MIAMI SHORES VILLAGE COUNCIL
Jan. 17, 1939
The regular monthly meeting of the Miami Shores Village Council was
held on January 17, 1939, in the Village office at 7: 30 P.M.
Present were Mayor Lindsey, Mr. Carlisle, Mr. Kitson, Mr. Pruitt,
the Village Attorney and the Village Clerk.
The Minutes of the meeting of December 13, 1938, were read and
after corrections, were approved.
The first matter of business to come before the Council was the
appointing of a Councilman to fill Lir. Otto H. Golfs term, who had
resigned, and upon motion made by Mr. Carlisle and seconded by Mr.
Kitson, Mr. Hugh H. Gordon, Jr. , was unanimously appointed to fill the
unexpired term of Mr. Goll, expiration date of said term being the
third Tuesday in June, 1939.
The next matter of business was the election of the Mayor for the

year of 1939, and upon motion made by Mr. Pruitt and seconded by Mr.
Kitson, Lir. John M. Carlisle was unamimously elected Mayor for the
ensuing year, who immediately took the chair.
Upon motion made by Mr. Pruitt and seconded by Mr. Lindsey, the

Village Department Heads were re-appointed, including.the Village
Manager, Village Attorney and the Village Marshall for the ensuing year.
Upon motion made by Mr. Pruitt and seconded by Mr. Kitson, the
Council authorized the payment of $75.00 to George E. Holt for legal
expenses in connection with the suit of Walter E. Peach Development
Corporation against Miami Shores Village.
The Village Manager presented a proposal from Byron Kirby concerning
the security to cover the building of sidewalks and streets in Kirby' s

Addition to Miami Shores, which the Council referred to the Village

Attorney authorizing the execution of the plat of said Kirby' s Addition
to Miami Shores upon the approval of the Village Attorney of said
security.
Upon recommendation from the Planning Board that the owner of
Lot 10, Golden Gate Park,be granted special permit to build on a 50 ft.
lot, it being pointed out that there was no additional land available
on either side of this lot, The Council authorized the issuance of said
permit in compliance with the recommendation.
Another recommendation from the Planning Board was that a special
permit be granted for the building of a house on Lot 35, Block 84, which,
upon motion made by Mr. Lindsey and seconded by Mr. Kitson, was approved
by the Council subject to the approval of the building plans by the Village
Building Inspector and by the Planning Board.
Upon motion by Mr. Lindsey and seconded by Mr. Kitson, an
Ordinance "ratifying the purcAse of pipe and fittings for the Golf Course
Sprinkler System under conditional Sale Contract and authorizing execution
of formal Contract" was adopted as read.by the Village attorney.
A letter from the People' s Water and Gas Company regarding the
distributing of gas in the Village was read and the Village Attorney was
instructed to study this letter and frame a reply to it.
A letter from Mr. Phillip DeLucca regarding a World' s Fair and
Exposition for the City of Miami was read and ordered filed.
A letter from the Village Attorney advising the Council of the
dismissal by the Court of the case of W. E. Peach Development Corporation
and others vs. Miami Shores Village was ordered fileds .
The next matter to come before the Council was, that the County
Tax Assessor sending Village Property owners to this office to register
in order that they might receive County Homestead Exemption but the
Village books are not opened until May. Don motion made by Mr. Lindsey
and seconded by Mr.Kitson, the Village Manager was instructed to write
to Mr. Lummus and explain to him that,while the Village is willing to
cooperate in everyway possible, they do not desire to make a change in

