HEIGHTS OF TOWERS, CHURCH SPIRES ETC.
In preparation of this report the following were contacted:
Dade County, Miami, North Miami, Miami Beach, and North Miami Beach.
All agencies reported that provisions were made for special considera-
tion but each case was handled on its own merit.
Dade County said "the top of the structure shall not be higher above
its foundation than ninety percent of the horizontal distance from its
base to the nearest point on adjacent property under another ownership
or to the nearest edge of a highway right -of -way. There is also an
over all height limitation of 150 feet if approved by F.A.A. and meeting
requirements of the South Florida Building Code.
The City of Miami in residential zones limit height of towers to the
height of buildings permitted in the area. This height is 35 feet for
single family and 30 feet for apartment zoning..
The City of Miami Beach will allow a height of 25 feet above the required
set back. If the set back were 10', the height permitted would be 35 feet.
Radio towers are limited to 125 feet and there is required approval by
the F.A.A.
The City of North Miami limit height to 40 feet and plans must be
approved by:
1. Architectural Board
2. Board of Adjustments
3. Planning Board
4. The City Council
The City of North Miami Beach have a height limitation of 35 feet and
structure taller than this require a variance.

twenty -five feet from the lot line fronting on any street or
thoroughfare, for the first five feet additional height above
the thirty -five foot limits, plus one additional foot setback for
each five feet of such additional height. (Ord. No. 57 -19, § 29

Sec. 33 -58. Height of building limited to width of'street in
certain districts.
No building in RU-4, RU-4A, BU -2, BU-3, IU-1, IU-2, IU-3
or GU districts shall be of a height greater than the width
of the widest street upon which such building abuts, except
after application is made and permit issued as a result of
public hearing. (Ord. No. 57 -1 ' § 29 (G), 10- 22-57)
Sec. 33 -59. Fire resistive construction of building over 55 feet.
No building erected within the boundaries of any district
established by this chapter, or any amendment thereof, shall
exceed fifty -five feet in height unless of type 1 fire resistive
construction, as specified by the building code. (Ord. No. 57-
19, § 29(14), 10-22-57)
Article IV. Towers, Poles and Masts'
Sec. 33-60. Compliance with article.
Before erection of a water tower, standpipe, windmill,
tower or mast for any purpose, over ten feet in height above
the roof of a structure or over twenty feet in height if erected
on natural ground, the requirements of this article and the
construction requirements of the South Florida Building Code
shall be observed. (Ord. No 57 -19, § 28(B), 10- 22-57)
Sec. 33 -61. Plans and specifications to accompany application
for permit.
Plans and specifications for the structures provided in
section 33-60 shall be submitted to the director showing all

dimensions, size and kind of members, footings, guy wires;
location, depth and type of guy anchors and footings, type
and weight of antenna, apparatus or structures to be attached
to or supported by the structure, and application made for
permit. (Ord. No. 57 -19, § 28 (B) (1) , 10- 22 -57)
Sec. 33 -62. Height.

ises in a BU -3 or any IU zone, need not conform to the re-
quirements of this section, provided the same does not exceed
a height of 150 feet measured from ground elevation and the
same conforms to the provisions of the South Florida Building
Code; provided, however, that such installation shall conform
to the provisions of all airport zoning regulations contained

Amendment note —Ord. No. 66 -3 § 1, amended § 33.62 to except radio
towers, where incidental to a business or industrial use in a BU - 3 ' or
IU Zone, from the requirements of said section.
Sec. 33-63. Antennas for amateur radio stations.
Poles, masts and towers for supporting antenna used in
the operation of amateur radio stations licensed by the Fed-
eral Communications .Commission shall be excepted from the
above regulations and shall be governed by the following
requirements
(a) Location on property. All such poles, masts and towers
shall be placed no closer than five feet to an official
right -of -way line or to property under different owner-
ship, or closer than one foot to an easement. If beam
(array) type of antenna installed, no element or part
