The amount in dispute is $57,716.63, representing the difference between Citizens' estimate of $11,223.47 and replacement quotes from roofing contractors for $68,615.00 and $68,940.00. Background, Subsequent to Hurricane Wilma, an insurance claim was filed with Citizens due to roof damage resulting in numerous leaks and water damage throughout the entire house including in the living room, dining room, entryway, pantry, game room, breakfast room, kitchen, hallway and a bedroom, At the time the adjuster inspected the roof, I had not secured estimates from roofing contractors since, due to the tremendous number of South Florida homes with roof damage, reputable roofing contractors were extremely difficult to engage. After contacting numerous roofing contractors who either turned me away or wait - listed me, 1 was finally able to obtain two quotes for the needed repairs: for $68,615.00 and $68,940.00. A third quote was discarded due to contractor 03/05/2007 05 :47 3057566520 February 12, 2007 Citizens Property Insurance Corporation Page2of2 CONSULTINGALTERNATIV PAGE 03 measurement error. All companies concluded that the entire roof needs replacement because over 90% of the tiles are loose and damaged. In the time period between Citizens' inspection and my obtaining quotes from roofing contractors, Citizens issued a payment of $7,163.47 ($11,223.47 minus deductible of $4,060.0. Based on the reviews of three roofing contractors, this amount is simply inadequate to replace the damaged roof. Given the need to make repairs as quickly as possible, I signed a contract with Affiliated Construction Services, Inc., paid an $8,000.00 deposit in August, 2006, and requested a supplemental claim with Citizens. The roofing permit has been issued by the Village of Miami Shores. After the supplemental claim was rejected, I engaged Trevi Engineering Contractors Group, Inc. to perform an uplift test on November 18, 2006. The test concludes that the roof has failed and must be replaced. A copy of the test results was provided to Citizens on January 4, 2007. We are now facing the possibility of mold damage as well and request mediation be scheduled immediately. Please contact me at (786) 299 -1029 if there are any questions. Policy Number: 5462954 Date of Loss: 10/24/05 Dear Insured: We are in receipt of your letter dated January 4, 2007, wherein you are requesting payment for replacement of your roof based on the report from Trevi Engineering Contractors Group, Inc. The report states the test was "ON -SITE CONCENTRATED UP LIFT LOAD TESTING OF ROOF TILE IN ACCORDANCE WITH FLORIDA BUILDING CODE TEST PROTOCOL TAS -106." The Florida Building Code 2004, in the section for TEST PROTOCOLS FOR HIGH - VELOCITY HURRICANE ZONES, the section for TESTING APPLICATION STANDARD (TAS) NO. 106 STANDARD PROCEDURE FOR FIELD VERIFICATION OF THE BONDING OF MORTAR OR ADHESIVE SET TILE SYSTEMS AND MECHANICALLY ATTACHED, RIGID, DISCONTINUOUS ROOF SYSTEMS states in item #7 Load Application, paragraph 7.1.1 This test shall be carried out on all mortar and adhesive set applications after final completion of the application at a time stated in the Product Approval or as specifically approved by the manufacturer of the mortar /adhesive." In other words, the TAS 106 testing is for testing new roofs after installation, not on older roof such as yours. Based on this, we are not in a position to consider this report for the basis of considering total replacement of your roof. Please notify the Department of Financial Services of your intent to go to Mediation at your earliest convenience. Your claim will be forwarded to our Mediation Unit. My apologies for the delay in responding; we have recently suffered a death in my immediate family and my attention has been focused on providing for the wellbeing of the surviving minor children my older brother left behind. The issue in dispute is the scope of the damage observed by adjuster David Hansen, who estimated removal /replacement of concrete tile roof at 178 pieces. There are substantially more than 178 tiles damaged on the roof. So many more that each roofing contractor who has inspected the roof has recommended a total roof replacement. The claim payment of $11,223.47 ($7,163.47 minus deductible) is simply inadequate to repair or replace the damage. The enclosed uplift test, performed by Trevi Engineering Contractors Group, Inc. on November 13, 2006, indicates that the roof has failed the test and must be replaced. The areas in flogged in red are the same areas inspected by David Hansen, not new areas, Based on the reviews of three roofing contractors and confirmed by the results of the uplift test, the claim payment amount is inadequate to repair or replace the damage resulting from Hurricane Wilma which is substantially more than 178 tiles. By stating the above and providing a copy of the uplift test, I do not intend to waive any other rights which I have or may have under the above - referenced policy. PAGt it After a review of the policy you have with Citizens Property Insurance Corporation and the request for roofing and interior supplement, it has been determined no additional amounts will be forwarded at this time. The property was re- inspected by independent field adjuster Rene Gonzalez on 11/10/2006. The re- inspection of the roof showed no additional damages which would warrant a complete replacement. The additional interior damages would not be covered under this claim due to the information from Mr. Insured who stated these damages occurred during the rainy season which started approximately 8 months after hurricane Wilma. The DW2 07 04 policy provides coverage for: Perils Insured Against "PERILS INSURED AGAINST" We insure for direct physical Toss to property described in the Covered Property Section of this policy, when such property is described in the Declarations, caused by the "Perils Insured Against ". These damages would have to be handled under another claim due to the fact they were not direct physical damages from hurricane Wilma. Based on the re- inspection and the information from the insured we feel that the original estimate is fair and just due to the State of Florida's allowances. Both companies conclude that the entire roof needs replacement because over 90% of the tiles are loose and damaged.
