Dear Property Owner:
Pursuant to the applicable provisions of Sections 901 and 902 of the Miami Shores
Village Code, a Village building official has inspected the above referenced property for
purposes of issuance of a Certificate of Re- occupancy. In accordance with Section 902(c) of
the Miami Shores Village Code, information gained or conditions observed in the course of such
inspection shall not be utilized by the Code Compliance Officers of the Village as a basis for
bringing code enforcement violation proceedings except insofar as they may relate to a violation
of the one family dwelling use requirement or with regard to structures that are unfit for human
habitation. Although, in the opinion of the building official, the re- occupancy inspection did not
disclose a violation of the one family dwelling use requirement nor did it indicate that the
structure is unfit for human habitation, and therefore a Certificate of Re- occupancy is being
issued by the Village, the inspection did, however, reveal the existence of certain conditions
which constitute a violation of the Village Code which we would like to call to your attention.
Specifically, in the course of this inspection the following conditions were observed:
Illegal aluminum structure attached to the NE section of the house. You must obtain the required
permits to either legalize the structure or to demolish the structure within 30 days.
As indicated above, this re- occupancy inspection cannot be utilized by the code
compliance officers of the Village as a basis for bringing code enforcement violation
proceedings with regard to this condition, but it is possible that, at a future time, some other
inspection or event might occur which could form the basis of a code* enforcement notice of
violation regarding this condition. The various Village Code requirements involved provide
important safeguards for the benefit of the individual residents and the Village at large and we
strongly recommend that you take all appropriate steps to bring this condition into compliance
with the Code. If you have any questions concerning how this can be accomplished, or the
nature of the violation, please feel free to contact me for further information.
Also, please note that neither the issuance of the Re- occupancy Certificate nor this letter
should be construed in any way as any representation or warranty as to the condition of the
property or any aspect of such condition, and that the apparent violation listed above is merely
something noted during the standard Re- occupancy Certificate inspection and may or may not be
the only violation currently present upon the premises.
