Notice to Owner- Workers' Compensation Insurance Exemption
Florida Law requires Workers' Compensation insurance coverage under Chapter 440 of the Florida Statutes. Fla. Stat t 4-:6 C5
allows corporate officers in the construction industry to exempt themselves from this requirement for any construction
prior to obtaining a building permit. Pursuant to the Florida Division of Workers'Compensation Employer Facts Brochure:
An employer in the construction industry who employs one or more part-time or full-time
employees, including the owner, must obtain workers' compensation coverage. Corporate
officers or members of a limited liability company (LLC) in the construction industry may
elect to be exempt if.
1. The officer oa^ns at least 10 percent of the stock of the corporation,or in the case
of an LI_C,a statement attesting to the minimum 10 percent ownership,

(1)ACCEPTANCE OF THIS PROPOSAL Upon acceptance,this proposal shall become a contract binding upon both the Buyer and Seller and shall be
constructed to the laws of the State of Florida.In the event that this proposal is not accepted any payments made by buyer will be returned.
(2)COMMENCING PERFORMANCE.Alter acceptance as provided,the Seller shall be given a reasonable time in which to make delivery of materials andlor
to labor to commercial,the performance of the contract.
(3)EXCEPTED LIABILITY.The Seller shall not be responsible for damaqes or delays either before commencement of or during the said work described herein
on account of transportation difficulties,priorities,war,strikes,accidents,acts of God,fire,sudden rains.stones,winctstorms,or any other casualty or that of
other causes beyond its control.
(4)INSURANCE.The Seller shall comply with all laws relating to Workman's Compensation in the state of Florida and shall carry public liability and property
damage standard form insurance.Insuring during the progress of the work any liability which may be imposed by law upon the Seller on account of an accident
arising from such operations.
(5)WORKING CONDITIONS.The Sellers employees shall not be required to work in hazardous conditions,(such as on freshly painted areas,in Gose
proximity to uninsulated power lines,in noxious fumes,In unusually intense heat from or where traveling cranes may strike their scaffolds),and the Buyer
agrees to give the Seller's employee all reasonable cooperation to mitigate such conditions.
(6)DAMAGE TO SELLER'S WORK.The Buyer shall underwrite in behalf of the Seller the cost of any damage to Seller's work caused by the Buyer,his
agents,and/or contractors or sub-contractors.And in the event such damages occur the same shall by repaired by the Seller,and the Buyer shall reimburse or
cause to be reimbursed to the Seller for the same on the basis of cost,labor,materials and expenses plus 30%ofthe total for overhead and profit.Such
payment shall be made on the tenth of the month following receipt of such statement from the Seller.Buyer shall assume the risk of loss or damage resulting
from the,theft,misuse,wind.flood,or from any other cause to materials delivered upon the premises or installed by Seller and Buyer shall reimburse Seller
upon demand for any such loss or damaqe.
(7)CHANGES AND/OR ALTERATIONS.In the event there are any changes in the drawing and/or specifications from those agreed upon in this agreement or
if there is any departure in construction from said drawings,then it shall become the duty of both the Buyer and the Seller,before proceeding with the affected
work to compute tho addtional cost or credit for such changes,and thereby agree upon the sum to be added to the amount.
(8)CANCELLATION.This agreement may be cancelled either before or after commencement of the work by the mutual agreement of both parties herein,and
in such an event the Buyer shall settle with the Seller as provided in paragraph 9.
(9)COMPLETION AND ACCEPTANCE.Upon completion the buyer shall immediately inspect Seller's work and issue an acceptance to the Seller provided the
work has been completed according to the terms of the working contract and full settlement shall be made in accordance with this agreement.A full and
complete acceptance of the work shall be presumed upon the Buyer making final settlement.
(10)LITIGATION.In the event of any liligation to enforce the terms of this contract the prevailing party shall be entitled to be reimbursed for ail costs and
reasonable attorney's fees including those in incurred in appellate review.