the date on which the books are opened.
Mr. J. 0. Phillips presented an amended plat of Golf View Estates
as there were some figures placed on the wrong side of a line of the plat
previously accepted. Upon motion made by Mr. Pruitt and seconded by
Mr. Kitson, the amended plat was approved.
Upon motion made by Mr, Pruitt and seconded by Mr. Kitson, the
Village Attorney was instructed to write a Resolution expressing
appreciation of and for the services of Honorable John J. Lindsey as
*<:ayor of Miami Shores Village during the year of 1938.
Mrs . Bessie Armour appeared before the Council and presented a
copy of a letter written by her to the Council on April 27, 1938, in
regards to building an apartment house on Lot 7, Block 74, to which
letter she claimed no reply was received. A letter was dictated to
Mrs . Armour by Mr. Lindsey and to be signed by the Village Manager,
this letter explaining to Mrs. Armour the steps for her to take in
presenting her case to the Planning Board and then their recommendations
would be received by the Council.
Upon motion made by Tyr. Pruitt and seconded by Mr. Kitson, the
Council passed and adopted Ordinance No. 73, said Ordinance being

A SUBDIVISION, FOR THE FISCAL YEAR 1938-39, IN PURSUANCE AND IN
ACCORDANCE IVITH 'THE TERMS OF PURCHASE OF LANDS FROM SAID ,�THEL M. HAUK ,
A WIDOW, NOT INCLUDED IN SAID GOLF COURSE, AND CONTAINING OTHER
PROVISIONS RELATIVE THERETO .

Upon motion by Mr. Lindsey and seconded by Mr. Kitson, approval
for the payment of December bills in the amount of $1687.69 was made,
after which the meeting was adjourned.

WHEREAS, Honorable John J. Lindsey, was elected Mayor
of Miami Shores Village, for one year from January 1, 1938, to
January 1 , 1939, and
WHEREAS, through the loyal co-operation and assistance of
Honorable John J. Lindsey, during his tenure of office as Mayor of
said Village, the Village has enjoyed a successful year, and
:WHEREAS, 1Siami Shores Village as a whole, and the Council
thereof, are deeply indebted to the Honorable John J. Lindsey for his
services in this respect, and take this means to express their praise,
thanks and gratitude.
BE IT RESOLVED BY MIA2.1I SHORES VILLAGE, that the thanks
and appreciation of the people of Miami Shores Village, and the
Council thereof, be, and the same are hereby extended to Honorable
John J. Lindsey, former Mayor of Miami Shores Village, for his loyal
co-operation and assistance during his tenure of office as :.layor of
said Village.
BE IT FURTHER. RESOLVED that a resolution be spread upon the
permanent records of the Village, and that a certified copy thereof
be furnished to the Honorable John J. Lindsey.

We are attaching herewith sketches andBuilding
Permit for a residence on Lot 353, Block 84, Miami Shores
Section 3, together with letter from Mr. John A. Mahood to
the owner regarding inability to purchase additional property.
Your Planning Board has gone over the sketches
very carefully and due to the location of the lot and the
frontage of fifty feet adjoining an alley on the Eastern
Boundary and that the lot is some seventy-six feet at the
rear and since the owner is willing to set the residence
back so that the side line restriction will be ten feet on
the West side and six and one-half feet on the alley, we
recommend to the Councir that permit be granted for the
construction of the residence shown on the attached sketches.

Regarding the matter of securing additional frontage
to add to your lot 35,, Block 84, Miami Shores, I regret to
inform you that I have been unable to get any satisfaction from
Mr. Trotter, who owns the adjoining lot 34, as he will neither
sell 15 or 25 feet which you have shown a willingness to buy,
nor can I get him to offer more than $900 for your Lot 350
as he feels he does not need th&s to add to his present homesite
of 100 feet. I do not know that I can do anything further
about it, as this seems to be final so far as Mr. Trotter is
concerned.
It may be possible that the Village Council would
give you a permit to build a house upon the lot, provided
you set the house back - say 50 feet from the front line,
as at this point the lot would be considerably wider than
50 feet, and, together with the alley on the East, which
you could use for a driveway, would make a very good building
site,

Gentlemen:
We are attaching herewith a blue print and

building permit for a residence to be built on Lot 10,
Golden Gate Park.
Since this lot, we are informed by the City
Manager, is between two existing houses and since it is
not possible or practical to purchase property on either
side and since the refusal to issue a permit would deprive
the owner of the property to his constitutional right to
use that property, we would suggest that in this instance
a building permit be allowed.
