It states there should be four reasons for my request. The reasons are as follows: 1)The alleged peculiar and unusual condition affecting the property. The peculiar and unusual condition is that the property at time of construction (in 1926) was built 7' from the property line which at the time was within code. There is very little I can do about this at this time_ I feel I am being unfairly restrained by this. 2)The alleged reasons why such condition make it impossible strictly to apply specified provisions of this ordinance to the property. The alleged reason why this condition makes it impossible to comply with this ordinance is that it is impossible to move the house over the 3' needed to meet the present setback code. 3)The variance in such strict application that the applicant believes to be necessary in order to enable him to make a reasonable use of the property. This house was built in the 1920's and is inadequate by today's standards. I am bringing it up to today's acceptable living standards by adding additional closet space and bath (presently the house has only one outdated and small bath). If this house where to be built today it would not adequately suffice a small family. 4)The reasons why the applicant is of the opinion that such a variance would be in harmony with the intent and purpose of this ordinance, would not be detrimental to the existing use or prospective development of property in the vicinity, and would not give to the applicant an advantage with respect to the use of his property that is not enjoyed by the owners of similarly situated property. This house has ample property for expansion to the east, which is where the proposed addition is to be built. I will in no way change the lines or look of the house from the street view if fact I am refurbishing the house which at the present time is in a dilapidated condition. This addition would in no specific terms distort or obstruct any neighbor or passerby's view in any direction. I am only doing what I feel is necessary to make the house liveable,I have no desire to infringe on anyone's property or to upset the natural look of the neighborhood on the contrary I would like to improve it. I would appreciate a vote of approval in this matter. Max and Elizabeth Praschnik Planning & Zoning Board Village of Miami Shores 10050 N.E. 2nd Avenue Miami Shores, Florida 33138 Dear Board Member(s): SUBJECT: Hardship Variance 59 N.E. 101 Street Miami Shores, Florida 33138 January 23, 1992 It has been brought to our attention that our recently purchased home, originally built in 1929, does not fall within the current Miami Shores building guidelines. Apparently, the home does not comply with the current, 10 foot easement required between property lines. Unfortunately, there is little we can do about this situation. At this time, we are requesting a variance to allow us to make improvements that are a necessity and not a luxury. The modifications to our home located at 59 NE 101 Street will not significantly alter the exterior appearance of the home. The appearance of the home is significantly outdated. It lacks many modern day conveniences such as sufficient closet space and a bathroom accessible to the master bedroom. Our intention is to update the home to meet the current standards without disturbing the historic charm of the house. We request the variance to build the additional bathroom /closet that will face the east side of the property and will not interfere with any neighboring property boundaries, nor further aggravate the existing encroachment.
