02-11-1936 Regular Meeting MINUTES OF THE METTING OF MIAMI SHORES VILLAGE COUNCIL February 119 1936 The regular monthly meeting of the Miami Shores Village Council was held February 11, 1936 in the Village Office at 7:30 P. M. All members of the Council were present as was the Village Attorney and Clerk. The first matter of business to be taken up was the appointment of members of the Planning Board as set forth In the planning board ordinance, ]mown as Miami Shores Village Ordinance #40, and after due discussion a vote was taken and the following were appointed to serve on said Planning Board, Mr. Julian B. Prix to serve for a term of threp��years; Mr. J. T. Feaster- to serve for a term of two years, and Mr. F. Scott Kitson for a term of k one year. The fact that slot machines were operating in the Village was brought up, and the Village Manager was instructed to collect $60.00 on each machine until further action is taken by the Council. The Village Manager reported on the condition of the nets at the tennis courts, and was instructed to purchase new tennis nets, and to have the property adjoining the tennis courts pre- pared for a Volley ball court and to purchase equilment for same. The plan of the Village Manager• to collect garbage with Village equipment and labor was discussed and it was decided to put this plan into operation on March 1st. Mr. Goll and Mr. Carlisle were appointed along with the Village Attorney and Clerk to confer with the owners of Blocks 59 and 108, Miami Shores, regarding lease on same and to reach an agreement that would justify the Village in going ahead with re- pairs and improvements, also to confer on leases and deeds on the other properties that are being used for Municipal purposes, Upon motion of Mr. Carlisle and. second d e by Mr Lindse ys 40 Miami Shores Village Ordinance No. 41, was passed, a copy of which is attached to and made a part of these minutes. The Village Manager was instructed to close the archway leading into the real estate office next door. BY THE CO IL Y Village Manager and Clerk Mayor . MIAMI SHORES VILLAGE ORDINANCE NO. 41 AN ORDINANCE AMENDING MIAMI SHORES VILLAGE ORDINANCE NO. 5. ENTITLED: "AN ORDINANCE ADOPTING TEMPORARY CODES FOR BUILDING, ELECTRICAL AND PLUMBING WORK, PROVIDING FOR AN INSPECTOR AND REQUIRING PERMITS FOR SUCH WORK", AND BY THIS ORDINANCE PROVIDING FOR THE AMOUNTS FOR BUILDING PERMITS AND PERMITS FOR ELECTRI- CAL, PLUMBING OR OTHER HIGHLY SPECIALIZED WORK, CON- CERNING THE BUILDING, REPAIR OR ALTERATION OF HOUSES AND OTHER STRUCTURES AND BUILDINGS WITHIN THE VILLAGE, AND PROVIDING FOR THE APPOINTMENT AND COMPENSATION OF INSPECTORS FOR ALL SUCH WORK, AND PRO`IIDING FOR COMPENSATION OF DEPUTY INSPECTORS FOR ALL SUCH WORK, AND PROVIDING FOR COMPENSATION OF VILLAGE BUILDING INSPECTOR AND ISSUANCE OF ALL BUILDING PERMITS WITH- IN THE VILLAGE. BE IT ORDAINED BY MIAMI SHORES VILLAGE: SECTION 1. That certain Miami Shores Village Ordinance No. 5, entitled: "Ari Ordinance Adopting Temporary Codes for Building, Electrical and Plumbing Work, Providing for an Inspector and Re- quiring Permits for such Work", be, and the same is hereby amended and changed to be and read as follows: SECTION 2. (a) That Section 2 of said Miami Shores Village Ordinance No. 5, be, and the some is hereby amended: that the total compensation of the Village Building Inspector shall be one-half of the amount of the fees for the issuance of general building per- mits, the remaining one-half thereof to be retained by the Village and deposited in the Treasury thereof. (b) All permits for the erection of buildings, repairs or alterations within Miami Shores Village shall be issued by the Clerk of said Village, subject to the approval and confirmation in writing of said Village Building Inspector as aforesaid, and under such term's and conditions as provided for in said ordinance as aforesaid, or other ordinance of the Village concerning the same. SECTION 3. That Section 3 of said Miami Shores Village Ordinance No. 5 as aforesaid be amended% That the fees for all building permits shall be in the sum of $25.00; that the fees for permits for electrical, plumbing or other highly specialized work shall be in the sum of $10.00 each. The fees for building permits for repairing and alterations upon houses and buildings within the Village shall be in the sum of 6 ; tue fees for repairing of plumbing and electrical work within the Village shall be in the sum of SECTION 4. That the Village Building Inspector is hereby empowered and authorized to appoint deputy inspectors for the pur- pose of inspecting and supervising all electrical: plumbing and other highly specialized and technical work in connection with the erect- ion of buildings or houses, or repair or alteration thereof, or other- wise within the Village, the number thereof and the duties to be per- formed by them to be specified by said Village Building Inspector, and the total conpensation of said deputy inspectors as herein provid- ed, shall be one-half of the fees for the issuance of permits for such work as herein provided, and no other cost or fees shall be paid unto said deputy inspectors, nor shall the Village be obligated or liabel in any manner whatsoever, otherwise than provided herein for the payment of compensation of said deputy inspectors. SECTION 5. That upon appointment of deputy inspectors as herein provided, the Building Inspector shall furnish the names and addresses of the same to the Clerk of the Village, who shall keep a -permanent record of the same and the said Clerk shall set up the necessary books and records for the issuance of licneses, receipt of moneys thereofr, and other matters in connection therewith. SECTION 6. The remaining one-half of the fees collected for the issuance of permits not paid to the deputy inspectors as here- inprovided, shall be retained by the Clerk and deposited into the • Treasury of the Village. SECTION 7, The Building Inspector and all deputy inspectors appointed by him as herein provided and authorized, shall serve at the pleasure of the Council. SECTION S. The Clerk of the Village shall issue permits for all work done upon buildings or houses within the Village, whether for the erection of new houses or buildings, repair or alteration, or otherwise, and for all electrical, plumbing or other highly special- ized work, and receive the fees theron on behalf of the Village, but before the same be issued it shall be the duty of the Building In- spector to approve such permit or permits in writing, and said Clerk shall pay from said fees so collected the amount or amounts to which the Village Building Inspector and the deputy inspectors, and each of them, shall be entitled as herein provided. SECTION 9. All other provisions and conditions of said Miami Shores Village Ordinance No. 50 not altered or changed herein shall remain in full force and effect, including the penalty for the violation of the same which said penalties shall be fully appli- cabel to the provisions as herein contained. SECTION 10. Each word, phrase, sentence or section of this ordinance shall be severable and the invalidity of any word, phrase, sentence or section shall in no way or degree impair any other part or parts thereof. SECTION 11. All ordinances and parts of ordinances in con- flict herewith are hereby repaaled. SECTION 12. That an evergency exists for the protection of the public welfare, life and property, SECTION 13, This ordinance shall be effective immediately upon its passage, Unanimously passed and adopted this 11th day of February, A.