(11)MODIFICATION.This contract may not be modified or terminated except in writing or signed by all parties herein.Any attempted waiver of any of the
terms of this contract shail not be valid unless in writing and signed by both parties.
(12)ENTIRE AGREEMENT.This contract,including any exhibits and riders attached sets forth the entire agreement between Buyer and Seller and contains
all of the covenants.premises,agreements,representations,conditions.and understandings.Typewritten or handwritten provisions inserted in this contractor
attached to them in exhibits or Riders and signed by both parties shall control all printed provisions in conflict therewith.No statement implied or expressed
representation or agreement,written or verbal,not appearing upon the face of this contract shall be binding upon the parties hereto.
(13)LATE PAYMENT.Al sums not paid as due shall bear interest at the maximum rate allowed by law until payment is received.Contractor will retain title until
full payment of obligation of indebtedness is met.Purchaser whose name appears on this agreement personally guarantees payment of this contract.
RIGHTS,RESPONSIBILITIES,AND DISCLAIMERS.
(A)Contractor shall not be responsible for any fault due to cracks,discoloration or hydrostatic pressure.
(B)In the event any tiles are broken,Seller shall only be responsible for its best effort in matching and installing said tile.
(C)Buyer must make al!payments required herein.Surface defects requiring touch up or repairs shail be covered as warranty work,and shall in no way affect the payment
schedule.Payrment held due to to touch up or repair work will]be considered in default.Furthermore,no warranty will be performed unless customer has paid full amount
of the contract price to Driveways by Design.
(D)Buyer shall be soleiy responsible for any footprints and marks created by vehicles,bicycles.pets,animals and persons prior to hardening of the sealer and/or cement
and concrete.
(E)Due to conditions beyond Seller's control concrete will not be changed or modified once it has hardened.Any additional leveling or straightening will be charged extra
and must be noted at the top of this contract.
(F)Seller is not responsible for cold joints in installation due to rain,temperature,starting and stopping of work,or act of God.
(G)In the event that holes are drilled they are drilled at the Buyer's risk.Buyer assumes all liability for damages to pools,pipes and electrical systems.
(H)Buyer hereby acknowledge and accepts that if any sprinkler lines,water lines,electrical lines,or cables lines are damaged Driveways by Design will not be held
responsible.
(1)Buyer is responsible for all non stationary objects in areas which work is to be done.
(J)Buyer hereby acknowledges and accepts the fact that product to be installed may vary in color from that displayed on samples and can vary by batch.
(K)The Buyer acknowledges that when Seller cleans,seats,or patches an existing instai]ation there is no warranty as to the result of the work.
(L)Seller does not warrant the sub-surface or any otner item which he did not install and which he has no control over.Since Seller has no control over future traffic.sun
exposure or use,Seller can not guarantee the shine and coloration of the surlace.
(M)Seller's Warranty is limited to the examination and repair of faulty installations caused by defects in material and workmanship to the full dolllar value if proven
defective.Written notice must be given within one year of substantial completion,This warranty is limited solely to the repair value.No other express warranty or guarantee
is given.
(N)Seller makes no warranted.guarantees,nor shall Seller be liable for any further work after the work is completed and accepted by Buyer,except as may be provided in
this agreement by a reference to specifications covering the proposed work or as may provided specifically in this agreement.The liability'of the seller shall be limited to the
terms and provisions of this agreement and confined to the work actually done hereunder,in no event shalt such a guarantee impose upon the Seller any liability for
damages caused by fire.tomado,hail,hurricane and/or other extraordinary cause beyond Seller's control,nor damage to the building upon or in which said work is done;
nor for any damage to said work.caused by setlement,warping,distortion of said buildinq.It is further agreed that in the event the Buyer upon final settlement to the Seller
fails or neglects to require such a guarantee in writing as may have been anticipated by the parties hereof,the same shall be construed as.a waiver by the Buyer of all
rights under the predicted guarantee.
