08-22-1939 Special Meeting MINUTES OF THE MEETING OF
MIAMI SHORES VILLAGE COUNCIL
August 22, 1939
A Special Meeting of the Miami Shores Village Council was held on
August 22, 1939, in the Village office at 7 :30 P. M.
Present were Mayor Kitson, Mr. Pruitt, Mr. Milledge, Mr. Lindsey and
the Village Clerk.
Minutes of the meetings of July 21, 26, and 31st, and August 1, 4, 7
and 8th, were read and approved with corrections made.
Mr. Phillips appeared before the Council in behalf of Mr. H. L. Clark
,regarding Mr. Clark's request that the zoning requirements be changed in
the area wherein his property is located and after some discussion
Mr. Milledge moved that the matter of changing the present zoning require-
ments in the area of E1 Pbrtal Sec. 4, Asbury Park, the South 90 ft. of Plaz
't Federal and North Shore Crest be referred to the Planning Board for their
recommendations and report at the next meeting of the Council. Mr. Pruitt
seconded this motion, motion carried.
Mr. Lindsey stated he would like to have copies of any proposed
ordinances at least one day before the council meeting.
Mr. Milledge moved that a permit be granted Mr. O'Dell to construct
a business building on Lot 3, Block 20. Mr. Pruitt seconded this motion,
and on putting same to a vote the results were

Mr. Pruitt yes
Mr. Lindsey no
Motion carried.
The next business to come before the Council was a letter from Mr.
Brown of the Commercial Advertising Company asking permission to distribute
advertising throughout the Village. Upon motion made by Mr. Pruitt,
seconded by Mr. Lindsey, Unanimously carried, this request was declined.
1.1r. Gordon B. Certain' s request, in the form of a letter, to construe,
a house on Lot 11 , Block 58, who' s plan was on file for the Planning
Board' s approval at the time the new zoning ordinance went into effect
and which plan complied with the old zoning ordinance was brought before
the Council. Upon motion made by Mr. Lindsey and seconded by Mr. Hilledge,
unanimously carried, ter. Certain' s application to build on this lot was
approved, under provision of Sec. 8 of Ordinance No. 86, allowing the
to
Council waive operation of certain sections of this Ordinance in case
of "unusual individual hardship".
A letter from the Planning Board was read by the Clerk referring
the plans of Mr. William S. Shaddock to the Council as there was some
question as to whether these plans conformed with Section 10 of Ordinance
No. 86. After due consideration, Mr. Pruitt moved that a building permit
be granted Mr. Shaddock, this motion was seconded by Mr. Milledge and
motion carried.
Mr. Phillips appeared before the Council and complained about the
zoning restrictions being too high in the buffer strip consisting of
about 200 acres in the N.J. 4 of the S.E. 4 Section 36-52-41 and in the
S1 of SE4 of Section 36-52-41, a strip between the County and the Village
and bordered on the north by the Dog Track. Mr. Phillips suggested that in
line 2 of paragraph 5 under Section 6 of Ordinance No. 86 that the word
"exclusive" be strickened and the word "inclusive" be inserted in lieu
thereof. Mr. Lindsey moved that Mr. Phillip 's remarks be recorded and
the matter of regoning this particular area be acted upon at a future
date by the Council. Nor. Pruitt seconded this motion, unanimously
carried.
Mr. Lindsey moved that Items 7 and 8 of the agenda be held over until
the next regular meeting of the Council . Mr. Pruitt seconded this motion,
unanimously carried.
Upon motion made by Mr. Pruitt and seconded by Mr. Lindsey, meeting
was adjorned.
