08-20-1935 Regular Meeting MINUTES OF THE MEETING OF
MIAMI SHORES VILLAGE COUNCIL.
August 20, 1935
Regular monthly meeting of the Miami Shores Village Coun-
cil was held at the village office at 7.30 P. M., on Tuesday
August 20, 1935. A quorum of the council was present.
The minutes of the previous meeting were read and app-
roved after corrections were made,
The question of issuing a permit for the construction
of an acquatic garden in E1 Portal subdivision at 87th Street
and Biscayne Boulevard, was discussed and on motion of Mr.
Lindsey seconded by Mr. Goll it was decided that at least for
the present no such permit should be issued.
Mr. Peach, owner of property in Hamilton Terrace and
Navarro subdivisions, asked for the council's opinion on what
the Village might do in the way of paving streets in these sub-
divisions. The Village Manager wasA to make a survey to deter-
mine the approximate cost for paving such streets and definate
decision on the matter was postponed until the September meeting.
Mr. GodArd,the building inspector, brought up thelquestion

of remodeling the - at 92nd and 2nd Avenue. It
was the unanimous opinion of the council that the issuing
of such permit be ruled entirely by the zoning ordinance and
after proper plans and specifications had been submitted to
the building inspector.
Mr. Cushman representing Seaver and Company, requested
that the council officially revoke plat of the N2 of SWI of
SEI of SE4, section 36-52-41, filed for record on July 18, 1933
on motion of Mr. Goll, seconded by Dr. Cleghorn, the co-anvil
unanimously passed a resolution entitled "RESOLUTION AUTHORIZING
REVOCATION ,OF PLAT RECORDED IN PLAT BOOK 36, PAGE 57 OF THE
PUBLIC REDORDS OF DADE COUNTY, FLORIDA."
The question of changing the zoning ordinance was dis-
cussed and on motion of Mr. Lindsey, seconded by Dr. Cleghorn,
the council unanimously passed "AN ORDINANCE AMENDING SECTION
3.4 OF MIAMI SHORES VILLAGE ORDINANCE # 11, ENTITLED: "AN
ORDINANCE ZONING THE VILLAGE AS TO USES OF LANDS AND BUILDINGS
AND RELATING TO INTERPRETATION AND ENFORCEMENT OF THE ORDINANCE",
BY EXCLUDING CERTAIN PROPERTY FROM SAID ZONEr_AND MAKING SAID
PROPERTY SO EXCLUDED A PART OF AND SUBJECT TO THE RESTRICTIONS
AND PROVISIONS OF ' ZON E 3 AS PROVIDED IN MIAMI SHORES VILLAGE
ORDINANCE # 11 AS AFORESAID.
Mr. R. A. Raymond submitted a proposition in connection
with the establishment of a community and park to include one
club house building and 24 residences, the council discussed this
matter and requested that Mr. Raymond submit his entire proposition
in detail and in writing and also submit plans and specifications
for the entire proposition.
No other matter being presented for discussion the meet-
ing was adjourned.

RESOLUTION AUTHORIZING REVOCATION OF PLAT
RECORDED IN PLAT BOOK 38 PAGE 57 OF THE
PUBLIC RECORDS OF DADE COUNTY, FLORIDA.
WHEREAS, Seaver and Company, a Common Law Trust by
VERNON C. SEAVER, as Trustee , did cause a certain plat to be
made of a subdivision of the N2 of SWj of SEJ of SEJ Section 36,
Township 52 South, Range 41 East, lying and being in Dade
County, Florida, which said plat was dated the 26th day of June ,
1933 and filed for record on July 18, 1933, and recorded in Plat
Book 38, page 57 of the Public Records of Dade County, Florida,
and ,
WHEREAS, in and by the said plat the said Seaver and
Company, a Common Law Trust, by Vernon. C. Seaver, as Trustee,
did dedicate to the perpetual use of the public, for proper
purposes , reserving to the said Seaver and Company, its successors
and assigns, the reversion or reversions thereof, whenever dis-
continued by law, said streets and alleys shown upon the said
plat and by the said plat, and,
WHEREAS, it appears that on the 11th day of October,
1934, the said Seaver and Company, a Common Law Trust, by Vernon
C. Seaver, as Trustee, did cause a certain plat of Beverly Glen
to be filed in the office of the Clerk of the Circuit Court,
same being a re-subdivision of the N1 of the S117j of the SEJ of the
SEJ of Section 36, Township 52 South, Range 41 East, in Dade
County, Florida, and that the said plat of Beverly Glen was duly
approved by the Miami Shores Village Council on the 20th day of
November, 1934, and approved by the County Engineer of Dade
County, Florida, and that the said plat was passed by resolution
of the Board of County Commissioners of Dade County, Florida,
and filed for record on the 18th day of December, 1934, and re-
corded in Plat Book 38, at page 74 of the Public Records of Dade
County, Florida, and,
WHEREAS, it appears that the said plat of Beverly Glen
recorded in Plat Book 38, page 74 of the Public Records of Dade
County, Florida, as aforesaid , is a re-subdivision of the same
plat described in that certain plat dated the 26th day of June ,
1933, filed for record July 18, 1933, and recorded in Plat Book
38, page 57 of the Public Records of Dade County, Florida, and,
NOW THEREFORE, be it resolved by the y:iami Shores
Village Council:
1. That Seaver and Company, a Common Law Trust , be
and it is hereby authorized to revoke, vacate and annul the
dedication for streets and alleys made in and by that certain
plat , dated the 26th day of June_, 1933 , filed for record on July
18, 1933, and recorded in Plat Book 38, page 57 of the Public
Records of Dade County, Florida, and that the said Seaver and
Company, a Common haw Trust, be and it is hereby authorized to
revoke , vacate and forever annul the said plat.
2. That upon filing of a revocation of the said
plat , recorded in Plat Book 38, page 57 , of the Public Records
of Dade County, Florida , by the said Seaver and Company, a Common
Law Trust , that the said plat be and the same shall be forever
regoked, annulled and vacated.
Passed and adopted by the Miami Shores Village Council
on the day of August, 1935.
