It is our position there have been multiple breaches of these contracts by One Hour. Accordingly, this letter serves to advise that a new AC contractor has been retained to complete the work One Hour has failed to perform. Dr. Roy contracted with One Hour on September 26, 2014, for the purchase and complete installation of an Amana/Goodman AC Unit for the second floor of the Roy residence. The amount of the contract, $11,220.00, has been paid in full. While the unit has been diagnosed and had replacement parts installed by Goodman Manufacturer, there nevertheless remains an issue with the functionality of the AC unit as installed by One Hour during the warranty period. . r In the meantime, on or about March 20, 2015, Dr. Roy contracted with One Hour for the purchase and complete installation of two additional Amana AC units. Because the initial permit for the first unit had lapsed, The Village of Miami Shores combined all three units under one permit. Notably, One Hour failed two "rough-in" inspections. The permit remains open. The AC handler that was installed on the second floor of the Roy residence (contract dated 9/26/14) has had ongoing issues since its installation and ceased operating in the early hours of August 11, 2015. One Hour was called out no less than nine times to determine the cause of the problem. The only "fix" provided was to reset and start-up the unit. Not once did One Hour service personnel diagnose, repair or replace the malfunctioning part under the existing Amana/Goodman warranty. The last attempt to repair the second floor unit occurred on August 14, 2015. Since that date, Dr. Roy repeatedly attempted to contact Mr. Torroja by phone and by email. Mr. Torroja finally responded the evening of August 14 after the Roys had spent several nights at a hotel. He promised to have the issues resolved to Dr. Roy's satisfaction and to call Dr. Roy on Wednesday August 19. After not hearing back from Mr. Torroja despite his promises to fix the issues, Dr. Roy contacted One Hour on August 21, and was advised that Mr. Torroja was no longer running the company and there was no one available to solve the problem because the company was going through a reorganization. Between August 21 and September 17, 2015, Dr. Roy repeatedly called and left phone messages for whomever was running One Hour that the AC unit in the second floor continued to shut-off in the middle of the night. In the meantime, no one from One Hour was working on the installation of the additional two units. Finally, on September 17, 2015, Dr. Roy received a voice mail message from "Kevin" at One Hour, requesting to meet with Dr. Roy in order to introduce the "new guy" they hired who will "definitely take care of your [Dr.Roy] situation". On Tuesday, September 22, 2015, "Kevin" and Chris Reynolds met with Dr. Roy at his residence and assured him that all would be taken care of and that Mr. Reynolds would be at the residence the next morning. Mr Reynolds did not appear the next morning but rather at the end of the day. Noting he had no tools with him, he promised to return "first thing next morning". Mr. Reynolds did not appear the next morning nor has Dr. Roy heard from any representative from One Hour since September 23, 2015. Not only has One Hour failed to remedy the malfunctioning AC handler covered under the first contract and under warranty. Furthermore, it has abandoned the second contract altogether. The Roy residence is left without the completed additional AC units and an open permit without so much as an approved "rough-in" inspection. Dr. Roy has no choice but to consider these contracts in breach and abandoned. He has contracted with another AC contractor to repair the second floor AC unit and to complete the installation of the additional two AC units. Mindful of the FEMA limitations on renovation, I hired William Griffith SRA of Appraisal First to reappraise the structure. His $650,000 depreciated building cost appraisal has been included in our building permit application file. Victor Bruce AIA, our architect, then hired Jose Valderrama to provide an estimate for renovation work to my home based on an initial plan you discussed in concept form with us in November, 2014. That plan called for raising the roof on the one story west end of the home by raising the walls and replacing the flat roof with scissor trusses and a new tile roof. Mr. Valderrama came up with an estimate of$217,638. This did not include a separate permit already issued for impact window replacement by Alpha Windows totaling $40,000 or the emergency replacement of the second floor HVAC unit and ducts by One Hour Air for$11,200. Because of the long delays in obtaining the initial estimates and developing the mechanical, plumbing and electrical portions of the plan, the project languished for months. As a result my wife and I decided that renovating the kitchen would be a higher priority than making the roof improvements on the one story end. We had the architect and his subcontractors make the necessary changes in the plans which were submitted to your office early last week, again after inordinately long delays in the drafting process. During this delay but based on the drawing pdfs, I was able to get my plumbing and electrical permits for the work based on their proposals which are attached. My HVAC, septic system and masonry/cement contractors have also produced proposals, attached, for their work. As a result the following items in Mr. Vaiderrama's initial estimate have been deleted or modified based on specific subcontractor proposals for a different amount. These deductions total $91,473. The current revision set includes new items totaling an additional $81,350. Other renovations which I understand are not subject to the FEMA budget inclusion are pool renovations, new patio, new walkway, new fence and new landscaping, none of which are attached to the structure itself. 2 My electrical contractor is including a transfer switch on the new panels in preparation for a future natural gas generator. Is a whole house generator considered a FEMA budget item? Despite my many years of experience doing over thirty new construction and renovation projects throughout the U.S. as an owner/contractor I have found the renovation process as an owner/contractor to be extraordinarily frustrating here in Miami Shores Village and have today filed a change of contractor revision with the Village naming DVG Builders, Inc.
