i i i i j i i I i L�YU.. OF A METING OF COUNCIL. QF MUW SSOUS VUJAM 0 .January Us 1932. Pursuant to adjournment at the last meeting, the Counoil met at the Village Offioes at 7:30 otolook, F. Y& on January 14, 19320 there being present: Mayor Frank 0. Pruitt, Councilmen Hugh H• Gordons Jr. r W. F: Andes, John Y• Carlisle, M• R. Harrison., being all of the Counoil , Miller Williams , Village Manager, and George Edward Holt , Village Attorney. The mayor oa-lled the meeting to order and upon motion duly made and parried , the reading of the minutes of the last meeting was dispensed with, to be taken up at the . neat meeting. James A. Dixon, a resident of Fl. Portals a sub- s division adjoining the Village on the south, appeared before • the Counoil stating that he represented a number of residents and property. owners in 11 Portal,who desired the Village- to extend its limits and annex the territory between Eighty Seventh Street and Ninety First Streeti Mr. Dixon informed the Counoil that there are forty houses in the territory re- presented by him, of whioh thirty are oocupied.; that the sani- i tart' problem, particularly the collection of garbage , is i becoming an acute problem to the residents of the said territory and he proposed that such territory be annexed, _ the best boundary thereof to be affixed at Miami Avenue. Mr. -Dixon stated that only one Mr, Posey and Mrs. Finch , j of the property owners in said territory ,had any objections to being taken in. The Council agreed that before action could proper- ly be taken on this question, a comprehensive survey of the matters affecting the question should be made ,. particularly i the amount of the. taxes assessed and the ratio of tax col- lections, the number of fires annually, and the extent of municipal facilities and conveniences needed , such as lights , I water, garbage collection, together with a report of the con- dition of the streets and sidewalks and probable cost of main- taining or improving same , and Mr. Dixon was thereupon in- formed that it would be necessary. for such survey to be fur- nished the Council in order for his request to be given fur- ther consideration, and he stated that such a survey would be made and presented in the vary near future. Upon motion duly made, seconded and .unanimously passed, the Council decided to pay Mr. Miller Williams Three I i . Hundred ($300.00) Dollars for his full month's salary for January and to inform Mr. Williams ,, which was thereupon done , that the Village felt such payment proper,in view of the inconvenience and expense to which he had been put , whether he remained in the service of the Village until February lst or not , and that he should feel free to leave the service of the Village immediately, or as soon as another manager be appointed by the Council , if he so de- sizes. Bir. Williams informed the Council that other matters demanding his attention made it convenient for him to leave immediately. Both Mr. Williams and the mayor and various members of the Council again expressed their mutual regards and regrets at terminating the association between them. Upon motion duly made , seconded and unanimously carried, it was decided by the Council to appoint immediately i a. successor to Mr. Williams for the title of Village Manager , who should be also Clerk of the Village , Tax Assessor and Collector, village Fudge and Ex-officio Clerk of the Village i Court at a salary of Two Hundred ($200.00) Dollars per month, with the understanding that he would do the stenographic and other work of the office and employ no clerk or assistants. Upon consideration of applications for a successor to Mr. i William , Councilman John M. Carlisle , nominated Mr. i I I I i Mr. Airy , former Clerk of the Town of South Miami and stated that after a thorough investigation of this gentle- . man he could recommend him-unqualifiedly as an honest , oon i; soientious and able clerk for the Village and that he deemed him particularly well qualified in view of his several years experience in handling municipal affairs. Councilman Wi. F. Andes nominated John L, Caruthers , the nomination being second- ed by Hugh-H.. Gordon, Jr. , and after some discussion on vote being taken, the vote was for John L. Caruthers-- Hugh H. Gordon, W. F. Andes and M. R. Harrison (3) and for Mr. Airy John M. Carlisle (1).. I Thereupon the mayor declared John L. - Carathers had been duly appointed and elected Village.Manager, Clerk, Tax Assessor and Collector, 'Village Judge and Ix-officio Clerk .of the Village Court ,. with the same powers and duties as Mr. Williams had under the charter and ordinances and in- structions of the Council heretofore given- -at a salary--of Tiro Hundred ($200.00) Dollars per month. Mr. George Edward Holt , Village Attorney, report- ed to the Counoil that the Circuit Court had denied the ap- plication of Biscayne Kennel Club , Inc. for a temporary . injunction or restraining order against the enforcement of Ordinance No. 2 0,T collection of license tax thereunder, and that an appointment had been made by him and the mayor with attorneys and officers of the Biscayne Kennel Club for the next morning to receive payment of the license tax and issue license for the operation of their dog tra©k. On motion duly made , seconded and carried it was decided that no reduction should be made in the tax imposed by said ordinance for the reason that the Council deemed the same reasonable. The