MINUTES OF THE MEETING OF
MIAMI SHORES VILLAGE COUNCIL
Dec. 10th, 1936
A special meeting of the Miami Shores Village Council
was held on December 10th, 1936, at twevle thirty P. M.,at 154
East Flagler Street. All members of the Coundil were present,
with Mayor Pruitt presiding.
The first business coming before the Council was the petition
to be annexed to Miami. Shores Village, by the residents and prop-
erty owners of the property fronting the south side of Northeast
91st Street from North Miami Avenue to Northeast 5th Avenue.
And upon motion of Mr. Lindsey, seconded by Mr. Kitson, the follow-
ing Ordinance was adopted.
AN ORDINANCE ANNEXING CONTIGUOUS LANDS AND
INHABITANTS THEREON BY EXTENDING THE SOUTH-
ERN BOUNDARY LINE OF THE VILLAGE FROM ITS
PRESENT LOCATION, VIZ: BEGIN AT A POINT
ON THE WEST BOUNDARY OF LOT 130 BLOCK 180
EL PORTAL, WHERE THE SOUTH LINE OF LOT 11,
BLOCS 1, OF EL PORTAL WOULD BE IF EX`T`ENDED
TO SAID POINT OF BEGINNING; THENCE WESTERLY
ALONG THE SOUTH LINE OF LOTS 1-0 20 30 40 5,
69 70 80 9, 10, 11 and 12, BLOCS 1, EL PORT-
AL; THENCE WESTERLY ALOND THE SOUTH LINE OF
LOTS 1, 20 30 40 5, 6, 70 80 99 10, 11 AND
120 BLOCK 2, EL PORTAL; THENCE WESTERLY

INTERSECTION OF MIAMI AVENUE AND NORTHWEST
MINETY - FIRST STREET, THE SAME BEING PART
OF THE SOUTH BOUNDARY LINE OF SAID VILLAGE,

SAID EL PORTAL BEING A SUBDIVISION LOCATED
IN DADE COUNTY, FLORIDA, ACCORDING TO PLAT
BOOK 120 PAGE 56, PUBLIC RECORDS OF DADE
COUNTY, FLORIDA, AND SAID PROPERTY AND IN-
HABITANTS ?LOCATED UPON SAID TERRITORY WITH-
IN SAID AREA INCLUDED BY THE EXTENSION OF SAID
BOUNDRY LINES AS AFORESAID ARE 'HEREBY ANNEX-
ED TO MIAMI SHORES VILLAGE, AND PROVIDING
FOR THE EXERCISE OF POWER AND JURISDICTION
OVER SAID PROPERTY AND SAID PERSONS, AND
DECLARING AN EMERGENCY TO EXIST.
WHEREAS,thirteen owners of property immediately to the south
of the Village have by formal petition requested the inclusion of
the hereinafter described property in Miami Shores Village and
the annexation thereof, and
WHEREAS, four owners of property in aaid territory have ex-
pressed to the proposers of said inclusion as being in favor there-
of, but not signing said petition, and
WHEREAS, only one land owner has made specific objection,
• being the owner of seven lots or less, and has opposed inclusion
whitin said Village, and
_WHEREAS, the remaining property owners, being ten in number
in said territory reside in the North and outside of the State of
Florida, and having been contacted by letters of the proposers
of said inclusion; and that only two of said ovmers have answered
and that same have been in favor of such inclusion, and
WHEREAS, certain valuable property located within the Village
facing Northeast Ninety-first Street might suffer irreparable
harm and injury if said inclusion is not }Had, in that the South-
ern boundary line of said Village as it now exists, does not in-
clude the said South side of Northeast Ninety-first Street, nor
control nor have jursidiction thereof, and
WHEREAS, by inclusion of said territory as hereinafter
described, all lawsi parts of laws, ordinances, resolutions and
3ursidiction of the Village shall thereupon immdeiately become
applicable and binding upon said annexed territory and all persons
residing therein, and
• WHEREAS, the inclusion of such annexed territory is con-
tiguoue to the Village and said territory is not located in any
other Municipal Corporation,
NOW THEREFORE, BE IT ORDAINED BY MIAMI SHORES VILLAGE:
SECTION 1, That the Southern boundary line of the Village
beginning at a point, be, and the same is hereby extended as
follows:
Begin at a point on the West boundary of Lot 13, Block 18, E1
Portal, where the south line of Lot 1, Block 1, of El Portal
would be if extended to said point of beginning; thence Westerly
to and along the South line of Lots 1, 2, 39 4, 50 6, 7, 89 9,
10, 11, and 12, Block 1, of El Portal; thence Westerly to and
along the South line of Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11,
and 12, Block 2, E1 Portal; thence Westerly to and along the
South line of :Lots 1, 2, 3, 4, 5, 69 7, 8, and 9, Block 3, El
Portal; thence South to and along the West line of Lot 15,
Block 30 E1 Portal, to a point thereon where the South line of
Lot 120 Block 3, El Portal, would be if extended; thence wester-
ly alond the South line of Lot 12, Block 3, of E1 Portal, to
and along the South line of Lot 129 Block 70 of El Portal; thence
North on the West line of said Lot l2, Block 7, of E1 Portal, to
a point thereon where the South line of Lot 89 Block 7, of E1
Portal, would be if extended; thence Westerly to and along the
_ South line of Lots 9, 8, 7, 60, 59 4, 3, 20 1, Block 7, of El
Portal, to and along the South line of Lots 1, 2, 39 40 5, 6, 7,
8, 9, 100 15, Block 8, El Portal, to the West line of Miami. Avenue;
thence North to the Northwest intersection of Miami Avenue and
• Northwest Ninety-first Street# the same being part of the South
boundary line of said Village, said El Portal being a subdivision
• located in Dade County, Florida, according to Plat Book 12, page
56, Public Records of Dade County, Florida, and said territory
+� including all streets, alleyways, sidewalks,, and all other prop-
erty of like nature, by reason of the extension of said boundary
line and all inhabitants thereon be, and the same are hereby
annexed and incorporated in and to Miami Shores Village, and by
reason thereof are a part of Miami Shores Village, for all
purposes whatsoever,
SECTION 2, That Miami Shores Village shall immdeiately
upon the passage of this ordinance assume jurisdiction over the
described property herein annexed as though the same had been
originally incorporated in said Village.
SECTION 3, That all Ordinances, parts of Ordinances, re-
solutions, Laws and portions of Laws of said Miami. Shores Village,
and of the State of Florida, pertaining to Municipal Corporations
and the territory incorporated herein shall upon the effective
date hereof be, and become applicable and appertain to the
territory herein annexed.
SECTION 4, That in accordance with Miami Shores Village
Ordinance No, 11, entitled; "An Ordinance Zoning the Village as
to Uses of Land and Buildings and Relating to Interpretation and
Enforcement of the Ordinance", and all amendments thereto, the
said annexed property shall upon the effective date hereof be,
and become a part of Zone 30 as provided for in said Ordinance
No, 110 and all amendments thereto, as aforesaid, and subject
to the terms, conditions and provisions thereof.
SECTION 5. Each word, phrase, senyence or section of this
ordinance shall be severable and the invalidity of any word, phrase,
sentence or section shall in no way or degree impair any other
• part of parts thereof.
SECTION 64, That an emergency exists for the protection of
the public welfare, life and property.
SECTION 7, This ordinance shall be effective immediately
upon its passage,

