04-11-1939 Regular Meeting MINUTES OF THE MEETING OF MIAIAI SHORES VILLAGE COUNCIL April 11, 1939 The regular monthly meeting of the Miami Shores Village Council was i held on April 11, 1939, in the Village office at 7:30 P. M. 1 Present Frere Mayor Carlisle, Mr. Pruitt, Mr. Gordon, Mr. Kitson and the Village Clerk. Minutes of meetings of March 14th, March 21st, March 25th, March 27th and April 3rd were read and approved. Mr. Lester Mitchell of 1000 N. E. 95th Street, appeared before the Council and complained about the dust from the Lane at 10th Alvue and 95th Street, which runs along the side of his house. The Council instructed the Village Manager to make a survey of this street, and Mr. Mitchell was informed that no action could be taken on this matter until this survey was made. Mr. C . W. Dean appeared before the Council and the Clerk read a letter from him appealing to the Council for a permit to build on Lot 3 I & E2 of 4, Block 56, as same was rejected by the Planning Board because it did not conform with the buildings in the surrounding territory. The Council advised Mr. Dean to take the matter up with the Planning Board again and should. they refuse to give him permission to build, to present his appeal to the Council for action. It was moved by Mr. Gordon and seconded by Mr. Pruitt that the Plat of O'Dell Manors with the papers attached be approved and officially signed. A letter from the Planning Board approving the Plat of First Addition to Marilyn Heights was read by the Clerk, and it was moved by Mr.. Gordon and seconded by Mr. Pruitt that this plat be approved and officially 4 signed. i The complaint of Mr. Vickers at a previous meeting that the public f was driving across his property at N. E. 9th Avenue and 94th Street, was brought before the Council again and the Village Manager explained that a survey had been made and according to the Engineer's certificate and stakes the present road is running across Mr. Vicker' s lot, and that there is sufficient right-of-way for this road to be moved north, with a very slight expense involved, and suggested that this be done. Upon motion made by Mr. Pruitt and seconded by Mr. Gordon, the suggestion of moving this road north was approved. , P � The next business to come before the Council was aAproposed beautification program of the Village and a proposed letter to be written to the Village improved property owners asking them to cooperate financially in order to get more done with the amount of money appropriat- ed in the budget for trees and shrubbery. Upon motion made by Mr. Pruitt and seconded by Mr. Gordon the proposed beautification program and letter was approved by the Council. A letter from Mr. Thomas J . Ellis resigning as member of the Golf Committee was read.by the Clerk. The Village Manager was instructed to write a letter to Mr. Ellis expressing appreciation for the fine work done by him on this committee and that the Council regrets he is unable to continue as a member of this committee. Upon motion made by Mr. Pruitt and seconded by Mr. Gordon the request of the Planning Board that its membership be increased to five was denied until a full membership of the Council be present. A letter from Mr. H. L. Clark, Jr. was read, and Mr. Clark appeared before the Council, proposing to sell to the Village that part of Lot 11 lying North of Biscayne Blvd. , and Lots 13 and 14 of Asbury Park, for the sum of $10,675.00, same to be used as a park. Mr. Clark's letter of proposal was ordered received and filed by the Council and it was explain- could be present this to Mr. Clark that when a full membership of the Council a 1 matter would be taken up and that they would let him know their decision as soon as possible. Mr. 0. W. Collins appeared before the Council and asked if the $500.00 bond furnished by Mr. Kirby for the building of sidewalks and streets in Kirby' s Addition could be released providing Mr. Frederick put up a bond of $500.00 to assure the Village that sidewalks on three sides of his property, Lot 1 , Kirby' s Addition, would be built. The Council advised Mr. Collins that this could be done. Two letters were read from Mr. Frederick assuring the Village of his intention of building these sidewalks. Upon motion made by Mr. Pruitt and seconded by Mr. Gordon, Ordinance No. 75 was unanimously passed and adopted, a copy of same being attached to and made a part of these minutes. Upon motion made by Mr. Kitson and seconded by Mr. Gordon, Ordinance Nos. 76, 77, 78 and 79 were unanimously passed and adopted, copies of same being attached to and made a part of these minutes.. Upon motion made by Mr. Gordon and seconded by Mr. Kitson, March bills in the amount of $1710.29 were approved, ordered paid and made a part of these minutes , after which the meeting was adjourned. ' The Planning Board has gone over this plat in detail with the Village Manager and has approved same. Since the original Plat of Marilyn Heights, fronting West on Northeast 9th Avenue was accepted and approved without sidewalks and since the street known as Northeast 9th Avenue has already been put in and paved we suggest there be no requirements for sidewalks in this First Addition. This plat was discussed at three separate meetings and, after due consideration, the subdividing of this land as shown on the attached plat met with the unanimous approval of the Planning Board. The Planning Board felt that to subdivide this land as shown would be to the best interest of the Village since it would face the greatest majority of the houses away from the undeveloped area Test of Northwest 3rd Avenue and North of 95th Street, which are not a part of the Village. Further, in consideration of the approval of this tentative layout, the developers agree to plant Australian Pines along the Western boundary on 3rd Avenue to the