real property conveyed by this deed.
If SHELDON SMITH, JR. or SHIRLEY C. SMITH cannot continue to serve as TRUSTEE, then the
other shall serve as sole Tnrstee. In the event of the resignation, death or incapacity of both of the original
Cc- Trustees, the Successor Trustee automatically succeeds to the office of Trustee. The name of the
Successor Trustee is MICHAEL SHELDON SMITH. In the event of the resignation, death, or incapacity of
MICHAEL SHELDON SMITH, the name of the alternate Successor Trustee is LINDA MARIE BRIGGS.
All Successor TRUSTEES are hereby granted the power to protect, conserve and to sell, or to
lease, or to encumber, or otherwise to manage and dispose of the real property described in this deed.
In the referenced SMITH FAMILY REVOCABLE LIVING TRUST, dated March 13, 2002,
SHELDON SMITH, JR. and SHIRLEY C. SMITH, have retained accessory and possessory rights in the
subject real property which gives them a beneficial interest for their fife which can be considered to be an
"equitable title to real estate,° as that term is employed in Section 6, Article 7 of the Florida Constitution.
Any reference herein to the SMITH FAMILY REVOCABLE LIVING TRUST, dated March 13, 2002, shall
also refer to any and all amendments thereto and restatements thereof.

Any person dealing with the TRUSTEE shall deal with said TRUSTEE in the order as set forth
above; however, no person shall deal with a Successor TRUSTEE unlit one or more of the following has

A. The written resignation of the prior TRUSTEE.
B. A certified death certificate of the prior TRUSTEE.
C. The order of a court of competent jurisdiction adjudicating the prior TRUSTEE
incompetent or incapacitated, or removing said TRUSTEE for any reason.
D. The written certificates of two physicians currently practicing medicine that the
TRUSTEE is unable to manage his or her own affairs or is physically or mentally
incapable of discharging the duties of TRUSTEE.
E. The written removal or change of a Successor TRUSTEE and /or the appointment of
another Successor TRUSTEE by SHELDON SMITH, JR. and SHIRLEY C. SMITH. or
the survivor, swam to and acknowledged before a notary public; this right being
