Do hereby petition the Village of Miami Shores to act as my own contractor pursuant to the laws of the State of Florida,F.S 489.103(7).And I have
read and understood the following disclosure statement,which entitles me to work as my own contractor,I further understand that I as the owner
must appear in person to complete all applications.
State Law requires construction to be done by a licensed contractor.You have applied for a permit under an exception to the law.The exemption
allows you,as the owner of your property,to act as your own contractor even though you do not have a license.You must supervise the
construction yourself.You may build or improve a one-family or two-family residence.You may also build or improve a commercial building at a
cost of$25,000.00 or less(The new form states 75,000).The building must be for your own use and occupancy.It may not be built for sale or
lease.if you sell of lease a building you have built yourself within one year after the construction is complete,the law,will presume that you built
for sale or lease,which is a violation of this exemption.You may not hire an unlicensed person as a contractor.it is your responsibility to make
sure the people employed by you have licenses required by state law and by county or municipal licensing ordinances.Any person working on
your building who is not licensed must work under your supervision and must be employed by you,which means that you must deduct F.I.C.A and
with-holdings tax and provide workers'compensation for that employee,all as prescribed by law.Your construction must comply with all
applicable laws,ordinances,buildings codes and zoning regulations.

Awnings and canopies shall be designed and constructed to withstand wind or other
lateral loads and live loads as required by Chapter 16 and in accordance with
Section 3105.4 of this code with due allowance for shape, open construction and
similar features that relieve the pressures or loads. Structural members shall be
protected to prevent deterioration. Awnings shall have frames of noncombustible
material, fire-retardant-treatedwood, wood of Type IV size, or 1-hour construction
with combustible or noncombustible covers and shall be either fixed, retractable,
folding or collapsible.
3105.3.1 Location.

Fabric awnings and fabric-covered frames located over public property or in areas
accessible to the general public shall be constructed so that no rigid part of such
fabric awnings or fabric-covered frames shall be less than 7 feet 6 inches (2286 mm)
from the grade directly below, and no part of the cloth drop shall be less than 7 feet
(2134 mm).

A fixed fabric awning or fabric-covered frame shall not extend over public property
more than two-thirds the distance from the property line to the nearest curb line in
front of the building site as measured from the exterior face of the building, nor shall
any portion be closer than 18 inches (457 mm) to the curb line.

Having looked at the code,right below 3105.3.3.1 flame resistance is the Exception: "Awnings or fabric-
covered frames used in conjunction with group R-3 occupancies." Ours being a single-family home with
permanent occupancy,don't we fall in group R-3,and shouldn't our awning fabric therefore be exempt
from section 3105.3.3.1 flame resistance standards?

Mr.Naranjo,
I called you yesterday and left a message,but haven't heard back. I am trying to get clarification on the
requirement the Shores has for a Certificate of Flame Resistance in order to issue a permit for new or
replacement awnings. I am trying to learn what the standards are for Flame Resistance,and where the
requirement for that Certification is codified in Village,County,or State regulations. I have been unable to find
such a requirement nor the flame resistance standards awning fabric is supposed to meet for residential awnings,
and the staff at Village Hall were unable to answer my questions and referred me to you.
Specifically,one of the best known brands, Sunbrella,makes fabric that meets or exceeds California Flame
Retardant Bulletin#117. Is that sufficient for a vendor to issue a certificate? Or is there an NFPA standard
above that that needs to be met? Sunbrella and a few—very few--other brands also make awning fabric that is
specifically advertised as flame resistant,but they are described as being for commercial use,not residential,
and there is little that would meet the requirements for appropriateness for our Historically Designated home.
I would appreciate getting clarification on this requirement so that I may proceed with requesting a permit to
replace the awning fabric at our home.
