05-27-1937 Special Meeting MINUTES OF THE MEETING OF MIAMI SHORES VILLAGE COUNCIL May 24th, 1937 At a special meeting on May 24th, 1937 the Council approved consolidating all existing acts of the Legislature re- lating to the Village Charter into one act, the new act to include the following: ARTICLE 1, SECTION 1. Annex Blocks 1, 2, 3, Golden Gate Park an acreage east thereof to Northeast 10th Avenue, also the block south of 90th Street, north of Shore Crest, east of the present line; also part of EI .Portal recently annexed by ordinance. SECTION 5. NEW - Power to exclude lands, subject to an Flection throughout the Village, prohibiting more than one election in any year affecting the same land. ARTICLE II. SECTION 4. Expressly authorizes granting of exclusive or non exc usive franchises, SECTION 9. Adds "Cubic contents" to zoning power. SECTION 10. Amplifies power over billboards. SECTION 11. NEW - Power to impose conditions to approval of plat ` SECTION 12. NEIN - Adds power in dondemnation cases to make a deposit and enter the lands immediately, if de- sired. This is an adaption of a recent Federal Act, 40 U.S.C.A. 258A, Supplement, and in some circumstances would be of material advantage. ARTICLE III. SECTION 10 Harmonizes and clarifies terms of councilmen - being in subatance the same as under- stood at present. SECTION 2. Makes removal of a councilman subject to a Village election within 60 days. The power of removal heretofore being unlimited in the Council. . Adds further power to arrest outside of the Village. SECTION 4. ESQ g Empowers the Village Jude to "try and to ermi�n t charges instead of to "try and determine". Mapes ordinances effective upon passage without finding of an emergency unless otherwise provide in the ordinance s and eliminates posting or publication, provided that two councilmen may require posting and one publication. 'Sec. 6) ARTICLE IV Clarifies requirement of property ownership to votes ixes 10 days before bond election as the date to determine .ownership, adds express provision not requiring an election to validate a mortgage or lien secured only by the property, or improvements thereon, and 'not con- stituting a general obligation of the Village. ARTICLE V . SECTION 5. Commences interest on tax cert- icates on Flrsf Monday in April, eliminating inconven- ience of computing interest for the few days of April be- fore the first Monday. SECTION 5 6 7, Further clarifies remedies on tax cert- IAicates and liens - minor phraseology. ARTICLE VI. SECTIONI. Adds express power to create special improvement districts, specifying parks and golf courses expressly. SECTION 2. Adds express power to impose gar'gage and such taxes, by dwellings. The bill ratifies all taxes, compromises and other acts of the 'Village. There being no other business presented for discussion the meeting was adjourned.
