Board of Rules and Appeals, I am requesting to appear before the Board of Rules and Appeals to appeal the ruling by the Miami Shores Building Official to install hard wired smoke and carbon monoxide monitors as a permit requirement to remodel the bathroom in my home. The work consisted of replacing the toilet, sink, shower, cabinet and tile. There was no new construction or increase in any square footage of the room or the house requested by this permit. When it came to a final inspection, I was informed that the permit cannot be closed out for the reason stated above. The house is equipped with battery operated smoke detectors. Based op the scope of Work depicted on the plans,your project constitutes a level 2 alteration as define under the 2010, Florida Building Code, Existing Building. Based on the approved plans and my interpretation of the code sections reflected below,smoke alarms and carbon monoxide alarms should be installed,in the locations shown on the Approved plans. Florida Building Code,Existing Buildings. Section 404.1 Scope. Level 2 alteration include the reconfiguration of space,the addition or elimination of any door or window,the reconfiguration or extension of any system,or the installation of any additional equipment. Section 404.2 Applicability. Level 2 alterations shall comply with the provisions of chapter 6 for level 1 alterations as well as the provisions of chapter 7. Section 701.3 Comoliance. All new construction elements,components,systems and spaces shall comply with the requirements of Florida Building Code, Building Florida Building Code, Building Section 101.2 Scope. The provisions of this code shall apply to the construction,alteration, movement, enlargement, replacement, repair,equipment,use and occupancy, location,maintenance, removal and demolition of every building or structure or any appurtenances connected or attached to such building or structure. Exception: 1. Detached one and two family dwellings and multiple single family dwellings(townhouses)not more than three stories above grade plane in height with separate means of egress and their accessory structures shall comply with the Florida Building Code, Residential Florida Building Code,Residential R314.3.1 Alterations,repairs and additions. When alterations, repairs or additions requiring a permit occur,or when one or more sleeping rooms are added or created in existing dwellings,the individual dwelling unit shall be equipped with smoke alarms located as required for new dwellings. Exceptions: 1. Work involving the exterior surfaces of dwellings,such as the replacement of roofing or siding, or the addition or replacement of windows or doors, or the addition of a porch or deck,are exempt from the requirements of this section. 2. Installation,alteration or repairs of plumbing or mechanical systems are exempt from the requirements of this section. R314.4 Power source. Smoke alarms shall receive their primary power from the building wiring when such wiring is served from a commercial source,and when primary power is interrupted,shall receive power from a battery.Wiring shall be permanent and without a disconnecting switch other than those required for overcurrent protection.Smoke alarms shall be interconnected. Exceptions: 1. Smoke alarms shall be permitted to be battery operated when installed in buildings without commercial power. 2. Interconnection and hard-wiring of smoke alarms in existing areas shall not be required where the alterations or repairs do not result in the removal of interior wall or ceiling finishes exposing the structure, unless there is an attic,crawl space or basement available which could provide access for hard wiring and interconnection without the removal of interior finishes.
