An existing bathroom will be removed and the existing laundry in the garage relocated within the garage. The remodeled garage area is accessible from the residence and has an entry from the kitchen with no exterior doors. The garage door will be removed and replaced with windows. The applicant proposes to install a new driveway and parking pad at the front of the residence for the required second parking space. Analysis The remodeling is consistent with the design of the existing residence. The applicant proposes to cut back the driveway 5 feet of the residence. The residence was constructed approximately 20 feet from the front property line. The original plans were drawn with a 20 ft. front yard setback and there is a notation that the setback is 25 ft. or the median of the existing setbacks on the block. r The code language is provided below and states that the minimum setback is 25 feet, it may be greater if the neighboring properties have greater setbacks. No provision would have allowed the 20 ft. setback that was actually provided. The applicant has an existing 28 ft. wide and 20 ft. long driveway in front. Cutting the driveway back 5 ft. from the residence would leave a 28 ft. wide and 15 ft. long driveway in front. This does not provided the depth necessary to park a vehicle on the plot. With a normal 25 ft. setback as required, cutting a driveway back 5 ft. from the residence would still leave a 20 ft. long driveway that would be of sufficient length to park a vehicle. Zoning Code Schedule of Regulations Front Yard R Districts For dwellings: Equivalent to the median of the depths of existing front yards in the same block and lying within a distance of 900 ft. on each side, but not less than 25 ft. or necessarily greater than 35 ft.; or 25 ft. if not more than one building exists within said 900 ft. on each side. The applicant asks to leave the remainder of the 28 ft. wide driveway in place and to connect it to a 94 ft. circular driveway. The applicant is proposing a circular driveway to provide the 2 necessary on-site parking spaces.
