PROBATE
EMPLOYMENT AND FEE AGREEMENT
THIS AGREEMENT, executed this day of 6/2/2015, between MARRERO,
TRIVEDI, CHAMIZO LAW, LP, hereinafter referred to as "attorney" and IBRAHIM
RODRIGUEZ, the person who has or will be petitioning for appointment as Personal
Representative of the Estate of ISABEL V RODRIGUEZ, LUIS I RODRIGUEZ
("Deceased"), hereinafter referred to as "client".
In consideration of the services agreed to be performed by the attorney and the fees to be
paid by the client, the parties agree as follows:
1. The client retains the attorney to probate the Estate of the Deceased, and to advise
and assist the client in causing all necessary and proper actions to be taken for the purpose of
fixing and paying any and all Federal and State Estate Taxes; collecting all assets of the estate;
paying of all debts of the deceased; distribution of the assets that may then remain among those
entitled thereto; advising the Personal Representative in the preparation of a complete accounting
for the funds handled by the Personal Representative of such estate; doing of all acts and things
necessary for the full and complete administration and settlement of the estate of the said
decedent as required by law and by rules of Court.
1. The attorney accepts such employment and agrees to render and perform all legal
services and furnish all advice on the matters to the extent relevant to this estate.
2. The client hereby agrees to pay the attorney as compensation for the services to be
performed as herein set forth: $1,500.00 for attorney's fees and filing fees subject to the
limitations set forth below. In addition to the fee for services, the client shall pay the attorney,
upon request, all sums in the nature of costs which the attorney has paid or will be required to
pay during the administration of the estate and these sums shall not be a part of the fee herein
agreed to be paid, but shall be in addition thereto.
3. The client agrees to deposit the sum of $1,500.00 on 6/2/2015 with the attorneys,
as a retainer and cost deposit before any work is commenced by the attorney. The client agrees to
pay the remainder of the deposit for the amount of $1,500.00 on 6/2/2015.
4. The fee quoted in paragraph 2 hereof shall include all normal and usual services
required or to be required in administration. It does not include representation of the estate in the
following matters, which, if required will be billed separately:
a. Appearance before zoning boards or other administrative bodies or boards.
b. Complicated, extensive or unusual procedures required in rendering
services agreed to be performed.
C. Extraordinary services.
d. Defense of the estate tax return in IRS audit proceedings.
e. Sale or lease of real property.
f. Will contest, will construction, challenge to or attempted removal of the
personal representative, contested or adversary proceedings, creditor's
suits or disputes, beneficiary objections requiring court appearance,
objection to accounting or personal representative fees or other litigation.
g. Transferring, collecting or dealing with assets not subject to probate.
h. Consultation with an accountant regarding necessity of filing Federal or
State Estate Tax Returns or the preparation of such returns.
i. Representation in guardianship proceedings in connection with the heirs of
the estate.
The fee quoted above does not include an allowance for the items shown on the foregoing
schedule because these matters are not common to all estates and may or may not be required in
this estate. It would be unreasonable therefore to agree in advance to pay a fee for these services,
or for any of them, if they were not required. Items (a) through (d) and (g), if required, will be
charged separately on professional time expended at standard rates. Items (e), (f), (h) and (i), if
required, will be charged on a negotiated fee basis acceptable to the client.
5. If probate is required in any other state this will be performed by a lawyer in such
other state and any legal services required in coordinating such ancillary probate or in searching
for, dealing with, or obtaining assets in other states or countries will be charged at standard time
rates. Preparation of income and estate tax returns will be accomplished by a certified public
accountant who will charge separately for his services.
6. The fee quoted contemplates that court accountings will be waived or prepared by
others. If prepared by the attorney, this service will be separately charged at standard time rates
This agreement shall be binding on and inure to the benefit of the parties hereto and their
respective heirs, personal representatives, legal representatives, successors, and assigns.
G. Any outstanding balances not paid when due as agreed above will accrue an
Interest charge of 8% per annum from the due date until paid.