north boundary on 95th Street and have agreed to a rezoning of this area from 12,000 cubic feet minimum to 13,500 cubic feet minimum. Your Planning Board recommends the tentative approval of. this layout subject to the necessary requirements as to streets, sidewalks and other necessary improvements, the planting of the pine screen and agreement as to re-zoning. Pursuant to the laws -governing the Village a iregular election to elect two members of the Village Council to succeed, John M. Carlisle and Hugh H. Gordon, Jr. , is hereby called for Tuesday, June 20th, 1939. SECTION 2. BE IT ORDAINED BY MIAMI SHORES VILLAGE: SECTION 1. A regular election for June 20, 1939, to elect two members of the Village Council to succeed John M. Carlisle and Hugh H. Gordon, Jr. , having been called by the Council for Tuesday, June 20, 1939, the Clerk of the Village is hereby directed to open the registration books of the Village on April 15, 1939, to allow duly qualified electors of the Village to register therein up to June 15, 1939, at which time the said Clerk shall close said registration books and thereafter refuse any further registrations. SECTION 2. Qualifications of persons desiring to register for said election shall be established by said electors and received by said Clerk and the Council in accordance with the Charter of said Village and of the ordinances and laws now in force and effect concern- ing elections within said Village. SECTION 3. Registration of peraons prior to the adoption of this ordinance for the purpose of establishing a residence for home- stead exemption, or because of absence from the Village during the registration period heretofore accepted by the Clerk, are hereby rati- fied, approved and confirmed, and the same are hereby acknowledged and accepted as valid registrations of qualified electors within the mean- ing and intent of the charter, ordinances and laws of the Village con- cerning the same. BE IT ORDAINED BY MIAMI SHORES VILLAGE: SECTION 1. All registered and qualified electors of Miami Shores Village who shall be absent from the Village on the day called for the regular election to be held June 20, 1939, may cast their ballots in said election with the Clerk of -the Village, after being duly registered, according to the laws and ordinances of the Village, from May 15th, 1939, to and including June 17th, 1939. SECTION 2. Upon the receipt of absentee ballots as pro- vided ' for in the foregoing Section, the Clerk shall properly safe- guard them, and each of them, and upon election day aforesaid, he shall place the same in the ballot box provided for in said election, and thereafter said absentee ballots shall be' governed by the laws and ordinances of the Village concerning elections held therein. SECTION 3. Lawton McCall Village Manager and Clerk i i MIAMI SHORES VILLAGE ORDINANCE No. 78 AN ORDINANCE FOR THE APPOINTMENT OF TWO ELECTION JUDGES WHO WITH THE VILLAGE CLERK SHALL CONSTITUTE AND BE THE ELECTION BOARD AND SHALL CONDUCT THE ELECTION CALLED FOR MIAMI SHORES VILLAGE ON JUNE 20, 1939, IN ACCORDANCE WITH THE LAWS GOVERNING THE VILLAGE ELECTIONS. BE IT ORDAINED BY MIAMI SHORES VILLAGE: SECTION 1. The Council having determined the qualifications of Carl S. Orleman and Mrs. John M. Ritter as election judges of the regular election to be held June 20, 1939, and having been found by the Council that said Carl S. Orleman and Mrs. John M. Ritter have fully qualified in every respect concerning Village elections, the said Carl S. Orlemen and Mrs. John M. Ritter, and each of them are hereby appointed as election judges of the regular election to be held in Miami Shores Village on June 20, 1939, to elect two members of the Village Council to succeed John M. Carlisle and Hugh H. Gordon, Jr. SECTION 2. Each word, phrase, sentence or section of this ordinance shall be severable and the invalidity of any word, phrase, sentence or section shall in no way or degree impair any other part or parts thereof. } SECTION 3. Lawton McCall Village Manager and Clerk MIAMI SHORES VILLAGE ORDINANCE NO. 79 AN ORDINANCE RELATING TO THE QUALIFICIATIONS OF CANDIDATES FOR MIAMI SHORES VILLAGE COUNCIL, AN ELECTION FOR WHICH WILL BE HELD JUNE 30, 1939, WITHIN THE VILLAGE TO SUCCEED JOHN M. CARLISLE AND HUGH H. GORDON, JR. BE IT ORDAINED BY MIAMI SHORES VILLAGE: SECTION 1. All candidates for Miami Shores Village Council to succeed the two members of the Village Council, John M. Carlisle, and Hugh H. Gordon, Jr. , shall be nominated upon written petitions signed by 10% of the registered qualified electors of the Village, said petitions to be filed with the Village Clerk on •or before May 10, 1939. Within ten.' days after May 10, 1939, the Clerk shall, after due examination of said petitions as provided by law, and if he finds that the same comply with the law governing elections in Miami Shores Village in all respects both as to the qualifications of said candidates and of the requisites of said petition, shall certify that said petitions and the candidates for whom said petitions were filed, shall be declared to be duly and properly nominated for said election and said positions as aforesaid. SECTION 2. After certification of petitions of the said candidates as provided for in the foregoing section, the Clerk shall give notice of said election in accordance with the laws of said Village, and place the names of said candidates upon the official ballot of said Village for said election. SECTION 3. Each word, phrase, sentence or section of this ordinance shall be severable and the invalidity of any word, phrase, sentence or section shall in no way or degree impair any other part or parts thereof. SECTION 4. All ordinances and parts of ordinances in conflict herewith are hereby repealed. SECTION 5. This ordinance shall be effective immediately upon its passage.
