AFFIDAVIT
BEFORE ME, on May , 2001, personally appeared: Anthony P. Zibelli and Heather K.
Zibelli, his wife who after being by me first duly sworn, deposes and says:
1. That Affiant is above the age of eighteen years, under no legal disability
and is a resident of Miami -Dade County, Florida.
2. That Affiant is the fee simple title owner to the following described
property (sometimes herein referred to as "Property").
Lot 12, in Block 91, Miami Shores Section Four, Amended,
according to the Plat thereof, as recorded in Plat Book 15 at
Page 14, of the Public Records of Miami -Dade County,
Florida.
3. That a survey was prepared on the property listed in item 2 above by
Lannes and Garcia. Inc. Survevors- Mappers -Land Planners, Order No. 53404 on
5 -14 -97 (sometimes herein referred to as "Survey ").
4. That since the date of the Survey, no additional improvements have been
constructed on the Property, nor have any improvements been constructed on adjacent
property that could give rise to an encroachment or other survey exceptions.
5. This affidavit is given to induce Neal S. Litman, P.A. and Attorneys Title
Insurance Fund to issue a policy of title insurance. Affiant further agrees to reimburse,
hold harmless and indemnify Neal S. Litman, P.A., Attorneys Title Insurance Fund for
any damage or loss they may suffer as a result of any inaccuracies set forth by Affiant
in this Affidavit.
6. Affiant further states that he /she is familiar with the nature of an oath; and
with the penalties as provided by the laws of the State aforesaid for falsely swearing to
statements made in an instrument of this nature. Affiant further certifies that he /she has
read or have has read to him/her, the full facts of this Affidavit, and understands its
context.
