09-30-1939 Special Meeting MINUTES OF THE IfEETING OF MIAMI SHORES VILLAGE COUNCIL Sept. 30, 1939 A special meeting of the Miami Shores Village Council was held on September 30, 1939, in the Village office at 7: 30 P. M. Present were Mayor Kitson, Councilmen John J. Lindsey, Stanley Milledge, W. Meade Stockdell, Frank 0 . Pruitt, the Village Attorney and the Village M Clerk. Minutes of the September 12th meeting were read and approved after corrections were made. The first business to come before the Council was the rumor concerning Mr. Fred A. Aufford, member of the Planning Board. Lir. Lindsey moved that it be recorded that it be the sense of this Council that the rumors concern- ing the Planning Board generally, and particularly with reference to Mr. Fred A. Aufford are without foundation and fact and that Mr. Aufford be here exonerated of charges contained in these rumors. This motion was second t ed by Mr. Milledge and unanimously carried. The next business to come before the Council was the matter of finding a place to dispose of garbage other than the present arrangement. The Clerk reported that he had talked to the Mayor of North Miami and had found that the pit used by North Miami was owned by a private party and that he wanted $50.00 per month from the Village for use of it; and that a further report would be submitted at the next regular meeting. The next business taken up was the report of Mr. Nice, and Mr. Milledge moved that the definite proposals contained in Mr. Nice' s report be accepted and that the Village Attorney be requested to draw an ordinance carrying this into effect. Mr. Stockdell seconded this motion. Mr. Nice' s proposal was read to the Council , a copy of which is attached hereto and made a part of these minutes. The Council then thoroughly discussed the proposal and the motion was put to a vote and carried by four-fifths majority, Mr. Pruitt casting the dissenting vote. 2. Mr. Lee M. Worley appeared before the Council and asked to be informed as to the completion and opening of the Golf Course. After some discussion between the Council and Mr. Worley, the Council and Lir. Arnold, a statement i,as made by Mr. Tyler that anyone who talks about the Golf Course should have f t a copy of the mortgage and other documents concerning the Golf Course in order to be able to state facts. Mr. Hewett, Mr. Lalor and Mr. Gordon ; requested the Council to take some action to solve the present misunderstand- ing between Bessemer Properties and the Council, and Mr. Lindsey made the following statement: "There has been a lot of talk about there being only one difference between the Miami Ohores Village Council and Bessemer Properties and about there being only one man personally objectionable to Bessemer Properties, but this talk and these statements have been made by persons not authorized to speak for Bessemer Properties. These statements are not in accordance with Mr. Hawkins' s letter and this is not the principle involved. rr I make this proposition: If Bessemer Properties in writing under the signature of an executive officer of that company or under the signature of that company' s recognized attorneys, Loftin, k Calkins, Anderson and Scott will recognize the principle that the Miami Shores Village Council has the right to name either a member I of the Council or any other resident of the Village that the Council may choose as one of the members of the golf course operating committee, without pressure, coercion, let or hindrance from Bessemer Properties, then I undertake that the only person who has been mentioned so far as being personally objectionable to Bessemer Properties will remove him- self and his personality from the controversy by offering to resign from the committee; and if I fail in this undertaking, I will feel justif- ied in assuming that I have failed as a member of the Miami Shores Village Council and feel justified in resigning therefrom and will do so. NICE In order that this report contain not only my recommendations for the benefit of the Village at large but also the definite means of placing my recommendations in practical effect, I am pleased to offer my formal proposal for such services as your Honorable Body may direct. 1. I will furnish Consulting Services, prepare all rough drafts and corrected drafts, make necessary search of Dade County and City of Miami records and supervise the completion of a Zoning Ordinance and Zoning Map, as required for Miami Shores Village, for the sum of X250.00, payable $ 125.00 when completed preliminary drafts of the Ordinance and Map are presented for your approval, the balance to be paid in full upon completion of the final ordinance and map. 2. I will furnish Consulting Services, prepare all rough drafts, corrected drafts and supervise the completion of a practical Build- ing, Plumbing and Electrical Code for Miami Shores Village for the sum of $450.00, payable w225.00 when completed preliminary drafts are presented for your approval , the balance to be paid in full upon completion of the final Ordinance. 3. Inasmuch as the following items are largely of an uncertain character and depend somewhat upon the desires of the Council, the Village is to furnish work space in their offices, steographic services, all office supplies, drawing supplies, drafting services, blue-printing, certified copies of "ity and County records, legal services, all cuts, plates and printing as required in the preparation of both the Zoning Ordinance and the Building Code. It is assumed that complete co-operation of the Village Council will be given in the necessary hearings and approvals required, and if reasonable dispatch in this regard is fulfilled, I can complete all, on or before January 1 , 1940; and, it is upon the basis of completion on or before January 1 , 1940 that my specified prices are made. 4. I will further undertake the position of Chief Building Inspector in charge of Building Inspection work for the Village and will as that official be on duty within the boundaries of the Village limits for three days, of eight hours each day, per week. As Chief Building Inspector, I will attend to the following, as Departmental Routtne: a. Inspect, approve or disapprove all plans and specifications submitted for building permits. b. Supervise the entire personnel of the Building Inspection Department. c. Prepare and place in effect office routine. d. Prepare and place in effect field inspection routine. e. Prepare all printed forms required. f. Submit to Council , suggestions for fee collections. g. Make the necessary field inspection as time will permit. h. Handle personally so far as possible, the field inspection for the new college. 1 • Will meet with the p Tanning Board every -tednesday evening, if necessary. J . Will meet with the Council at all regular meetings and at such Special meetings as the Council may direct. k. The present personnel in the Building Inspection Division is to remain for the present at least and perform the duties of Inspectors under my direct supervision. 1. I agree that so long as I am employed as a salaried Village official , I will not directly or indirectly engage in my professions as Architect, Engineer or Real Estate Broker on any project within the confines of the Village limits. I will accept the duties as outlined above for a period of six months from September 6, 1939, on the basis of salary at 0150.00 per month, plus milage from my residence in Miami. The present fiscal budget contains the following items: Building Inspector' s Salary 1800.00 Planning Board 300.00 Contingency Fund 7085.58 The fee collections through Building Inspection Department for the previous year: Permit fees 3287.43 Contractors & Sub-Contractors licenses 2150.00 Should the Building Department collect fees this year in proportion to last year' s collections, it appears that the costs of all the services in this proposal could be properly financed out of this year' s budget allowance.' I would suggest that as soon as practical, your Honroable Body- advise me your wishes regarding my proposals, in order that vie may adhere to the time limits specified.