Tillage attorney also gave as his opinion to the Council that a budget should be adopted for the fractional fiscal year January 2nd to July 31st inclusive , 1932, and notice given and hearing of objections had thereon as the charter requires of budgets for full fiscal years but 1 j that unless there were. some pressing , practical reason therefor it was unnecessary at this time to adopt a bud- get for the fiscal year August 1 , 1932 to July 1 , 1933 • or .tax assessment roll for 1932 , which could be done nearer the commencement of such fiscal year. I ; i I • Thereupon, on motion duly made , seconded and unanimously carried , it was decided to follow the procedure suggested by the Village Attorney, and Mr. John.M. Carlisle proposed the enactment of an ordinance to be known as Ordinance No. 4 and entitled n AN ORDINANCE Fixing the Man- ner of Giving Notice of Hearings on the Budget and Tax As- sessment Roll" and the same being duly seconded, upon vote thereon, the ordinance was unanimously passed, the original thereof being signed by the Mayor and Village Manager in the presence of the Council, and ordered published and recorded. January 25.9 1932 at- the New ttheNew Miami Shores Elementary School in .the Village and i the form of notice of such meeting preparedg the Village Attorney was approved, and the manager instructed -to publish the same immediately and al.s o to give notice by mailing to the resident freeholders of the Village. Upon -motion duly made , seconded and unanimously oarried, the form of letterheads of the Village was approved and the manager authorized to purchase and have printed not exceeding One -Thousand (1000) letterheads with envelopes there- for., I . John L. Caruthers being notified by telephone , -----came before the ©ounoil and took and subscribed his oath--as - Village Judge and was installed as Village Manager, Clark, . .Tax lasessor, Gollee_tor, Village Judge and Ex-officio Clerk of the Village Oourt , . and Mr. ,Miller Williams thereupon de livered to John L. Carothers the Village Seal -and all books , ? in his ha,nds ,as his last official act records and accounts , except signing these minutes. There being no further business $ the -®ouncil • adjourned. , Village Manager and Clerk APPROW by the o 0 BY: cuKi Mayor G i. RRCORD OF FREEHOLDERS I MEETING HELD JANUARY 960 1932 at 7:30 P.M. AT NEW MIAMI SHORES ELEMENTARY SCHOOL Pursuant to legal notice published in The Miami Daily News of January 15th, 1932 which read: • "Notice is hereby given that the Council of Miami Shores Village will hear objections to the tentative budget for the fractional fiscal year of 1932, at the New Miami Shores Elementary School, 10351 Northeast Fifth Ave- nue, at 7:30 P. M, o'clock, on Monday January 25th 1932. "B7 authority of the Council, January 14, 1932: Frank 0; Pruitt -J. L. Carothers As Mayor of the Village As Village Manager and Clerk " and also pursuant to written notices sent through the mails to all the property owners of the Village known to the Village Clerk, the said meeting was held as called, the Mayor, Mr; Pruitt taking charge: The mayor explained that no tax monies would be received by the Village until the end of 1932 and that until that time the Village would be operating on borrowed capital and that the tentative budget about to be presented to the meeting had been made up on as conservative a basis as possible, The tentative budget, which had been approved by the Village council at its previous meeting held at the Village Offices but subject to the hearing of objections of the freeholders, was then read item by item by the Mayor and each item was explained in detail. During the discussion of "Lighting" one property owner suggested that if a street light were placed at N. E. 5th Avenue and 93rd Street seven homes would benefit- by it: Another property owner made a suggestion that an inspection of the assessment values of the properties included in the Village on the old City of Miami tax rolls be made to ascertain if all the assessment values of the various properties were equitable and if some adjustment could be made favorable to the property owners, Another property owner . suggested that electricity rates under the old City of Miami Franchise were very high and that when Village came to prepare a franchise with the Florida Power & Light Co, that the tax payers have a voice in making its terms. Further suggestions were made regarding the ownership of the light standards in the Village and that the Village Manager find out the status of this owner- ship; that under the City of Miami government the home owners and tenants were paying a surcharge amounting to 50% of the actual water charges and that this be eliminated if possible in the case of the Village; and that the Village Manager ascertain the possibilities and cost of artificial gas for the Village. The meeting was attended by about fifty men and women of the village and their numbers and interest in the meeting was very gratifying. Mr. J. T, Feaster of 540 N*' E. 96th Street, a- rose to compliment the Magor and members of the Council on their efforts and that he wished to make a motion that the budget as presented be accepted and approved. Other members of the meeting also expressed their approval after which the meeting was i adjourned by the Mayor and the Members of the council adjourned to the Village offices for the .`fftah meeting of the Council since its installation:, • i
