The Building Department provides homeowners with a specific list of requirements regarding sheds. I was given this document and proceeded with plans for the shed. I completely fulfilled and adhered to every requirement that is listed (EXHIBIT I). The Building Official has interpreted the City Code in a manner that denies my permit because my property is non- conforming. I an applying for a hardship variance for the following reasons: (a) My home is nonconforming because it was erected nine years before the City of Miami Shores came into existence. Part of the reason Miami Shores is an attractive and unique community is because of the many historic homes throughout the city. (b) My home, like many others in our community, has an existing detached garage built close to the property line along the alley. The Building Official states that a shed cannot be placed within 15' of my garage, even though the published guidelines clearly state that the shed must be placed 15" from the "main" house. Since I don't live in the garage, we can all assume that this detached building is not the "main" house. The Building Official further denies the permit by stating that the square footage of a non - conforming property cannot be increased. While this part of the Code is correct, to state that an 8" x 10" utility shed increases the square footage of my home is almost laughable. (c) My family recently added a new member and we are in need of additional storage space. My property is large enough to meet the published setback requirements and therefore the proposed shed is certainly a reasonable use of the property. MEMO - Hardship Variance continued (d) I have excellent relationships with all my neighbors. I have vastly improved the property ,since purchasing it in 1993 when it was in derelict condition. The improvements were such that the home was featured in a walking tour sponsored by the Miami Shores Historic Preservation Board in 1995 (EXHIBIT II). The proposed shed will not be visible from the street and will be fully or partially shielded from view from all sides, so it would not disrupt the aesthetics of the neighborhood. Many other homes in the area also have similar utility sheds. It would not be detrimental to the area. EXHIBIT I NIIANII SHORES VILLAGE REQUIREMENTS ON SHEDS The only sheds that are approved by the Dade County are some of Ted's sheds and some of Sheds America. Permit application must be accompanied by: ♦ Two copies of letter from the State of Florida indicating that this is a "State Approved" shed. ♦ Two copies of survey showing location of shed and setback requirements written. ♦ Shed must be made out of galvanized metal or aluminum, no wood allowed. ♦ A concrete slab is optional when sheds have pre - fabricated floor. ♦ Slab: 4" slab monolithic footing 8" x 8" with one #5 bar with 6X6 #10 mesh . Slab needs to be 6" larger than shed all the way around. ♦ No electrical or plumbing fixtures are allowed inside a shed.
