Village property owners should be aware of the Dade Envi- ronmental Resource Management (DERM) agency's enforce- ment of Dade County's Ordinance #89 -8 which protects speci- men trees throughout the County and addresses permitting re- quirements applicable to tree removal. The Village's Code Com- pliance and Public Works Deparmaents must comply with this ordinance. Specifically. any tree (other than the species listed below) with a trunk circumference of 18' or greater at a height of 54" from ground level is termed a "specimen tree" and cannot be legally removed unless disease. trauma (such as vehicular acci- dent. lightning, etc.) or infestation renders the tree unsalvagable. Illicit removal of any specimen tree can result in very serious legal consequences based on the nature and scope of violations of the ordinance. Under extenuating circumstances, there are provisions within the ordinance to have specimen trees relocated (which involves posting a bond and additional compliance fac- ets). Homeowners are accountable for trees on their property; the Village's Public Works Department is responsible for rights -of -way trees (frequently fronting or bordering private property) and public facility trees. Just cause must be the means test for removal of any tree within the Village. Trees cannot be removed for arbitrary, aes- thetic or other inappropriate reasons. The Village's Public Works Department will fully comply with this ordinance and will not remove an otherwise healthy. thriving tree. Exceptions in the major tree category by species are:' Melaleuca. Australian Pine. Norfolk Island Pine. Schefflera and Brazilian Pepper. Medical documentation (For sensitivity. aller- gic reaction, etc.) provided to the Public Works Department is justification for removal of Melaleuca trees. Lastly. any healthy tree removed for approved reasons must be repiaced at the prop- erty owner's expense. Removal will not commence until the owner documents purchase and possession of a suitable replace- ment tree.
