j/& Mrs. Callaghan said that she seconded Mr. H. M. Thomas' motion for a rising
vote and was the first to stand, then others who objected to the proposed
apartment house district stood. (It appeared that everyone present stood up. )
Mr. 0. J. Halt-North, 278 N.E. 97th Street, objected to apartment houses and
called the people' s attention to the apartments over the commercial building at
97th and N.E. 2nd Ave, with trucks and cars parked in the back of �- � -
tj Mr. Champion, 185 N.E. 100th Street, said when he moved here a year and
a half ago that he was advised that 99th Street was the limit to the Business
district, and with this in mind he put his money into his property. He objected
strenously to the proposed apartment district.

��fW Mr. Shaw, 73 N .E. 99th Street, objected to the proposed apartment hoase
district.
1 Mr. Reakirt, 10117 N.E. 2nd Avenue, objected to the proposed apartment
house district. He brought out that apartment renters are not as desirable as
home owners.
WMiss Pratt Spears, 287 N.E. 96th Street, said she knew nothing about this
proposed apartment house district until the day of this meeting and she objected

ry \ Mrs. Reakirt objected to the business district progressing. She brought
t that Little River is so close that a larger business district is not needed in
the Village. She asked why the zoning could not be set now definitely and not have

be changed.all the time.
Lir. Shaw said he had tried to buy some business propery on 96th and 2nd Ave.
and the Real Estate men told him it was not for sale. He wanted to know if this
business section was tied up by some big owner who was going to make a Real Estate
game out of it.
*'*- Mr. Reakert asked what businesses were permited and what businesses were
prohibited under this proposed zoning ordinances. The Clerk read the zoning
ordinance covering the business that were permitted and those that were prohibited.
64 , Mrs. McCaffrey, 395 N .E. 92nd Street, asked if this proposed zoning ordinance
was lowering the building in the 4illage and was it bringing in business.
