MIAMI SHORES VILLAGE COUNCIL.
September 21st, 1936
A special meeting of the Miami Shores Village Council
was held on Monday, September 21st, 1936 at the Village office.
All members of the Council were present as was the Village Attorney
and Village Manager.
The minutes of the previous meeting were read and
approved.
The following resolution was passed upon motion of
Mr. Lindsey, seconded by Mr. Kitson.
A RESOLUTION COMMENDING THE IMAEDIATE
CONSTRUCTION NND COMPLETION OF STATE
ROAD N0. 26-A.9 AND URGING THE STATE ROAD
DEPARTMENT TO ALLOCATE SUFFICIENT FUNDS
FOR THE SAME,
WHEREAS, Construction of Road No. 26-A from the lake
section of Florida into Dade County has long been quiescent, amd
WHEREAS, the benefits to be derived from the direction of
said road to all of south Florida and especially to Dade County
by the completion and use of said road will amount to millions of
dollars and be a stimulous to trade from all territiories affected
by the same, and
WHEREAS, the State Road Department of Florida has full
authority and sufficient money to proceed with the imediate
construction and completion of the said road;
NOW, THEREFORE, BE IT RESOLVED by Miami Shores Village
that the State Road Department is hereby urgently requested to
allocate sufficient funds for the construction and completion of
said road No. 26-A.
BE IT FURTHER RESOLVED that a copy of this resolution be
forwarede to the Chairman of the State Road Department, to the
Governor of Florida, to Congressman Mark C. Wilcox, to the daily
newspapers, and to the County Commissioners of Dade County, Florida.
Unanimously passed and adopted by vote of the Council on

COMPANY RELATING TO THE STANDARD MUNICIPAL STREET
LIGHTING AGREEMENT DATED THE 7TH DAY OF MAY, 1932,
AND ALSO RELATING TO THE SUPPLEMENTARY STREET
LIGHTING AGREEMENT DATED THE 27TH DAY OF SEPTEMBER
1934s BOTH OF WHICH AGREEMENTS ARE NOW IN EFFECT
BETWEEN SAID VILLAGE AND SAID COMPANY, WHICH
LETTER AGREEMENT AMENDS SAID COMPANY'S STREET
LIGHTING RATE SCHEDULE NO.2§ ATTACHED TO AND MADE
A PART OF SAID STANDARD MUNICIPAL STREET LIGHTING
AGREEMENT, SO AS TO MADE PROVISION FOR A RATE
COVERING A 100 CANDLEPOWER SIZE STREET LIGHT
TO BE INSTALLED ON THE EXISTING f1WHITE WAY"
UNDERGROUND SYSTEM IN MIXMI SHORES VILLAGE ARID
WHICH LETTER AGREEMENT FURTHER MAKES PROVISION
FOR THE RESTORATION TO SERVICE OF 100 CANDZE-
POWER"WHITE WAY" UNDERGROUND STREET LIGHTS IN

LIGHTING AGREEMENT, SUBJECT TO CERTAIN TERMS
AND CONDITIONS? AND WHICH LETTER AGREEMENT,

MAKES PROVISION, AT NO ADDITIONAL COST TO THE
VILLAGE FOR ELECTRIC ENERGY AND SERVICES, FOR
THE RESTORATION BY THE COMPANY OF ADDITIONAL
SERVICEABLE 100 CANDLEPOWER "WHITE WAY'S
UNDERGROUND STREET LIGHTS EQUAL TO 50% OF
THE AMOUNT OF STREET LIGHTS SO RESTORED TO
SERVICE IN ACCORDANCE WITH THE PROPOSED LETTER
AGREEMENT; AUTHORIZING AND DIRECTING THE MAYOR
AND THE VILLAGE CLERK OF AND ON BEHALF OF THE
VILLAGE OF MIAMI SHORES TO EXECUTE AND ENTER
INTO THE SAID PROPOSED LETTER AGREEMENT WITH
FLORIDA POWER & LIGHT COMPANY.
BE IT RESOLVED BY MIAMI SHORES VILLAGE:
1. That the proposed Letter Agreement with the Florida
Power & Light Company, set forth in form in Section 2 hereof,
• be and the same is hereby approved as to form and substance.
2. That the Mayor and the Village Clerk of and on
behal(f of the Village of Miami Shores be and they are hereby
authorized and directed to execute and enter into with said
Florida Power & Light Company the said Letter Agreement approved
in Section 1 hereof and hereinafter set forth in form, words
and figures as follows:
Gentlemen:
This relates to that certain Standard Municipal Street
Lighting Agreement now in effect between us dated the 7th day of
May, 19320 covering "all electric energy and services necessary
for the operation of .the street lighting system within the cor-
porate limits of Miami Shores Village, Florida, which is now or
may hereafter be installed*" in accordance with the terms and
conditions of our Street Lighting Rate Schedules Nos, 1�.and 2,
together with Supplementary Street Lighting Agreement between us
dated the 27th day of September, 1934,
In order for Miami Shores Village and its inhabitants
to enjoy additional street lighting service, you have advised us
of your intention to cause to be placed in service and thereafter
operated under the said Standard Municipal Street Lighting Agree-
ment and as a part of the street lighting system within the corp-
orate limits of Miami Shores Village, Florida, additional street
lights, including 100 candlepower size street lights to be in-
stalled on the existing "White Ways' underground system. in Miami
Shores Village. Our Street Lighting Rate Schedule No, 20 which
is attached to and made a part of the said Standard Municipal
Street Lighting Agreement makes no provision at 'this time for a
rate covering such a loo candlepower size street light and at
your request it is understood and agreed by and between us that
as of the date of this letter agreement the `Rate" clause of
our said Street Lighting Rate Schedule No. 2 shall be amended
and revised to read as follows:

