MIAMI SHORES VILLAGE COUNCIL

The regular monthly meeting of the Miami Shores Village Council
was held on November 8th, 1938, in the Village office at 7: 30 P. M.
Present were Mayor Lindsey, Messrs. Carlisle, Kitson, Pruitt,
the Village Attorney and the Village Clerk.
Minutes of the meetings of October 13th and October 25th, 1938,,

were read and approved.
The first business to come before the Council was the matter of
Mrs. Young's request for a reduction in her taxes. The Council
confirmed Mr. McCall' s action in this matter, it being necessary for
her to wait until the next meeting of the Equalization Board to present
her complaint.
The following people omitted filing their Homestead Exemptions and
appealed to the Council to be allowed to file at this time for exemptions
from their taxes now due and payable: Mr. Spurdle, Mr. L. W. Nelsen
and Mr. Troy Hewett. Upon motion made by Mr. Carlisle and seconded by
Mr. Kitson the Council agreed to refer. these late applicants for

exemption to the Village Manager and to the opinion of the Village
Attorney, and the Council would be governed accordingly.
Mr. Sanders appeared before the Council and objected about his
and Mr. McDonald's houses being assessed on August 1st and claimed
they were just two-thirds completed. The Council decided to refer this
matter to the opinion of the Village Attorney and Village Manager, and
to leave the assessment as is unless the Village Attorney advised
otherwise.
Mr. Lanaham appeared before the Council and protested on behalf
of his clients on having to put sidewalks in the proposed Walter's
' Park Plat before the Plat would be approved. As this matter was passed
on at the last meeting,the Council declined to reconsider same.

--Mr. Hanock appeared before the Council and presented the proposed
Kirby Plat. It was decided that before the Council could act upon
this plat the Planning Board be requested to see that this plat
conformed with the contiguous territory,and to state just what is
meant by "improvements" outlined in its letter.
Mr. H. L. Clark appeared before the Council in regards to selling
his land in Asbury Park and Plaza Federal to the Village as this
property is restricted to residential purposes. Mr. Clark explained
to the Council that the appraisal on this property for business purposes
is three times more than for residential purposes. It was decided by
the Council to have a meeting within the next thirty days, or at least
at the next regular, monthly meeting, to determine whether or not to
change the Zoning Ordinance aff ecting the property described by Mr. Clark
in his offer to sell, and before the Council decides on a change, to

take this matter up with Mr. Clark and other persons affected in that
territory, the Village being unable to buy this property.

Mr. Fahnstock, who has owned two separate fifty foot lots since
1924, appeared before the Council with a request that he bye granted
a special permit to build on one of these lots, that he had tried
to buy land on either side of him from Bessemer Properties in order

to comply with the 75 ft. frontage restriction but that he could not
get clear title to this adjoining land. The Council decided to take
this matter up with Bessemer Properties and try to get some definite
information on this matter.
Mr. Matchett, who owns Lot 7, Block 11, Pasadena Park, appeared

before the Council and asked that he be granted a permit to build
{ on a fifty-foot lot. It was decided by the Council to have the Planning

Board to submit a regular form of recommendation to them as to whether
Mr. Matchett should be given this permit or not.

Mr. Bartels, 339 N. B. 100th St. , appeared before the Council
and protested against the assessment of his house. The Council advised
hien it would be impossible to do anything about it at this time but to take
it up before the next Equalization Board meeting.

The Village Clerk had received some complaints from persons living
on N. W. 100th Terrace and .100th Street about the streets but as there was
no one present to present their complaints no action was taken on this
matter.

The next business to come before the Council was a letter from

our Recreational Director asking permission to use the Community House
on each Tuesday night for adult training in handicraft and also for adult
recreational purposes. Upon motion made by Mr. Carlisle and seconded by
Mr. Kitson, permission to use the Community House for the handicraft class
was denied but permission was granted to use it for adult recreational
purposes.

A letter from the Planning Board Chairman regarding a letter he
had received from Ray E. Behrens relative to Lot 1, Block 67 which has
a seventy-foot frontage was presented to the Council. Mr. Behrens plans
to put this lot on the market and wanted to be assured that the prospective
purchaser could build on same. In view of so many people asking special
permission to build on less than 75 ft. frontages it was decided that

Mayor Lindsey, the Village Attorney and Village Manager would get together
and submit a letter in regards to the waiving of the seventy-five foot
i
frontages in certain cases and a copy of this letter would be mailed
Mr. Behrens.
A letter from Bessemer Properties, Inc. , asking a rental of $50.00
on the garage used by the Village and owned by them was brought up and
as there was no allowance made for this in the current budget it was
decided to take the matter up with Mr. Hawkins of the Bessemer Properties
and try to get the rental price down for the remainder of the Village
fiscal year.

A letter from -Bessemer- Properties relative toa landscaping project
of the Village as a whole was brought before the Council and after due
w. _ discussion the Village Manager was instructed to reply to letter of Mr.

Hawkins of Bessemer Properties accepting their proposal of free assistance
of their landscape architect in working up a landscape project an their
donation of trees and shrubbery from their nursery, the Village Manager
was further instructed to cooperate in all respects with Bessemer Properties
in preparing this proposed project. The Council wished to express thanks
for this offer from the Bessemer Properties.
The matter of a Resolution pledging participation in construction
Miami of a Greater
Mi i International airport was taken up by the Council.
Mr. Carlisle was asked to take the chair and upon motion by Mr. Lindsey
and seconded by Mr. Pruitt it was decided to adopt the form of Resolution
as presented with the following exception: Strike out words in Section 21

immediately following the words "pledges to take such official actions
as are" and insert in lieu thereof 'legal and--permissable under the charter
of Miami Shores Village and general laws of the State of Florida", and a
pledge of $2000.00 in this participation be made, said Resolution being
Miami Shores Village Resolution No. 227.
Upon motion by Mr. Kitson and seconded by Mr. Pruitt, the new
Street Light Contract as offered and explained by Mr. Holt was accepted
and the Village Mayor and Village Manager be authorized and directed to

sign this contract.
Upon motion by Mr. Kitson and seconded by Mr. Carlisle, approval
was made of Dr. Vincaet's suggestion that the Council participate in the
Thanksgiving Service.
Upon motion by Mr. Kitson and seconded by Mr. Carlisle, October
bills in the amount of $1535.80 were approved and ordered paid, a list of
same are attached hereto and made a part of these minutes.