The Council then discussed the locations of new street
lights, and upon motion made by Councilman John M. Carlisle and
seconded by Councilman John J. Lindsey, the following resolution
was duly passed and adopted:

CERTAIN MUNICIPAL STREET LIGHTING AGREEMENT
DATED THE 7TH DAY OF MAY,1932, NOW IN EFFECT
. BETWEEN THE MIAMI SHORES VILLAGE AND SAID
COMPANY AND ALL SUPPLEMENTARY AND SUPPLE-
MENTALAGREEMENTS THERETO; AUTHORIZING AND

HALF OF MAIMI SHORES VILLAGE TO DELIVER A
CERTIFIED COPY OF THIS RESOLUTION TO
FLORIDA POWER & LIGHT COMPANY AS WRITTEN
NOTICE TO INSTALL SAID ADDITIONAL STREET
LIGHTS AND RESTORE TO SERVICE SAID STREET
LIGHTS UNDER THE SAID MUNICIPAL STREET
LIGHTING AGREEMENT# SUPPLEMENTARY AND SUPPLE-
MENTAL AGREEMENTS THERETO.

BE IT RESOLVED BY MIAMI SHORES VILLAGE:
1, That Miami. Shores Village, Florida, hereby authorizes
and directs Florida Power & Light Company to install and there-
after serve., in accordance with the terms and conditions of
that certain Municipal Street Lighting Agreement dated the 7th
• day of May, 1932, now in effect between said Village and said
Company, and Supplementary and Supplemental Agreements thereto,
the following described street lights:
Eighteen (18) 100 Candlepower Overhead Bracket
Type Street Lights, owned by the Company, to
be operated on an ANA burning schodule, at the
fallowing locations:
N, W, 101st Street 2nd pole W, of Miami Court
N, W, Miami Court at 100th Terrace
N, W, 100th Street 3rd pole W, of Miami Court
°N. E, 1st Avenue at 95th Street
N, E, lst Avenue at 94th Street
N. E, lst Avenue at 93rd Street
N. E. 1st Avenue at 92nd Street
N, E, 105th Street 2nd pole E. of 2nd Avenue
N. E. 105th Street at 3rd Avenue
N. E. 105th Street at 4th Avenue

2, That Miami Shores Village, Florida, . hereby au-
thorizes and directs Florida Power & Light Company to restore
• to service, in accordance with that certain Letter Agreement
between the said Village and said Company, dated September 21,
1936, and thereafter serve under that certain Municipal Street
Lighting Agreement Dated May 7, 1932, between the Village and
the Company, and all Supplementary and Supplemental Agreements

thereto: fifteen (15) 100 candlepower "White Way" underground
street lights, owned by the Company, to be Operated on an ANA
burning schedule at the following locations:
• N. Miami Avenue at 91st Street
N. Miami Avenue at 94th Street
N. Miami Avenue at 97th Street
N. Miami Avenue at 100th Street
N. Miami Avenue at 101st Street
N. Miami Avenue at 103rd Street
N. E., 96th Street, 1st light E. of
2nd Avenue on S, side.

3. That the Village Clerk Of and on behalf of Miami
Shores Village, be and he is hereby authorized and directed to
deliver a certified copy of this Resolution to Florida Power &
Light Company as written notice to install the said Overhead
Bracket Type street lights and restore to service the said "White
Way" underground street lights, under the said Municipal Street
Lighting Agreement, Supplementary and Supblemental Agreements
thereto.
