My client is desirous of selling Lots 22 and 23 of Block 36 and requests that the Village of Miami Shores advise her of any prohibition against selling the subject lots independent of the East '/2 of Lot 20 and 21. In reviewing the title it appears that my client's father and mother, H. Roger Turner and Mary R. Turner, purchased Lots 22 and 23 with improvements from Bessemer Properties, Inc. in 1939. In 1949, the Turners purchased the East '/2 of Lot 20 and Lot 21 from Bessemer Properties, Inc.. Said parcel was undeveloped and has remained undeveloped. In anticipation of the sale, a survey was prepared by Nova Land Surveyors: According to the survey, the improvement (house) is situated on Lots 22 and 23 and does not violate any of the set back requirements. A copy of the survey is enclosed for your review. In addition, my client has applied for and obtained from the Dade County Tax Collector separate folio numbers for the division of the lots.
