Fla. Stat. § 440.05 i allows corporate officers in the construction industry to exempt themselves from this requirement for any construction project prior to obtaining a building permit. Pursuant to the Florida Division of Workers'Compensation Employer Facts Brochure: An employer in the construction industry who employs one or more part-time or full-time employees, including the owner, must obtain workers' compensation coverage. Corporate officers or members of a limited liability company (LLC) in the construction industry may elect to be exempt if: 1. The officer owns at least 10 percent of the stock of the corporation,or in the case of an LLC,a statement attesting to the minimum 10 percent ownership; 2. The officer is listed as an officer of the corporation in the records of the Florida Department of State,Division of Corporations;and 3. The corporation is registered and listed as active with the Florida Department of State,Division of Corporations. Construction exemptions are valid for a period of two years or until a voluntary revocation is filed or the exemption is revoked by the Division. Your contractor is requesting a permit under this workers' compensation exemption. In these circumstances,Miami Shores Village does not require verification of workers'compensation insurance coverage from the contractor's company. Therefore, you may be personally liable for the worker compensation iniuries of M person allowed to work under this permit Please check with your insurance carrier since most property insurance policies DO NOT cover this type of liability. We started this project January 2014 and have had many setbacks including Matt's financing and also numerous sub-contractor issues. Because of these setbacks Matt and Primal Fit Miami has been forced to require not one but two extensions with their existing SBA loan. The lost time Primal Fit Miami has accrued has forced them into paying two rents, one in their existing location and one in the location where construction has been under way. We have been rushing to finish this project for obvious reasons but primarily because of an existing SBA deadline (missed one in Oct.and another July 1St) and also because of Matt's current location has been leased and he needed to vacate the unit as of June 29 2015. To this date we have passed final Electrical and final Mechanical with a pending Plumbing and Fire which is scheduled for today July,2nd 2015. We had hoped passing all finals by Friday,July 3rd and being open to service his members on Monday July, 6th;however,given the impending holiday weekend and the fact that were are down to the wire with our pending inspections,we would like to request a TCO for 15-30 days so that Matt can serve his members come Monday,July 6th,in the event we run into any issues with the plumbing inspection. We do feel confident that we will pass fire inspection given that we were able to remedy fire's main concern and requests last week We hereby hold harmless and release Miami Shores Village Building Department and Miami-Dade Fire Department from any liability that may arise during the use of the designated areas in the aforementioned facility while under the limitation of the Temporary Certificate of Occupancy. We hereby certify that all means of egress shall be kept clear and accessible and that all life safety systems will be maintained and operable at all times while the building is occupied. Please contact Matt Pack at 305-951-6648 for any further questions. Sincerely, Felix Mesa Jr. Aquarius Building, Inc. We startedthis project January 2014 and have had many setbacks including Matt's financing and also numerous sub-contractor issues. To this date we have passed final Electrical and final Mechanical with a pending Plumbing and Fire which is scheduled for today July, 2nd 2015. Matt Pack Primal Fit Miami _. ,..