Upon receipt from your Village Clerk of a certified
copy of Resolution of Miami Shores Village, authorizing the plac-
ing in operation of a serviceable "White Nay" underground 100
candlepower street light or lights under the said Standard Munici-
pal Street Lighting Agreement, we shall place in operation such
a serviceable light or lights and thereafter the same shall be a
• Part of the street lighting system within the corporate limits
of Miami Shores Village and we shall bill you and you shall pay
• us for the operation of said light or lights in accordance with
the terms and conditions of said Standard Municipal Street Light-
ing Agreement and said Street Lighting Rate Schedule No. 2, as
amended and rivised by this letter agreement. However,it is
understood and agreed that we shall be put to no cost and expense
in placing in operation the said street lights so requested by
you hereunder, except that we shall at our cost and expense in-
stall the necessary glassware and lamps in said lgihts, In the
event the placing in operation of the lights so requested by you
requires the incurring of any expense to make said lights serv-
iceable, except the expense of installing glassware and lamps, we
sahll not be obligated to place said lights in operation until
you have paid to us the cost and expense necessary to be incurred
by us in this regard.
As street lights ar restored to service as above
provided for and in accordance with the s&id Standard Municipal
Street Lighting Agreement and you are billed and pay for such
street lights so restored to service in accordance with said Stan-
dard Municipal Street Lighting Agreement, and we are put to no
expense in making such restorations, except the expense of install-
ing glassware and lamp, we shall restore to service additional
serviceable 100 candlepower "Mite Way" underground street lights
in Miami Shores Village equal to 500 of the amount of our street
lighting billing to you covering street lights restored to serveie
by us pursuant to this letter agreement and your Resolution or
Resolutions delivered to. us hereunder. Additional lights desired
to be restored to service in accordance with the terms and pro-
visions of this paragraph shall be by the procedure set forth in
Section 4 of said Supplementary Street Lighting Agreement. You
shall not be obligated to apy anything whatsoever for the additioz%al
elbetric energy and service supplied to you by resaon of the 500
additional servicalbe street lights provided for in this paragraph,
except the actual cost and expense incurred by us in reconnect-
ing such additional serviceable street lights and the cost
and expense necessary for making the same serviceable, which
costs and expenses shall be paid by you to us as provided for in
Section 5 of said Supplementary Street Lighting Agreement. Our
agreement in this respect shall be subject to each and every term,
provision, condition and zovenent of the Supplementary Street
Lighting Agreement dated the 27th day of September, 1934, now in
effect between us, including the terms and conditions of Section 5
of said Supplementary Street Lighting Agreement, just as though
such term, provision, condition and covenant was set out in full
herein and made a part hereof.
It is understood and agreed that the term of this
letter agreement shall be concurrent with the term of the Siad
Supplementary Street Lighting Agreement as such term is 4e* forth
in Section 8 of said Supplementary Street Lighting Agreement.
It is further understood and agreed that except as
expressely provided herein, the said Standard Municipal Street
Lighting Agreement, the said Street Lighting Rate Schedule No. 2
and the said Supplementary Street Lighting Agreement shall remain
in full force and effect between us.
If you agree to the foregoing, kindly so indicate by
signing this letter and the attached copies in the spaces pro-
vided below for that prupose.

Mr. Lawerence presented his plan for the golf course,

which the Council examined and expressed the opinion that it
was a very suitable plan, but as financial aid to build the Course,
had not been secured, the Council was not in a postion to
enter into an agreement with Mr, Lawerence, but that if the
project should be approved and the plan used same suitable
a'trangement would be made.
Upon Motion of Mr. Lindsey and seconded by Mr, Kitson,
the Village Manager was instructed to purchase road oil for the
Village streets in an amount not exceeding eleven thousand dollars.
Mr, Frix, Chariman of the Planning Board, reported to
the Council that the Planning Board was working on a New Zon-
ing Ordinance and would present it to the Council in the near
future.
The Village Manager was instructed to ascertain the
amount neceasary to obtain the property in .:Asbury Park wanted
for Park purposes.
There being no further business presented for discuss-
ion the meeting was adjourned.
