07-25-1933 Special Meeting SPECIAL MEETING OF
TAXPAYERS OF
MIAMI SHORES VILLAGE
July 25, 1933.
Upon call of the Mayor, proper legal
notice having been given a meeting of the Village Council and the
citizens and taxpayers of the Village was held on Tuesday Evening,
July 25th at the Community Club House building, 9823 N. E. 4th Avenue•
The members of the council present were Frank 0. Pruitt, Mayor, who
presided over the meeting, and Otto H. Goll and John J. Lindsey.
The Village Clerk and Village Attorney were also present as well as
about fifty of the residents and taxpayers of the Village, including
a few residents in the territory adjacent to the Village.
After the mayor called the meeting to order,
the two newly elected councilmen were introduced to those present.
One of the principal purposes of the meeting
being the approval of a budget for the coming year August 1, 1933
July 31, 1934, a copy of the tentative budget already prepared was
given to each of those present. This tentative budget was gone over
in detail and the Mayor gave a full explanation of each item in the
budget and after this detailed explanation, the meeting was opened
for general discussion. The Mayor then called for any questions on
or objections to the proposed budget and as there were no questions
or objections, final approval of the budget was left to the council
to be given at the budget adjustment board meeting to be held at the
Village offices on Monday July 31st, said meeting to be temporarilly
adjourned to the following day, if necessary.
Tle Mayor then presented the tentative
tax assessment roll for the fiscal period August 1, 1933 to July 31,
1934, and as no questions or objections were raised the Mayor then
• set Monday, July 31st, 1933, as a date for further hearing of objections
to the tentative tax roll and tentative budget, said meeting to be
adjourned temporarilly until the following day if necessary.
The Mayor then explained the question which
had been re.ised at previous council meetings regarding the re-zoning
of that section of the village which includes a part of El Portal
Subdivision, part of Asbury Park Subdivision and part of North Shore
Crest Subdivision, and suggested to those present that any suggestions
or criticisms on this question would be gladly received by the Council.
The meeting was then turned over to a
general discussion and the question aro se as to what action might be
taken to eliminate the disturbance and nuisance of the Tropical
Jungle Beer Garden located at 87th Street and Biscayne Boulevard
just south of the south .line of Miami Shores Village . A considerable
number of those present stated their complaints. After considerable
discussion and upon advice of legal council present it wad decided that
Miami Shores Village as a municipality could not take legal action in
the matter, but that the citizens themselves of the community might
organize as a body and upon proper petition take action. Therefore,
upon motion of Dr. Roy J. Holmes, duly seconded,: the. folld�rving
resolution was passed:- "That we, as a group of tax payers and citizens
• organized together and through legal advisors, immediately take whatever
legal steps are necessary to declare the Tropical Jungle Beer Garden
a nuisance, and that in the event that such decision is rendered by
the courts, that the doors of the Tropi cal' Jungle Beer Garden be closed
unless such nuisance be discontinued and that the signatures of
twelve ( 12) individuals living in the vicinity of said Tropical
Jungle Beer Garden be regarded as sufficient evidence that a nuisance
exists, which thay shall be expected to correct.
There being no further matters presented
for discussion, upon motion, duly seconded the meeting was temporarilly
adjourned to re-convene on Monday Evening, July 31st, 1933.
