Observations of the buildings' structural systems were conducted following Miami -Dade County procedural guidelines. On our initial site visit, minor conditions were noted and later repaired before the buildings were inspected again for preparation of the attached report. Based on the results noted in the report, it is my professional opinion that the buildings' structural systems are safe for the specified use and continued occupancy. In general, we have found the electrical system to be in good condition requiring no additional repair work. Based on the above and our report field findings, in our opinion, the electrical system is safe for its continued use and occupancy, we ask that the electrical system be re- certified for 10 additional years. April 20, 2009 To: All Owners, Residents of the Shores Plaza East Condominiums From: The Board of Directors Subject: 40 -Year Inspection of Our Buildings On April 15, 2009, our office received a certified letter from Norman Bruhn, Building Official of the Miami Shores Village, whereas in accordance with Miami - Dade County, Chapter 8 Section 8 -11, our buildings must comply with the Inspection /Certification of our entire property within a period of ninety (90) days from the date of their letter (4/13/09). The required inspection /certification is required on buildings forty (40) years old and older. The required inspection for our buildings is already overdue by several years. The Board is in the process of obtaining the third and final proposal from a qualified Florida Registered Architect or Engineer to perform the initial inspection and provide the report to the Miami Shores Village. Such report must be presented to the Miami Shores Village no later than July 13, 2009. Once the report is presented to the Miami Shores Village, the Association will have sixty (60) days to complete any and all required and necessary repairs, maintenance, updates, re- structure, etc..., in order to be in full compliance with the Miami -Dade Building & Zoning Dept. The scope of the inspection will comprise mainly the structural soundness of our buildings (walls, foundation, roofing, flooring, windows, proper lighting of parking areas, etc..) as well as the electrical service as it is supplied to the main electrical rooms and also to each individual unit. • Given the fact that our buildings are 60 years old, and even though the maintenance and up keep of our property has been praised by many visitors to our property, including Miami Shores Village officials as well as other professionals, this Association cannot determine or predict what expenses might be incurred by our Association to bring all of our buildings up to current standards. All owners will be notified well in advance of the required inspection. Mot important, the inspector(s) will need access to the inside °fat. 54 units to check structures as well as electrical installation. The inspectors will need access to the "electrical panel" of each unit for evaluation of the electrical service. It is imperative that all units be inspected at the time of the scheduled inspection so as to avoid additional costs of revisiting units not accessible at the time of the scheduled inspection. Of the three proposals presented and discussed, the Board voted on the firm of Pedraza Architects, Inc., registered architects in the state of Florida. Pedraza Architects, Inc., will be performing their inspection this coming Tuesday, May 12, 2009 starting at 9:00 a.m., they will be on the property until 3:00 p.m. Later that evening of May 12th, they will return to Inspect the "parking lots illumination" as part of the scope of their inspection. The inspectors have also scheduled Wednesday, May 13th, from 9:00 a.m. until 3:00 p.m. to complete the inspection if it cannot be completed on Tuesday, May 12th. The scope of this inspection will require the inspector to enter all the units in our complex as well as other common areas within our buildings. The individual unit inspection will comprise, but not limited, to the inspection of structural soundness of each individual unit as well as electrical installations. Most important, the inspector will need access to the electrical panel inside each unit — it is most important that they have easy access to this panel and same panel should be exposed for easy detection by the inspector. It is most important that the resident<p* the unit, preferably the current owner, in the case that the unit is rented or leased, be present at the time of the inspection. In any case or circumstance the inspectors will be allowed access to each and every unit. A Board member will be with the inspector to allow access to units whereas there is no one home to receive the inspector. It is most important that all resident comply with the requirements of the inspection. This inspection is mandated by the Miami -Dade County Zoning and Building Dept. and the Miami Shores Village, and it cannot be any further delayed. STRUCTURAL 1) Some owners have already replaced some of the broken windows; we are closely monitoring this problem and will be sending out letters to owners that have yet to complete these repairs. 2) Presently we have not inspected all the windows in need of caulking. Some unit owners have already proceeded to do their own window caulking. We will be inspecting all the windows and prepare a list of all units in need of this type or repair. We have been in contact with some vendors that do this type of work and will be obtaining proposals from them. 3) The windows altered to accept an A/C wall unit have not been repaired or corrected at this time. We will be speaking, as well as following -up in writing with the respective owner(s) to make sure that they complete the needed repairs / replacement. 4) We have already started working on the exposing/filling of the hairline cracks on our buildings. We expect to complete this project soon. This job requires extensive "prep" work as well as touch up painting of the areas. The work so far done is of very good quality. After discussion with you, we understand a permit will be required. We will obtain this very soon. 5) We have obtained several proposals to repair the "ponding water" problem in the flat roof of building "1" (726 NE 92 Street). All proposals received address this problem with the same response; the roof will require extensive work in order to properly correct the problem. The "ponding water" problem was addressed and corrected in 2008 by a licensed roofer (Paul Kawalek Roofing & Painting); apparently the job was not properly done and we are presently trying to contact that roofing contractor to find out what type of warranty or recourse is available to the Association to correct this problem. We have not seen Mr. Kawalek in the community and are concerned he made no longer be in business. Regardless of the outcome, the "ponding water" problem will definitely be corrected. ELECTRICAL 1) We have obtained the electrical engineer's drawings to correct the lighting problems in all our parking lots (3). We have also obtained two proposals required for this project. We have already spoken with one of the electrical contractors who presented his proposal and mentioned to him that we plan to grant him the contract. 2) 3) and 4) Shortly after receiving the "40 -Year Old Building Recertification" report we sent out letters to all the owners in our Association stating that several units, were in "code violation" in regard to the electrical panels as stated in the report. We specifically mentioned all the areas of concern mentioned by Mr. Pedraza (architect). The Association has not made a visual inspection of any corrections made by the unit owners. According to Mr. Pedraza, the Association need only to inform the owners of the required code compliance and the violation observed. We further have a list of the unit address of those found to be in violation by Mr. Pedraza and the electrical engineer that accompanied him during his inspection. A copy of the correspondence sent to those owners was forwarded to you as well as to the Miami -Dade Fire Rescue Dept., in June, 2009 Mr. Bruhn, as I mentioned in our telephone conversation we are trying our best to resolve the problems addressed in the 40 -Year Inspection report. Some of the deficiencies that need correction will be costly and will require time to be done properly. I want to assure you that regardless of cost to be incurred by this Association, the items in question will be corrected. We not only have to answer to the Miami Shores Village code compliances but also to all fifty -four owners in this Association. At this time we kindly and respectfully request to the Miami Shores Village to grant us an extension of time to complete all the projects that are pending. We are trying to complete these projects within the constraints of our already strained financial "budget" without having to assess our owners at a time when we know that many of them are going through financial difficulties. On Tuesday May 26th, the "report" of the 40 -Year inspection was hand delivered to our office, and the original report was delivered, as required, to the Miami Shores Village. The report outlines several deficiencies within our buildings which must and will be timely addressed and corrected. Within the scope of the inspection, the electrical engineer made an observation regarding the number of units that have a refrigerator in front of the electrical panel. This condition is not in compliance with code requirements. This association urges all unit owners to maintain unobstructed access to the electrical panel.
